Important Information:

Terms of Service. (view on my website if easier)

By commissioning me, you agree to the terms of service below.

I retain all rights to my artwork, commissions or otherwise. I may use the artwork for self-promotion, including but not limited to posting on my website, Patreon, and other social media, portfolios, and commission examples.

Use:  ALL MY COMMISSIONS ARE FOR PERSONAL, NON-COMMERCIAL USE.

  • I will not take any commissions for any commercial use. This includes merchandise, V-tubing, and other things that can be monetized.
  • None of my artwork is ever for use in  NFTs. I will never make any NFTs of my art, and I do not authorize any.  If you see my work on a site selling them, it has been stolen.
  • I do not consent to my artwork being used in AI image generators of any kind, nor altered through them in any way.
  • My artwork should not be reposted to online art galleries or social media (such as twitter, instagram, facebook, pinterest, deviantart, ect). If you wish to share a commission you received or other artwork of mine, please share a direct link to that artwork, thank you.
  • Commissioners may repost the artwork I created for them on their toyhouse account with credit and a direct link to my toyhouse profile (nickyflamingo).
  • My artwork is not to be altered in any way. Do not remove my signature or my watermark (commissioners will be provided a non-watermarked version of their artwork).
  • Sketch commissions may be colored by their commissioner only (creating a collaborative work) with the following guidelines: You may not use the sketch or finished collaborative artwork in any commercial/monetized capacity, including making it into a base or adopt. Do not alter my lines or remove my signature. You may not use AI to alter any of my works, including to color or "finish" my sketches. If you post the finished collaboration, make sure to credit me for the sketch and link to one of my social media accounts, website, or my toyhouse account, whichever is most relevant to the place you are posting. Do not create any derivative works that change the nature of the sketch such as adding mature content or any content which is hateful or derogatory to any group. If I request you remove the resulting piece, you must do so.

Payment: I accept Paypal. All prices in US Dollars. Payment is due before work starts. Refunds not available once sketch is sent for approval, but please let me know if any changes are needed, I want you  to love your commission.

  • I will send you an invoice via paypal which will need to be paid within 48 hours of receipt unless otherwise agreed.
  • If you would like to add a tip to your payment, you may add a tip to the initial invoice, you may ask for either a separate invoice after the commission is finished, or you may use my ko-fi after the commission is delived. This is not at all required or expected, but as I’ve had people ask, I wanted to give the option.  My ko-fi can be found here. Thank you!

Refunds: If you would like a refund before I have sent you a sketch of your commission, please message me and I will refund you the price of your commission via paypal. Please do not begin a chargeback as I will handle it for you ASAP. If I have already sent you a sketch, I will only refund your commission price minus the cost of the equivalent sketch commission (full body, bust, ect). Once your sketch is approved, I do not offer refunds.

Time Frame and Work Flow: Please keep in mind that I will need some time to make the best art I can for you. I am usually working on several commissions and other artworks at the same time, as well as Patreon commitments. I do not work on a first in first out basis as I avoid burnout by working on multiple types and steps of artwork at any given time. In addition, as a chronically ill/disabled artist, I need to make sure to factor in rest and may experience periods of ill health. Because of this, while I aim to complete all commissions within 30 days, please be aware that I may need up to 60 days to complete your commission. If you need your commission by a certain date (such as for a gift), please advise me of this when requesting the commission so I can make sure it can be done on time; rush fees may apply if you need your commission on a short schedule. Thank you!

  • I will provide you a progress sketch for your review for most artwork types, with the exception of traditional sketches, digital line/sketches, and usually ACEOs as these are all quick commission types. I may sometimes provide progress sketches ACEOs if either I want to make sure I’m interpreting something correctly, or upon your request (feel free to request this at time of commission, otherwise I will just move quickly through that commission). For all other types of commissions you may request changes at the sketch stage and I will make the changes and request you to review again before moving on to the inking and coloring stages. With my traditional work, I cannot change the artwork once it is inked, so make sure to let me know what needs changed when I send the sketch for review. With digital works I can makes some corrections (such as a color being off or some small detail I missed while inking and coloring), but I will not make major changes that were approved at the sketch stage.

I have the right to decline any commission for any reason, but these are the usual reasons:

  • I do not work from descriptions alone and I require a color reference (or black and white if the commission is a sketch). I will decline a commission if no good, color reference is available. Please no small pixels to work from. These are not custom character designs; I'm working off existing references, not designing you a character, thank you. Working off descriptions only counts as a custom (which will be announced elsewhere if they are open).
  • Your character is simply too detailed for me to do justice. Extremely anthro characters (faces with muzzles and beaks like animals for example) and characters with a lot of armor are likely to be declined due to not being my forte. Please message me to ask if unsure and I can let you know!
  • I may decline portraits of real-life people, depending on the context. If you are looking for a portrait of yourself or a loved one, please be aware that a different price will apply which I can quote for you after understanding what you are looking for. I reserve the right to decline if I either can’t take the portrait on due to my current workload (real person portraits are much more time consuming) or if I don’t think I’ll be able to portray the persons well enough. Thank you for your understanding. This doesn’t apply to characters you have recreated based on yourself/loved ones that you have existing drawn references for (such as a fandom character rather than your actual likeness).
  • With traditional artworks, I will always do my best to match colors to the references provided, but limitations of markers and watercolors and matching traditional materials to digital references and variations of screens and scanners means there will always be some variation. If I do not have a reasonable match to your reference, I will discuss this with you before taking the commission. In addition, due to scanner limitations, sometimes very dark colors (such as above 70% gray, dark blue, and green) may cause some problems when used as skin tones due to detail loss, and very shading of bright oranges, yellows, and reds may also not be picked up well by scanners so those may also be difficult skin tones. I will discuss this with you before taking on a commission, if your character seems to be likely to not scan well.
  • Mature art: I will not create explicit artworks. This is not to shame, just to avoid having to make personal calls on them. I will not draw suggestive art of underage characters (I can draw younger characters but only in an age -appropriate manner). I am declining commissions for images depicting adult acts.
  • Characters, outfits, and other things based on AI images: I will decline working with characters, adopts, and outfits generated by AI programs. I am against AI generated images due to the ethical and legal issues surrounding them. I will ask for you to provide another character/outfit or decline the commission. I also will not draw anything associated with NFTs.
  • I do not take commissions for characters with gore, medical themes, and body/medical trauma themes, especially missing body parts and exposed organs/excessive blood. (I can discuss characters with missing limbs on a case by case basis. This is for personal trauma/mental health reasons, sorry).
  • I will not take any commissions for any commercial use. This includes merchandise, V-tubing and other things that can be monetized.
  • If you wish for me to work as an illustrator for a project such a print book, please email me with details of the project and contract/payment terms. Please keep in mind I cannot always accept large project work due to my health. Thank you for your interest.
  • A few other personal reasons I will respectfully contact you about if they come into play.

I have the right to cancel any commissions and refund payment.

My adoptables have a different terms of service which was provided to the owners of those adopts. Please see those terms of service (or request another copy from me) if you are the owner of one of my adoptables.

I have the right to update and change these outlined terms at any time.
