PLEASE TAKE NOTE OF THE USERS HERE BEFORE TRADING MY DESIGNS

You may -

• A.1 - Resell the design for the same price it was bought at.
    - If said design has added commission work and personal work, feel free to add on the price of those. Do NOT add on the worth of free, gifted, and payment work.
• A.2 - Redesign the character in any way.
    - This includes things like gender, colors, species, accessories, etc. Do whatever you'd like, just keep it credited to me. For Toyhou.se specifically, you are free to credit yourself as a DESIGNER if you have made a SIGNIFICANT change to the design.
    - Do NOT change the character into an original species or convert them into a species, open or closed, without my explicit written permission.
• A.3 Gift, trade, or give the design away.
    - Please do not give the design to someone who you know I am blocking or have blacklisted.
    - This is not required, but if you are giving a design away for free and not as a gift, I highly prefer that it comes back to me. This does not constitute as a refund.
• A.4 - Use the character in almost any situation you desire.
    - Please use common sense and do not include them in unsavory scenes that openly endorse these themes, including but not limited to: Pedophilia/map/nomap/loli /shota/cub art, hate art/speech, zoophilia/bestiality, incest, proship, and things of the like. If this is not enough information for a general idea, you are free to contact me about it. (if you would like me to censor these terms lmk)
    - I am okay with regular NSFW artwork and fetish artwork as long as the character is a clear-cut adult. Pretty much everything else is A-OK, and if there is any confusion you are always free to ask.
    - If you have an idea for a design of mine to have a less-than-desirable backstory, go ahead. Do not romanticize the situation they've been placed in though! Also be sure to tag your content accordingly.

Please ask about -

• B.1 - Using the character commercially.
    - I will likely say yes as long as I get credit. This may change in the future.
• B.2 - Using the character for "breedables" or derivatives.
    - This is only in the monetary and trading sense, like with adoptables. Depending on how similar the new design is from the characters, the answer will vary. You ARE, however, free to use the character as a parent who creates offspring, though the resulting characters must stay with you permanently.
    - Copies and near-copies are absolutely NOT allowed.
• B.3 - Modifying the original artwork.
    - If it is simple enough, I'll likely just make the changes for you! I just prefer to be asked before any edits are made, though I will almost always say yes. If you make any edits, my credit must still be attached. I do not mind if you also credit yourself for changes.
• B.4 - Turning the character into a closed/open species.
    - For example: turning a cat base adopt into a Dutch Angel Dragon, or turning a cat base adopt into a Primagen. I do not mind the opposite of this, though! Just know you will likely be voiding the character from that species if the reverse happens.
• B.5 - Turning the character into a new original species, opened or closed.
    - This usually entails the replication of many of their key features among many designs, of which I am fairly uncomfortable with. We can work things out if insisted though.

You may not -

• C.1 - Sell the design for an inflated price without any extra artwork or valid additives.
    - Personal attachment is not a valid additive. If you are selling one of my designs for an increased price, all additional art MUST be visible. All art of past redesigns becomes VOID as soon as the new design is in place and the art of the old design does NOT go towards their total value. Going back to the previous design voids all added value of the redesign. Redesigns cannot be sold separately from previous designs.
    - If you are entertaining offers on a design of mine, I expect that this rule is respected. Do NOT take inflated monetary offers on my designs.
• C.2 - Claim you are the designer and/or leave out credit in important places.
    - Important places are like bios, offsite character profiles (like Amino or FurAffinity), reference sheets (on the sheet itself or in the description, either works), and other hubs of information for the character.
• C.3 - Force a refund without previous agreement.
    - I do not normally do refunds in the first place, so do not expect me to say yes. There are no grounds for a refund, what you see is what you get.
• C.4 - Knowingly give one of my designs to a blocked/blacklisted user.
    - My blacklist can be found here.
    - If you didn't know before sending them over, you aren't in trouble. Just know I'll probably ask about it if I discover you did.
    - If I find one of my designs currently in the pending process to a person I have blacklisted, I will message you and ask you to cancel it if it isn't too late to.
• C.5 - Impose your TOS over mine, regardless of circumstance.
    - If I am the original designer, my TOS holds priority over any others who may have had input in the design, such as redesigns of any level of significance. If you make a large enough change to the design to be warranted secondary designer credits, this rule still applies.
    - In the case of a collab design (ON CREATION), BOTH TOSes are considered EQUALLY and BOTH designers must be contacted.
    - Ignoring these rules is an immediate blacklist.

Miscellaneous -

• E.1 - Traded and gifted designs CANNOT be resold for their base price and can only be resold for any NEW art obtained AFTER the trade.
    - Digital currency (aside from Deviantart points!) is considered a trade and does NOT constitute a new base price.
• E.2 - Credit me in the first post you make of the design.
    - All links to my social media are on my profile. Use the one that matches the platform you're posting to or any other. You do not need to credit me in any other art you make of them if you do not want to.
• E.3 - All rules are also applied to customs.
• E.4 - If the design was co-created with someone else, check out their TOS too. If something conflicts, contact both parties.
• E.5 - Do not give my art and/or designs any labels akin to LQ, MQ, and HQ when trading, its incredibly degrading.
• E.6 - Do not put my designs into "shelters" of any kind. Trade them for free or send them back to me if you want them gone so badly.
• E.7 - Do not raffle off my designs via any methods.
• E.8 - Tradebacks are okay on my designs, but it is something I do not have any control over and must be agreed upon by the owner and receiver.
    - You must be the (most recent) previous owner of a design to request a tradeback from someone you are trading with. If you are not the most recent previous owner of a design, you may not request a tradeback.
    - I do not need to be notified of any tradebacks in place.
    - I will not moderate or enforce any tradebacks in place, it's all on the two participants. The most recent owner of the design holds priority over all others.
     - I do not support "forcibly" taking back designs and I do NOT allow this with my designs. I myself will reclaim the design if you are found doing this, your thievery will not be rewarded or justified.
• E.9 - By owning any design of mine, you agree to all of these terms.
    - It does not matter if you do not like me and/or are blocking me. If you no longer agree to these terms, you can trade the design back to me. You do not earn the right to disregard these terms as soon as we are on bad terms with each other in any way whatsoever.
