Unforgivable Behaviour. Proof for all of the following statements.
-Using art & designs without permission from the original artists for commercial purposes which violates several artist's TOS. (used their artwork for a "fantribe" and profited off of it through myo and design sales)
-Copying the Nel'oth species design to making off-brand Nel'oth designs called "Snakehorns" which look nothing like a snake, nor have horns.
-Intent to buy, void, then resell Nel'oth designs as the off-brand species without changing the design.
-Violating Nel'oth TOS that they agreed to when owning a Nel'oth by refusing to redesign voided Nel'oths into something that does not resemble a Nel'oth.
-Threatened to un-credit artists that wanted their art to be removed. Proceeded to re-uploading art and characters with no credit & removing artist's watermark/signature.

My Credit Info

Last updated: September 22, 2023✦ By purchasing my art/designs, you automatically agree to my TOS + DNI & Blacklist
✦ I have the right to decline my services to anyone.
✦ Violating my TOS will result in getting Blacklisted
✦ Ghosting me after telling me you will commission me/ buy an adopt will result in getting Blacklisted. Please don't waste my time with making me think you're giving me business.
Seriously, just tell me if you can't go through with it and it'll be Gucci with me.✦ I can and will use my artwork for personal and self promotional purposes.
✦ I do not have, nor plan to use permanent storage for art files but I do keep them for at least 2 months. It is your responsibility to save any files you want to keep.
I am 18+, therefore NSFW art of my designs are 100% okay. By commissioning me for NSFW art or adult themes, you agree that you are at least 18 years of age.

Payment

✦ In USD via Paypal Invoice only (Goods & Services). I will require an email to send the invoice to.
✦ I expect to be paid a day or two before I start working, however if you are fine with paying further in advance then please let me know.
✦ I will only start working on the commission once I've received 100% of the agreed upon amount up front.
✦ Payment plans are available for large commissions (over $150) however it is not preferred. If only 50% of the commission is payed for, I will only do 50% of the work, and finish it upon receiving the full payment. If the rest of the payment is not given then you will only get whatever I've completed.
✦ When I let you know that I'm ready to work on your commission, I expect you respond within 5 days otherwise I will ask the next person and you will be pushed back 1 spot. (only applies if I have a list of commissions)
✦ Invoices are set to expire in 10 days and must be paid by then unless you notify me about any issues.✦ For auctions, only bid if you are sure you are able to pay. If you need to retract a bid, you MUST contact me first. Retracting bids more than 2 times/ Ghosting/ Refusing to pay/ will result in a blacklist and the previous bid will be accepted.✦ All purchases are final. Refunds will only be given if I deem that I am unable to work on the commission. In that case a refund will be given depending on how much work I have already done. I will only be able to issue the max amount that won't put me at a loss.
✦ Issuing a charge back will result in you being Blacklisted.
✦ Ghosting will result in a blacklist.
✦ I am not responsible for irresponsible spending,✦ In the event that I prematurely pass away, you accept that a refund is not to be expected and my family is not be harassed for it.

Artwork Rules

✦ You may use it for personal and display purposes, only if the image belongs to you!
(example: profile icon, profile decoration if the character belongs to you)✦ Do NOT edit my work without my permission! This includes removing my watermark! You must ask me if you would like to make minor edits.✦ Art commissioned from me may only add its paid-for value to a character’s overall value.
✦ Artwork that I have made for free or traded for has no monetary value but can still add some value to the character overall.✦ All copyrights of the image (not the subject) belong to me, regardless of whether or not the image is shared by a different user or used in association to a specific character.
✦ Any art given to you; commissioned, gifted, or otherwise, is for personal enjoyment only. You CANNOT monetize/use any of my work commercially or use as advertisement without my permission!
If you would like to use an image for commercial purposes then please contact me.✦ My art will NEVER be associated with NFTs and Cryptocurrencies.
✦ My art is not to be uploaded to AI databases.✦ I reserve the right that at any time I can request you remove my art from a character that belongs to you.
✦ I reserve the right that at any time I can request you take down a post with my art on it.
✦ I reserve the right that at any time I can demand you remove my art that is being monetized or used for commercial/advertising purposes if there is no agreement between me the offending party.✦ Uploading art/designs that belong to you is okay as long as you ASK ME IN ADVANCE and inform me which platforms it is on! You MUST give credit! Tag or @ me
✦ Uploading to Toyhouse to the correct character(s) is accepted.

Adoptable/Design Rules

✦ Do not claim that you are the original designer. Removing me as the designer or creator will get you blacklisted.
✦ Owners of my designs MUST have a toyhou.se account.
✦ I MUST be credited for the designs I create (or species if applicable) each time it is used.
✦ Sexualizing/P*rn of my feral designs are strictly prohibited.✦ Do not resell my designs at a higher price without added personal or commissioned art.
Art obtained for FREE has no monetary value but can still add some value to the character overall. Do not abuse this and inflate the value beyond reason.
(Original price + commissioned artwork + value of your own artwork)
✦ Designs that were originally obtained through a TRADE with me can be resold. The base monetary value will be determined by me based on how much I belive the design is worth.
✦ Designs that were originally made for FREE will not be able to be resold.
(such as a raffle/gift/DTA design, or for charity)
✦ Give-a-way/Gift/Trading is okay! (unless specified otherwise)
My designs do not loose their original monetary value if traded or gifted!✦ You CANNOT make a species based on/with any of my designs without my permission.
I reserve the right to turn any of my designs into a species (excluding custom designs).
✦ If the design is part of someone's species; you should know what those rules are and adhere to them.Regarding Redesigns:
✦ Feel free to change/alter the design. You may also change the species.
✦ Any redesigns for any designs made by me that belong to a closed/semi/open species must follow that species' design/redesign rules.Regarding Species Concepts:
✦ You MUST give me credit for the original concept. (not the same as ownership)
✦ You MUST agree to allow me to be permanent artist for the species until I decide to resign. (As I may want to make some MYOs and adopts for funsies).
