Hunibi's terms of service

By purchasing my art and adoptables, you automatically agree to the following conditions. Please read this entirely and carefully. 

These rules also apply if you bought my adoptables through someone else! if you are reselling an adoptable made by me make sure the new owner knows the rules! 

Payment rules for commissions and adoptables

• If paying with PayPal. The payment should be made through invoice method. I will ask you to provide me with your PayPal email address.
• ALL payments must be made with YOUR PayPal. Do not use anyone else their account to purchase from me. Please inform me if someone else if paying for you! (in case of vouchers)
• Payment is due in full up front. I will not work on your commission before I received full payment.
• Payment must be made within 24h. If you need more time please let me know.This is unless you have discussed a hold with me.
• Once you have made the payment I can not refund you. Please keep this in mind when commissioning me! Don't commission me if you cannot afford it after all.
• If you have bought a character from me I will not refund you. You are allowed to resell the design yourself for the same price as bought though.
• I rarely accept points. When I do accept points please wait for me to give you instructions on how to send me the points.

Commission rules

• I am allowed to refuse your commission for any reason.
• Please do not rush me.  Your commission can take up 1-2 months to complete and a max. of 3 months depending on how big the to-do-list is. 3 months usually doesn't happen, but I wrote it down just in case something goes wrong. You will be notified if there will be a delay. If you want me to work with a deadline we can discuss rushing fees.
• When commissioning me make sure you send me a clear reference of the character you'd like me to draw. If there are details that might easily be missed please point them out when sending the commission form to me.
• I will send a sketch of the drawing before lining it. When I do send the sketch, if you want me to fix any errors you see in it, please let me know during that stage. Once you approve of the sketch, you cannot ask for any more changes to the commission.
• You cannot negotiate making my commission prices cheaper. The prices I've listed are set and will not be changed (unless I specify otherwise). Any attempts to negotiate will be ignored.
• If I find your account suspicious , empty, hidden comments on profile etc. I have the right to decline your commission unless proven that your account is legit.
• I am not responsible when you lose the file of the drawing. I try to keep all files on my computer, and most of the time still have them, but if you lost the file for some reason and I do not have the file on my computer anymore either I will not be responsible. Please make back-ups of your files or make sure you can find them back on the internet (such as storage sites)
• You are not allowed to make profit of my art. The commissioned artwork is for personal use only.
• You are not allowed to use my art in any commercial ways. (not for fake or real currencies)
• Credit must be given if you upload my artwork. Only commissioners have the right to re post their commissioned artwork.
• There will be a watermark on the commissioned artwork. Please do not remove the watermark! If you would like a version without watermark please ask me.
• If you want to ask about whether you can or can't do something with your commission, don't hesitate to ask me!

Adoptable rules

• After you buy the character design its yours but, you must credit me for the original design. My designs are for personal use only though unless you buy commercial rights.
• You are not allowed to upload the original image at other sites. If you do have a good reason to upload it at deviant art, then please inform me about it and give me proper credits. (I only allow toyhouse if you credit my toyhouse account which is Hunibi)
• I do not allow more than one person to own my design. CO-owning is not allowed.
• I don 't accept trades for my adoptables unless the description says I do.
• You are allowed to resell adoptables  for the same price as you bought it for. Please do not sell my designs for more than what you paid for unless it includes COMMISSIONED art work. (Example: This means you are not allowed to resell an adoptable for $50 if you bought it for $30 etc)
• You are not allowed to resell or trade my adoptables to people on the black list (black list found at the bottom of this ToS)
• You are not allowed to sell adoptables you got through trades, gifts, raffles or OTAs (offer to adopts) You are only allowed to trade or gift them.
• When trading or selling a design made by me you are not allowed to combine them with another character you are reselling. This is to go against value raising. (Example: You are selling a design and have one of my outfits uploaded to their profile, but you have never used the outfit for this character. In this case you have to remove the outfit from the character's profile and may not add value of the unused outfit to the character you are selling. You may sell the outfit separately though) 
• You are allowed to trade or gift the adoptable. New owner must know about my rules. The person who got the character gifted can only gift it and not trade in the future. 
• You are allowed to make changes to the design once you purchased the adoptable, but please don't edit the original file/design. If you would like any edits on the original design please ask me to do it or ask for permission to make the edits yourself.
• Once payment is made I cannot refund you.
• When buying or offering on my adoptables please do not hide your comment or back out of it without giving me a reason to.
• I allow holds on adoptables, but only if you are 100% you are able to afford the adoptable on said date.
• The payment must be made within 24hours, if I haven't received the payment within without any reasons I will put the adoptable up again. (this is only if we haven't agreed on putting your adopt on hold)
• I decided the adoptable prices. I find it important that I feel comfortable with my prices. Complaining about prices is not appreciated. Please refrain from making such comments.
• Do not trace, steal, re-upload or copy my adoptables.  
• If I find your account suspicious , empty, hidden comments on profile etc. I have the right to not sell designs unless proven that your account is legit or agree to sending your payment through friends/family. This is a payment option on PayPal which I will only ask you to do the first time of buying from me. (this is only if your account is suspicious to me)
• I am not responsible when you lose the file of the drawing. I try to keep all files on my computer, and most of the time still have them, but if you lost the file for some reason and I do not have the file on my computer anymore either I will not be responsible. Please make back-ups of your files or make sure you can find them back on the internet (such as storage sites)
• I will take back the character if for some reason you need a refund / chargeback / take back your money. You will not be allowed to use the characters anymore and will be blocked from buying in the future.

Personal use rules (What can you use the OC for?):

• You can use the character for person al use. 
• Give the character a name, personality, change the clothes, gender, and colors (but keep the changes small, when making changes keep the original file) 
• You can use it for your story, avatar, to rp with. 

Commercial rules: 

• Commercial usage is allowed if commercial rights are purchased for the design.
• A Purchase of Commercial rights to the adoptable design will always be 100% of original price.
• Credit is still required for usage of my artwork, even if altered or edited.
• Using my designs to Vtube with is considered commercial use. Always credit the original design when using it as model even if altered.
• With commercial rights you are allowed to make any sort of merch and profit with the character but not with the artwork made by me. I will still remain the designer/creator of the design.
• Commercial rights don't need to be purchased directly with the adoptable. You can DM me for commercial rights of older adoptables or when you want to buy the commercial right of an adoptable later after purchase.
• Commercial rights are not refundable, and not allowed to be paid for in parts. 

Edit rules

• You are allowed to make changes to the design once you purchased the adoptable, but make sure to keep the original file as well.  
• I will not make any edits to designs unless requested upon purchase. Small edits are free.   
• If you ask for big edits on the design I might add a fee. This can be discussed. 

Black / Ban list:

Do not resell or trade my designs to these people.
