Terms and Conditions for CommissionsLast Updated: August 29, 2023Please read these Terms and Conditions ("Terms") carefully before commissioning artwork from me ("Arcade_Anon"). By commissioning artwork from me, you agree to be bound by these Terms.

1. Commission Process1.1 Order Placement: All commission requests must be submitted through Discord Direct Messages (DMs) or via my designated platform or website.1.2 Payment: Payment for all commissions must be made in full upfront before work on the commission will commence. I accept payment through PayPal, Venmo, and Cashapp. Pricing for commissions will be as agreed upon between us.1.3 Queue and Priority: Commissions will be fulfilled in the order they are received, and priority will be determined by my queue. I reserve the right to adjust the estimated delivery time depending on my current workload. You will be informed of any changes in the estimated delivery time.2. Artwork Usage and Ownership2.1 Artwork Usage Rights: You will receive personal, non-commercial usage rights for the commissioned artwork. This includes the right to display, print, and share the artwork for personal use only.2.2 No Modification: You are explicitly prohibited from modifying the commissioned artwork in any way, including but not limited to alterations, edits, or additions. I retain all copyrights to the commissioned artwork, and it must be used in its original form. I may take legal action against any unauthorized modifications or uses that violate this condition.3. Revisions and Refunds3.1 Revisions: I will provide you with a preliminary sketch or concept for approval before proceeding with the final artwork. You may request major revisions up to three times at this stage. Additional revisions beyond this limit may incur extra charges.3.2 Feedback: If you are unsatisfied with the preliminary sketch or concept, it is your responsibility to provide clear and constructive feedback to help guide the revisions. I will make reasonable efforts to address your feedback and make necessary changes.3.3 Satisfaction: While I will make reasonable efforts to accommodate your requests and revisions, please note that I am not responsible if the final artwork does not meet your personal aesthetic preferences or expectations. Artistic interpretation is subjective, and I will execute the commission to the best of my abilities based on the information and feedback provided.4. Cancellation and Termination4.1 Cancellation by You: You may cancel your commission at any time, but if work on the commission has already begun, I may retain a portion of the payment to cover work already completed.4.2 Cancellation by Me: I reserve the right to cancel a commission at any time due to unforeseen circumstances or reasons beyond my control. In such cases, a full refund will be provided to you.5. Communication5.1 Communication: Discord Direct Messages (DMs) is the preferred method of communication. You agree to maintain open and respectful communication with me throughout the commission process. Failure to do so may result in cancellation of the commission.6. Privacy6.1 Personal Information: Your personal information will be kept confidential and will not be shared with third parties unless required by law or agreed upon by both parties.7. Blacklist7.1 Blacklist: Anyone on my blacklist is prohibited from commissioning me, and they cannot have someone else order on their behalf.8. Third-Party Sites8.1 Third-Party Sites: I may use third-party sites, but they will all be found linked back to my Carrd: https://arcadecom.carrd.co/.9. Jurisdiction and Copyright9.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Texas, United States, for matters related to copyright infringement.10. Chargebacks10.1 Chargeback Policy: You agree not to initiate a chargeback for any reason. In the event that you initiate a chargeback, you will be immediately blacklisted, and further commissions will not be accepted from you.11. Requesting a Deadline11.1 Deadline Requests: You have the right to request a deadline for the completion of your commissioned artwork. I will do my best to accommodate reasonable deadline requests. However, please note that the agreed-upon deadline may be subject to adjustment based on my current workload and schedule. I will communicate any changes to the deadline promptly.12. Rush Fees12.1 Rush Fee Policy: Rush fees may apply if you request an expedited completion of your commissioned artwork within a shorter timeframe than what is typically required. The specific rush fee amount and conditions will be communicated to you at the time of your request. Please be aware that the availability of rush services may vary based on my current workload.13. Crediting Artwork13.1 Crediting Artwork: If I choose to post the commissioned artwork created for you on any platform, I will provide proper credit to you as the client. The credit will be given in a manner that is reasonable and customary for the platform on which the artwork is shared.By commissioning artwork from me, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
