❥❥ GENERAL GUIDELINES

❥ Through out this document, the "I", "me", and "my" all refer to the owner of the service and artist, Choaru. "You" and "your" refers to the client that has commissioned the work.❥ Please communicate clearly and well-mannered. Any form of ill-will or disrespectful actions/words will NOT be tolerated.❥ Commissions are NOT first come first serve basis. I hold the right to decline the commission.❥ ANY Commissioned artworks are for PERSONAL usage only, and under NO CIRCUMSTANCES can be used for-profit or as merchandise UNLESS discussed and contracted prior to the beginning of the sketch phase.

❥❥ COPYRIGHT / USAGE RIGHTS

❥ I retain full copyright of all artwork created during the commission process and the final original image. (This includes any WIP shown and the final artwork.)❥ I retain the right to use the commissioned artwork for promotional purposes. (ex. posting on social media and personal portfolio) If you, the client, do not wish for your commission to be made public, please detail this in the commission form.❥ You are allowed to repost the commissioned artwork for nonprofit usage on any platform (ex. Toyhou.se, ArtFight, etc.) ONLY if there is proper credit to (@Choartsu) as the artist, or a direct link to one of my social media accounts in a visible and accessible location on the post.❥ Removal of my watermark/signature from the final artwork without my consent is prohibited unless previously discussed with you, the client, and I, the artist, have provided a non-watermarked version.❥ Tracing, editing, or major altercations to the final artwork in any way is FORBIDDEN unless I, the artist, have given consent.

❥❥ NFT / AI Art Statement

❥ Any artwork commissioned from me, the artist, by you, the client, are STRICTLY FORBIDDEN to be turned into and/or sold as any form of Cryptoart and Cryptocurrency (ex. NFT [Non-fungible Token ]) and/or used in any projects related to the sale or promotion of Cryptoart and Crytocurrency.❥ Any artwork commissioned from me, the artist, by you, the client, are STRICTLY FORBIDDEN to be used and uploaded to AI databases and/or used in any projects related to the sale or promotion of AI art.❥ Any form of violation of these terms will result in you, the client, losing all rights to the commissioned artwork. (This includes any and all usage rights being revoked for any previous artworks you, the client, have commissioned from me, the artist.)

❥❥Payment and Additional Charges

❥ All payments will be made via PAYPAL (USD only). In the case of limited-time commissions, payments will be made through Ko-Fi (USD only).❥ Payment through PayPal will be handled through PayPal invoice. You, the client, have a _48-hour period to pay off the invoice, unless discussed prior to sending out the invoice.❥ Failure to pay off the invoice within the time period without any prior communication from you, the client, will result in the commission being placed on hold or cancelled.❥ I will provide a low-resolution WIP (sketch) to you, the client, and once we reach an agreement, FULL PAYMENT will be required before I, the artist, finish the commission.❥ Depending on the complexity of the character, the commission may be subjected to additional charges. (I, the artist, will state the reasoning after reviewing the commission form.)❥ You, the client, are allowed TWO revisions to the final image. Any additional requests will be charged ($10 + per additional change).

❥❥ Cancellation / Refund Policy

❥ Should you, the client, request a cancelation of the commission before I, the artist, have started, a FULL REFUND will be issued to you and the commission will be canceled.❥ You, the client, are permitted to request a FULL REFUND should there be zero contact on the status of the commission over a 4 month period.❥ Once the sketch has been discussed and agreed upon between, you, the client, and I, the artist, NO REFUNDS will be given per request of the client.❥ I, the artist, reserve the right to cancel the commission at anytime without explanation; however, the client(s) will always be notified and be issued a REFUND.

❥❥ Workflow

❥ Commissions will take between 2 weeks to 2 months depending on commission queue and other personal commmitments.❥ If there is a specific date the commissioned work needs to be completed, please note in the commission forum and you, the client, and I, the artist, can discuss if the request is possible.❥ Works in progress (WIPS) are exclusively given during the sketch stage and will include: composition and base colors.❥ Unless a specific date is discussed prior, please do not rush me, the artist. (Please give a week before inquiring about the progress of the commission after your, the client's, last inquiry.)

❥❥ Final Disclaimer

❥ All communication between you, the client, and I, the artist, will be conducted via Twitter DM or email. Conversations should strictly be about the commission, and any messages not pertaining to the commission will be ignored.❥ You, as the client, must respect that you are commissioning artwork in my, Choaru, art style, and there may be slight differences between the samples in the examples and gallery and the final artwork you will receive.❥ By commissioning me, Choaru, you have established that you have READ AND COMPLY with the terms listed above, and understand that failure to abide by the T.O.S could result in cancellation of your, the client's, commission and possible blacklisting.
