Agreement

By commissioning me, you agree to the following:

  1. Terms and conditions outlined in this document

  2. You are of legal age and have the financial capability to purchase digital goods and services

  3. You will not file for disputes or chargebacks and agree to contact me first if you want a refund or corrections for your commission

General Blanket Terms

  1. If you're using my works, remember to credit me!

  2. I reserve the right to use any of my finished pieces and process leading up to my finished pieces in my portfolio(with an exception for those who commission and pay a privacy fee).

  3. I reserve the right to accept or decline any offers that have been made in exchange for my works.

  4. I reserve the right to cancel any offers for my work should the need arise. A refund is in order if the work is paid for.

  5. If you commission me, especially for commercial works, I will browse your social media profiles wherever and whenever I can. This is a safety precaution in order to filter out possible bullies/bigots/scammers/other dubious entities that I would not like my work to be associated with.

  6. Generally, my illustrated works will be signed. If it is, please do not remove said signatures.

  7. You cannot under any circumstance claim that you made my work.

  8. I don't accept crypto for payment.

  9. I do not support NFTs. If you see my work on an NFT in any capacity, THAT’S NOT ME — it’s a fraud.

  10. I do not work with AI generated designs. They are too risky in terms of copyright, developed by companies that are too shady in terms of business ethics, and the results are too dubious in terms of consent and ownership. Selling them to clients feels like a scam.

Commission Process

  1. Slots are granted through direct message(DM) inquiries on any of my social media accounts or through a VGen.co/Artistree.io request.

  2. Accepted clients will be notified and sent an email and/or DM on the social media/commission hosting site used to first contact me.

  3. The client will be given 7 days to reply to the email/DM to establish contact. If a client fails to respond within the allotted time, the commission slot is forfeited.

  4. Invoices will be sent via VGen/Artistree or directly via PayPal.

  5. Slots are officially reserved and work will begin once payment is made. Payment plans can be discussed.

  6. For illustration commissions, the price must be paid in full.

  7. For commissions worth $150 or over, installment plans made of up to 2 installments are an option.

  8. For Live2D art or rigging, installment plans of up to 4 installments(2 for Live2D art, 2 for rigging) are an option.

  9. If you choose to pay via installments, you will only receive the full product once full payment has been made.

  10. Updates will come in the form of pictures, videos, or test models and will be sent through DMs or email. Clients will also be given access to a project tracker on Trello.

  11. The commission is considered done once the final product has been approved by the client or has ghosted contact for 14 days after payment(grace periods may be given).

Commission Timeline

  1. If the commission has a specific deadline, it is encouraged to tell me as soon as possible.

  2. Illustration commissions are generally done within 7 days to 1 month of starting the commission. Illustration commissions with a deadline sooner than 7 days are considered rush orders.

  3. Character design commissions are usually done within 2 weeks to 1 month. Character design commissions with a deadline sooner than 14 days are considered rush orders.

  4. Live2D related commissions are generally done within 1 to 2 months of starting the commission. Live2D commissions with a deadline of sooner than 1 month are considered rush orders.

  5. Do note that this artist takes breaks during the weekends, please do not expect much work done if it is a Saturday or Sunday.

  6. This artists area is highly prone to natural disasters. If updates become infrequent, feel free to check up.

Deadlines & Extensions

  1. If the artist believes they won’t be able to finish the commission before a deadline, they will contact the client to state their reason and ask for an extension.

  2. If the client refuses the extension, the artist will issue a refund.

Privacy Policy

  1. Please note that the client or artists legal name, country of origin, address, and other personal information may come up and be known to either party during the commission process, specifically during payment if the clients PayPal account is not a business account.

  2. Both the client and artist solemnly swear not to share any of each others personal information and reserve to use it only during cases of dispute or providing proof of work to relevant government bodies or banks.

Revisions, Updates, & Client Feedback

For regular illustration or character design commissions, the client will be sent updates directly and using Trello during (a)the sketch phase, (b)the base color phase, (c)the rendering phase. Each phase is a chance for any sort of correction or edit to be brought up. Other minor updates can be tracked using a provided project tracker.

For Live2D art commissions, the client will be sent direct updates during the same phases as normal illustration commissions(sketch, base color, rendering).For rigging commissions, direct updates will be sent when the following have been rigged: (a)eyes & mouth, (b)head angles (c)expressions(if applicable), (d)once the rig is nearly done. Other minor updates can be tracked using a provided project tracker.

Free & Paid Revisions

First of all, clients are highly encouraged to provide feedback and to be communicative during the commission process to ensure accuracy to what the client wants.Minor revisions are free, however, there is a threshold for the quantity of minor revisions that depends on the order. If a client is nearing that threshold, the artist will be sure to tell. Once the client has used up all their free revisions, the artist will propose a price(which can be discussed) for any minor revisions moving forward.Major revisions at any point are not free. A list will be provided for what counts as a major revision. If you're not sure what you want could be considered a major revision, you may consult with the artist.

Major Revisions for Illustration:

  1. Anything that will majorly change the composition of the artwork(pose, composition, angle, etc.) passed the sketch phase

  2. Additional key elements to the work(additional characters, background elements, drastic changes in color palette or lighting etc.)

Major Revisions for Live2D:

  1. Change of clothes or character design

  2. Additional animations

  3. Additional expressions

  4. Revising parts that are already rendered/done

When giving feedback, it is highly encouraged to double-check and be as descriptive as possible. Try to put everything down in one go as if all corrections to be made will be final. This is to waste no time and make sure all corrections are substantial so the client & artist does not have to go back and forth for every little thing.References are highly encouraged.

Fees

The client will be charged additional fees when:

  1. Too many revisions have been made(price will be discussed)

  2. The commission has more elements in it than what is included in the purchase such as additional characters, expressions, animations, etc.(price will be included in the quote)

  3. The commission is a rush order(+30% of commission total)

  4. The commission is an illustration to be used for commercial purposes(+50% to 100% of commission total)

  5. Waitlist fee: the client wants to secure a slot without having to wait for commissions to open(+20% of commission total)

  6. The client wants the commission to be private & unused in my portfolio until stated otherwise(+10% of the commission total)

Refund Policy

In general, either party can ask for a refund before the final product is delivered. However, once the final product has been delivered, all sales are final. There are stipulations.

Full Refunds:

  1. The client has requested a refund before any substantial work has started(before the artist is done with the sketch)

  2. The project has been terminated by the artist

  3. The artist cannot fulfill a commissions deadline and the client has rejected the extension

Partial Refunds:

  1. The sketch is done(70% refund) *with the exception of sketch commissions(no refund)

  2. Base colors are done(50% refund)

  3. Partial rendering is done(30% refund)

  4. Only the eyes, mouth, head Z, body Z is done(70% refund)

  5. Head XY and/or Body XY is done(50% refund)

  6. Expressions are done(30% refund)

NO Refunds:

  1. The rendering for an illustration/model art commission is done

  2. The rigging is in its physics phase, unless it’s the artist who terminates the commission

  3. The client has not been honest about their satisfaction and withholds their disapproval or feedback throughout the commission process, only to seek a refund after progress is irreversable

  4. The client has ghosted for 14 days or more after payment has been made and neglects to communicate or acknowledge progress despite being sent updates and having access to a project tracker(grace periods may be given if the artist sees fit).

  5. The client has received the final work

Intellectual Property and Commercial Usage

Client:

  1. The client must not claim the artists work as their own and must give credit.

  2. For illustrations, simply do not remove the artists signature.

  3. For commercial works such as Live2D works, character designs, illustrations, or merch designs, the client must give credit. Put a link or handle that leads back to my website or accounts in their social media biographies, item descriptions, Twitch and/or Youtube channel descriptions.

  4. Character design commissions already include commercial rights to said design.

  5. The client may use Live2D works for commercial purposes such as streaming & social media graphics.

  6. Clients will not be able to access the editable Live2D file, they will only be provided the file ready for face tracking. Corporate clients OR clients willing to pay a +50% fee are the only ones able to access the editable Live2D file.

  7. The client may not use any of my works for NFT related activities.

  8. The client is not to use my works in training AI models. I do not support the companies who made the current models for AI image generators. I may or may not change my views depending on how it develops further in regards to business ethics but until then, assume I don't use nor want to use my works to train AI.

Artist:

  1. If the client files a chargeback, the artist has the right to modify the work and resale to cover the cost.

  2. The artist has the right to use their work in their portfolio, promotion of their other works, and posting of WIPs with the exception of those who choose to hold the commission under a nondisclosure agreement which may incur a fee. This fee makes up for the cost of lost marketing opportunities and inquiries.

  3. The artist is allowed to use assets available to all artists and models.

  4. The artist is NOT allowed to resell finished & approved commissions.
