A good TOS?

Do you have a TOS?

What are good things to add to a TOS ? I've never had one but I feel I should.

generally i just copied a bunch of the stuff i’ve seen , like ‘all art is for personal use only’ and ‘no refunds unless x’ and that kinda stuff

really it depends on the type of art your doing? like if you’re making art for someone’s game, the personal use thing wouldn’t really apply for that, but it would apply more if you’re doing fanart/ocs 

in the separate paypal invoice version, i put that there’s no address needed and that there’s no physical goods being shipped in case somebody feels like being crafty with chargebacks 😒i make it painfully clear that it’s digital goods because then i have a better chance of paypal siding with me or at least so i’ve heard

then you can just not have a paypal specific terms :0 no matter the currency most tos have similarities !

it’s useful to just kinda like .. look around the art marketplace and see what people’s tos are like!

I'd like to think my ToS is pretty good? I have the following things in it...

Notes on when it was last updated, in case anyone is commissioning me for a second time

What rights I and the commissioner have to the image

What the commissioner can/cannot do with their image

What I will and won't draw

How to pay and queue information

Refund information

Commission details, what the commissioner needs to show/tell me in order for me to be able to make their image exactly how they want it

Image edit info

Art progress, how long it will take to complete a project and WIP info

And lastly, I have a FAQ, with nothing in it yet lol

SonieTheDog has some super good points! I few I would add are...

-Edit guidelines during the art process. How many free edits and how large then can be before a fee will be applied. This helps stop those who ask you to keep changing details (not because they are wrong, just because they thought of something new or wanna add stuff) that were not discussed before hand or added to how much it would take and thus the price.

-Contact info. In case they need to get a hold you of outside of DA or wherever in case the site goes down or someone gets too busy. Having a separate email just for commissions is a good idea for this.

-Useful links. Sonie mentioned the queue and it's good to have a direct link to the queue in case someone needs to find it. Linking to your FAQ, other art sites, etc are good too.

-If you do adopts you can add in an adopt only section for them. It would help cover some things a general TOS might not. Of course if the TOS is about adopts and not commissions then it would be a moot point.

-Delivery policy. How will you be giving them their files? Dropbox, GoogleDrive, DA stash? Will you be giving them a watermarked file for web posting and a large file?

-Posting. Going off of the delivery policy. Can the client post what they have gotten? Can they only post the 'web' approved version? I know this sounds silly but trust me it's good info. I've had clients ask if it was okay to post the images I've drawn for them multiple times to adding it in can save you some questions.

It dosen't hurt to go around a few other artist's TOS to see what they do, and take notes on what they feel is important to mention and not to see if it applies to you.

I looked at a lot of ToSs before I made mine. I wouldn't say it's perfect, but have a look! Remember that it is your policy and to tailor to what you think is best!
