Commission TOS:

• I, the artist, own the copyright of the art and full and exclusive rights to the original image
  • You may repost the art; but you MUST credit me and/or link to my social(s)
    • Clients may alter my artwork as they please, including finishing an image, cropping it, recoloring it, or using it as reference.
      • Clients may NOT trace over my work and claim it as their own. Do not trace or steal my artwork.
      • Clients may NOT claim my artwork as their own if they choose to alter it. 
      • Clients may NOT turn my work into NFTs under any circumstances.
  • You may NOT use my art to make a profit; However,
    • You MAY buy the copyright from me if you wish.
      • Once you have done so, you may do with the art what you will, save for violating my TOS.
  • I am allowed to put art on merchandise in order to make a profit, however:
    • I will not do this for original characters or content.
    • I will not do this if requested not to.
  • I reserve the right to post commissioned images to my galleries on various websites, however;
    • I will not do this if asked for a commission to remain private.
    • I will not put images on specific websites if asked.
    • I retain the right to use commissioned images as commission examples.
• You are asking me to draw in my style; do not ask me to draw in another style.
• Communication with me can be maintained over Discord (Ac3Kat17#7143), E-mail ([email protected]), or DeviantArt/TH Notes. I am unlikely to respond to other messaging platforms. Discord preferred!
• I have every right to deny your commission at any time. See below for refund policy.
  • Reasons for cancelling a commission may include: Supporting NFTs, ghosting me, refusing to pay, requesting me to draw something I am not comfortable with.
  • I will draw: 
    • Humanoids 
    • Flatfaced anthros
    • Most CS (Ask!)
    • Gore (to the best of my ability) 
    • Ship art (Ask!)
  • I will not draw: 
    • Ferals
    • Muzzled anthros 
    • Mecha
    • Overly complicated designs (I know my limits)
    • Fetish art
    • Hate art
    • NSFW art
• If the commission is cancelled (by me or the client), refunds will be given in full before work has started on the image 
  • If I stop drawing your commission after some of the work has already been done, you will recieve compensation equal to the amount paid minus the value of the artwork already created.
    • EX: If I stop drawing your commission but have already finished the sketch, you will recieve the sketch and compensation equal to the amount you paid minus the value of the sketch.
      • No refunds will be given for completed or nearly completed comissions.
        • If I have sent an unwatermarked completed work, absolutely no refunds will be considered. 
      • If a commission has remained uncompleted for over 3 months without a clear reason from me, the artist, the client is entitled to a full refund.
• Do not hound me for an ETA; I have a life and will get to your commission in time.
  • If there is any delay on my end, I will let the commissioner know. 
  • Generally commissions during non-school months will take around 1-2 weeks to complete. Commissions taken during the school year may take much longer to complete. 
    • Do feel free to poke me if I am taking too long! 
  • Asking for WIPs is completely fine, however if you repeatedly poke me, please understand if I become annoyed.
    • WIPs will not be provided for sketch commissions except to clarify certain details.   
• PLEASE USE THE COMMISSION TEMPLATE!
  • Please note me with your full specifications and if you want the commission to be private or not!
  • Clients must provide a full (with relevancy to the amount of art being purchased. I cannot create a fullbody from a bust reference) visual or written reference. 
    • Visual references are highly preferred, and although I will accept written descriptions, it is massively helpful if the client would provide a mock-up or visual reference along with their written description.
• In terms of redraws and revisions:
  • I will send a WIP at any point in time if asked.
  • I will allow 5 minor edits and 2 big edits up to the sketching phase. Once the picture is inked, there will ONLY be small revisions made, and once the image is colored, I will ONLY do color-correcting. 
    • A minor edit would be changing the way the hair falls on the face, or changing shoes/accessories.
    • A big edit would be scrapping the entire sketch and changing the pose entirely, or changing the outfit a character is wearing.
      • For sketch commissions, what is considered a Big or Small Edit will be reviewed on a case-by-case basis. I will not allow complete scraps for sketch commissions.
  • If I make a mistake in my interpretation of a character (outfit, gilding, details), please let me know ASAP so I can correct it!
• In terms of payment:
  • I only accept USD over PayPal or Venmo.
    • I will accept alternate payments in Art, DA Points, or Discord Nitro, but ONLY if these things are specified and/or agreed upon beforehand.
  • I expect payment upfront within 24h, but:
    • If you do not have all of the money necessary, you can pay me half upfront and half once the sketch is finished. I will not proceed with the commission until I receive full payment. Please let me know if you are going to do this.
      • If a commission somehow costs more than $100, I will take a three week payment plan, with $50 upfront and $25 each following week.
      • Commissions costing upwards of 100$ may have payment plans reviewed on a case-by-case basis. Payment plans are not expected (or accepted) unless agreed upon beforehand.
  • I will have a base price for most types of commissions, however:
    • I will add a fee if the character is complicated (wings, complicated armor, etc.)
    • I will add fees for backgrounds or accessories (See my commissions page for more information)
  • Do not send me money until I tell you to.
• If these terms are broken, I will blacklist you and ban you from purchasing artwork from me.
• My TOS is subject to change at any time. Changes will not be applied retroactively. 
• By paying, you agree to these terms.

ADOPT RULES:

1. You may NOT sell a design you bought from me for more than you bought them for, unless they have extra art. Price extra art accordingly; don't overinflate the price of a design by me.
   1. Do not sell/gift/trade designs by me to people on my blacklist. This will result in a blacklist.
2. You MAY change things about the design. Gender, Outfits, Fandoms, etc are all acceptable things to change.
   1. You may make alternate versions of a character design by me; CS versions, alt outifts, AUs, etc are all acceptable
3. Payment MUST be done via PayPal, Venmo, or in DA Points within 24 unless we have explicitly agreed to something else.
   1. If an art payment is being made, I understand that it takes time. I would appreciate an ETA, but this is not required. The adopt will not be handed over until the completion of the artwork. 
   2. I accept holds for up to one week. After the time allotted is up, the character will no longer be held.
   3. If OTA; 
      1. When offering, offer something of a similar value to the design I am offering. I will not accept uneven trades. 
      2. Please don't offer me Ferals, MLP, Mecha, FNAF, or Anthros unless they are CS. It is highly unlikely I will accept.
4. You MUST credit me for the design and link back to my page (preferably TH, but any social will do) at least once.
5. By paying, you agree to these terms.
