Adopt T.O.S

• Open Adopts

✧Reselling

When reselling my adopts please try to keep the price close to what you actually paid for.

✧Commercial Use

When buying my OCs you are also buying the rights to use the adopt for commercial projects.
You must credit me in the case of commercial use. If you earn more than 2000$/monthly or 20000$/yearly through a product using my adopt I am obligated to a 15% commission of the earnings.

✧Credits

You must credit me if you are using my adopt commercially.
If it's just for private use you're free to credit me but it isn't necessary.
Do not remove my watermarks without my permission.
Do not claim my work as yours or someone-else's.

✧Design Changes

You may change everything about the adopt as long as it isn't a closed or semi-open species.
You must get approvel for changing body features and traits for closed and semi-open species adopts.
Outfit changes, genderbending, humanizing or anthropromorphing are generally allowed.

✧Returns

I do not accept returns.
Once bought the transaction is irreversible, unless I offer myself to take them back.
If you try to revoke the payment (PayPal G&S etc.) you will be blacklisted and I might make a post about you to warn other creators. (Even if you try to send the OC back.)

✧Auctions

Only bid if you are able to complete the offer.
After the auction is closed I will expect the payment within 48h unless we agreed upon something different.
If I haven't received the payment within the set timeframe I will ask the next highest bidder if they are still interested.
If you're not the person who closed the auction you're not obligated to take the adopt.
If you're not interested I will simply ask the next person in line.
Do not drive up the price to ward off other potential buyers without purchasing.
If the character is also listed as OTA, offers will always go before bids. (If I get an offer I prefer I will take that, even if you ABed.)

✧Transferring Time

You will receive your adopt within 48h of purchase, unless agreed upon something else.

✧ToyHouse

Do not take my characters off of ToyHouse or reupload them without telling me as I would like to still keep track of them.
You are allowed to trade or sell to someone who does not have TH but you must update the profile on their behalf. If needed I can provide Invite Codes for potential buyers.

✧File

I usually just send the character over via TH, but upon request I can send you the files via email, on other platforms or upload them to a service such as Google Drive for you to download.

✧Payment Methods

I take money via PayPal, giftcards or bank transfer.
My primary virtual currencies are DeviantArt Points and Amino Coins.
Usually my commissions are in real life currency or virtual currency exclusively.
Other stuff I am willing to do an exchange for are characters, MYO Tickets and art.
Feel free to offer other items, currencies or services but it is likely I will decline.

✧Payment

I will ask for the full sum upfront. If we have worked to together before I may offer half upfront half after finishing, but am not obligated to do so.

✧WIP

I will send you a picture of the sketch to check if everything is satisfactory.
After that I might not always send updates regularly.
Feel free to ask me for a WIP if you're eager to know how it's going.

✧Timeframe

When opening commissions I will usually state in the post how long they will take. Depending on workload, size and motivation they might take longer.
Traditional usually takes less time, than digital. General time is around a month for digital and 2 weeks for a traditional piece.
If I take longer than the stated time you may ask for a refund.
If I haven't started yet I will refund you in full.
If I made some progress already I will only charge for the finished parts. (Example: You ordered a shaded bust, but I only lined it yet. In that case I will charge you for a lined bust and refund the rest.)

✧Cancelling

You can only cancel an order if I haven't started yet.
If you try to revoke the payment (PayPal G&S etc.) you will be blacklisted and I might make a post about you to warn other creators.
You may try to cancel again if I take longer than the agreed timeframe. (Timeframe rules apply)
I have the right to refuse or cancel your commission and refund you, at any time and for any reason.

✧Changes

I will check in after finishing the sketch to see if everything is right.
After that I can only offer small changes. (Up to 3)
I will not do major changes such as different poses, expressions, outfits for free unless I made an error interpreting the reference, that wasn't clear from the sketch.

✧Altering Artwork

You may not alter my artwork in any way unless agreed upon. (Stickers, filters etc are okay if you visibly state that these edits took place and were not made by me.)
You may not remove my watermark or crop the piece with the intend to hide the watermark.

✧Copyright

I, the artist, hold every right to the produced drawing, not the commissioner. Therefore I am allowed to post the art on my own platforms.
If the art includes your characters, by commissioning me you are allowing me to use the character and share the artworks on my platforms. I will not use it commercially unless agreed upon by both parties.
You may repost the art but it must be visibly credited. If I am active on the platform you're posting it on would like to be tagged. (No "@ /username")
You may not turn my art into NFTs.
The art is personal use only. If you are planning to use it commercially please message me to discuss a commercial license.

✧Value

You may use my artwork to add value to your character.
You may not use a higher amount than what you paid for.

✧Referencing

Do not steal, trace or heavily reference my art without permission.

✧File

I usually just send the art over via TH, but upon request I can send you the files via email, on other platforms or upload them to a service such as Google Drive for you to download.

Trade T.O.S

✧Creator T.O.S

I don't care if you retrade or resell an OC right after, but please mind the original creator's T.O.S because they might not allow that.
I'd generally recommend reading their T.O.S before going through with a transaction.

✧Transaction

Don't send any money, virtual currency, characters etc over or start drawing art if we haven't discussed a deal and agreed to it yet.
If you do so I will take it as gift/donation. I'm not obligated to give you anything in exchange if I haven't agreed. Don't try to bully me in to a trade. I will block or ignore you if you do so.

✧Holds

I usually do holds for up to 2 weeks. I may chat with other potential buyers in the case of the person I'm holding the OC for not going through with the transaction.
If you don't have the full sum yet and can't gather the rest in the timeframe of 2 weeks I can offer to hold them for longer if you do a down payment of at least 1/4 of the price agreed upon.
If you do not go through with the transaction after all I will keep the down payment as compensation, since I could have sold it to someone else in the meantime.

✧Partial Payments

If you are planning to purchase an expensive OC of mine or several at once but don't have the full sum, I can offer you partial payments. Usually it would be 1/4 upfront and the rest on a monthly basis, over the course of several months. If that model doesn't work for you or if you are able to do weekly payments for example I'm open to negotiate.
The OC/item will be on hold for the agreed timeframe.
If you don't finish the transaction, I will reopen offers for the OC/item 2 weeks after the date the transaction was meant to be completed.
I this case I will keep the incomplete sum as compensation for the timewaste.
