Darby's Ownership

Design T.O.S. Updated as of 05/2022 located here and perhaps a bulletin post and/or updated carrd. Includes a little bit of Art T.O.S. but not all of it. Feel free to send a DM/PM with any questions or clarification.

It is not necessary but it would be lovely if I can be authorized to see my designs if they are not visible to the public to be able to sort of keep track of them in cases of character “theft” or false ownership claims.

Failure to follow or comply to my Design T.O.S. will result in a blacklist from business-related transactions from me. I will not enforce, monitor or police this. Action will only be taken if found out or it is directly brought up to me. I will not and legally can not revoke ownership of designs/characters as they are no longer mine or under direct ownership hence the blacklist for discovered or reported offenders.

- Nothing made by D-Send as well as any other pseudos/aliases used by them may be used in any blockchain-related technology, to include NFTs (nonfungible tokens), cryptocurrency, or any future inventions in the space.

* It is recommended that designs are not exchanged on amino or facebook. Currently toyhou.se is my only listed/known public social platform for character designs/adopts, artworks I have made, and for archive purposes so please keep them/their profiles on-site if possible.

- Only one character profile/submission is allowed on-site. Due to this and to avoid disagreements or disputes, co-owning is not allowed. This includes “splitting” designs/forms of a character.

- Buyers or owners may freely sell, trade or gift designs. Resales is a grey area that I can not dictate so I ask politely that characters you did not make art of yourself or spent money on to purchase or commission something for be sold or sold for more (Ex. scalping/flipping) aka please be reasonable and/or fair if doing resales or trades involving value/money and don’t flip or scalp my designs and/or artwork to profit off of.
* Additionally if you received art or things of your character for free or through a trade I ask that you not put a value on it or use them to “add value” as it was done without payment or without a price-able value.

- Designs may be used freely/commercially (like creating merch, Vtuber, fursuit or mascot, etc.) however please respect the art T.O.S. for all artists. All artworks by D-Send (and any other pseudonyms they go by) (including references and original adopt images) may not be used commercially or be profited off of or edited to match any design changes or edits. You may use artworks by D-Send and any pseudonyms they use privately/personally and create merch but only for yourself and not for profit. 

- Designs may be edited and changed around including changing their base species: Ex. OG design is a dog but a feline design is created , as long as they are still recognizable and either drawn yourself as a reference sheet/artwork or it is commissioned. If you are unsure if a large/drastic change is too much feel free to send a DM/PM to check with me. I ask that you do not split up any and all designs/forms into separate characters or toyhouse profiles. All designs/forms must stay together in one profile page/character. 

* All OG images made by D-Send and any pseudonyms used by them must be kept on the profile even as hidden images as they most likely will not have any copies of the original files or images to be able to send to the current or new owner in case they are deleted or lost. To reiterate once more, all artworks and references or original images by D-Send and any pseudonyms used by them may not be edited or used commercially and/or for production, merchandise, promotion, etc. 

* Please do not splice (create “breedings” or “fusions”) my designs for character adopts or designs if it can be avoided. If for an art challenge/prompt that is okay. 

- If discovered or reported that you are breaking my T.O.S. you may be blacklisted from business related interactions with me. Meaning you will not be able to purchase or bid for designs by me directly and you may not also be able to commission or purchase art (YCH/art piece auction) from me.
