Ivy's Ownership

By Buying a Design / Adopt from me, Penvains, you the client affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected / cancelled with or without a refund, and / or a blacklist / public service announcement. Please note that these Terms of Service may be subject to change without prior notice.

These Terms of Service are in effect as of February 11 , 2020.

Section 1.0, Payment

• I have the right to decline an payment (offer, trades, ect.) for any reason, I am not required to specify why.
• I have the right to sell my designs and adopts for any price I see fit.
• Payment is to be made via PayPal only, unless specified.
• PayPal payment is to be done in USD (United States Dollars).
• PayPal payment is be done using invoices. The Artist will require the Client's PayPal email.
• The Client does not need to pay extra for any of the PayPal fees.
• Payment must be sent within 72 hours after confirmation.
• The Client has right to decline payment for any reason, you do not need to explain why, but sale will be declined and you do not own the design you tried to buy.

Section 2.0, (Re)Uploading artwork / Image rights

• I have the right to reploud my art to any social media (Twitter, Ko-fi, Tumblr, Instagram) and commission pages/examples.
• The Client may make minor edits to the completed commission (ex. Cropping, Adding text/ borders, Changing Brightness/ Contrast/ Hue/ Saturation...).
• The Client may use/ reupload the Adopt/Design for personal/ non-commercial use, but only if proper credit to the Artist (Penvains) and a linkback to any of the Artist's social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram) is provided.
• The Client may not use the Design for any commercial use unless discussed with the Artist beforehand.
• The Client may not claim the Design as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the commission.
• The Artist does not claim ownership to any of the Designs/Adopts after payment. Characters belong to their respective creator(s).

Section 6, Refunds.

• There is none when payment is completed
• The Client has right to decline payment for any reason, you do not need to explain why, but sale will be declined and you do not own the design you tried to buy.
• If payment is in pending stages, The Client will be refunded in full but The Client will not receive any files of the Adopt/Design
• If repeated signs of refunding/ habit of wanting a refund when in pending stages occur, you will be Blacklisted from buying my designs/adopts and even commissions
