Terms of Service

BY COMMISSIONING ME, YOU AGREE TO AND UNDERSTAND THE FOLLOWING:

Please read the following page carefully.
These terms are to protect both the artist, and commissioner and by purchasing my services and art, you automatically agree to the terms and conditions of service outlined below. When filling out a form to request a commission, you will be required to acknowledge that you have read this page in full. It is the customer's responsibility to read and understand the Terms & Conditions prior to the purchase of any work. The artist will assume that the customer has read the Terms & Conditions. It will not be the responsibility of the artist to ensure that the customer has done so.Any disregard for the Terms & Conditions may result in a refusal to work with the customer. If you are not comfortable/willing to accept these terms, you may not request a commission. Any attempt to violate these rules will result in an indefinite blacklisting of services.
I retain the right to change my terms at will.

You are purchasing digital goods.

Digital goods do not require physical shipment to a physical address. You will not be receiving a physical copy of your commission unless otherwise discussed. You will receive your choice of an email or direct message containing the file(s) associated with your commission or a link to an online storage system where the file(s) associated with your commission can be found. If you do not choose between email or direct message I will automatically send a direct message.

⛔NON-FUNGIBLE TOKENS / CRYPTOCURRENCY / AI⛔

Clients are not permitted, under any circumstances, to use any part of their commission for AI image generation and non-fungible tokens (NFTs).I also do not accept cryptocurrency as payment. Note that I will never sell/resell any of my work whatsoever as non-fungible tokens.
If my work is found listed as a non-fungible token or resold for cryptocurrency, it is not permitted and is stolen or a direct violation of my work.

🪺 GENERAL USAGE 🪺

All work is automatically priced and considered to be for personal usage.

Under personal use, the client may do the following;

✧ Re-post artwork if adequate credit is provided.
✧ Make personal modifications.
✧ Use the original artwork for personal use such as forum icons, banners, character webpages.
✧ Create physical prints of the artwork for personal use, or as gifts.

⭐ COMMERCIAL USAGE ⭐

This list is not comprehensive and may be added to at any point in time.

Commercial use may be defined as follows;

✧ Usage in promotional material, content, and websites.
✧ Usage within mediums/platforms where the client receives profit (eg. Patreon, Twitch, YouTube, etc.)
✧ Reproducing and selling the artwork.
✧ Merchandising.

✧ Purchase of commercial usage MUST be communicated in clear terms with the artist, prior to or after completion of the commission.
✧ If the client has not paid for the rights for commercial use, the commission is considered to be for personal use.
✧ Commissions can cost x2-x3 of the original price, depending on the scope of its commercial use.

⏳ GENERAL TIMELINE ⏳

Availability for commission work revolves heavily around my day job and health. I work in manual labour and during busy periods this leaves me exhausted on every level (mentally, physically, emotionally). As a result you may see fluctuation in regards to the speed at which I complete commissions.Additionally I have several mental health problems, some of which are diagnosed and some of which I'm seeking diagnosis for. While in general I'm adept at managing these issues they still do affect me on a daily level, and can easily take the wind out of my sails every once in a while.If you'd like to follow the progress of your commission you can find my Queue here

DEADLINES + RUSH FEES

✧ By default, there is no set deadline, as I work 5/7 days of the week in manual labour.
✧ If the client requests a meaningful deadline (e.g. a birthday gift, holiday piece, etc), I am willing to accept rush orders with the addition of a fee.
✧ Rush fees are at least +25% of the commission, but may also depend on the project and timeframe provided.

💸 PRICES AND PAYMENT 💸

Please ensure that you have the funds to pay if you are requesting a commission.✧ Currently all payments are in USD through PayPal.
✧ Clients are required to pay in full for commissions of $50 and under.
✧ For commissions above $50, half upfront deposit is required and the other half will be invoiced after the project is finished.
✧ Additional payments may be requested later down the line, such as in the case of partially paid deposits, requested additions, or fees due to excessive edit requests or other extra work.✧ I price my work based on demand, the amount of time per piece and labour.

💳 REFUNDS 💳

Refunds will only be applied in case I have to cancel your order due to personal matters or health issues. Clients can be refunded in case the first deposit has been made and no significant progress has been made. The amount of said refund will be based on the progress of the project.✧ First review — 90% Refund*
✧ Second review — 50% Refund*
✧ Start of rendering — NO Refund*Remember. If payment has not been made yet, then nothing is owed from either parties.❗ Refunds will not be provided for orders under $50, barring emergency situations or if the refund is of my own volition.❗

🚫 CANCELLATION 🚫

✧ I have the right to cancel a commission at any time for any reason.
✧ Abusive behavior towards me will result in cancellation of the commission, potentially without refund in the most extreme cases.
✧ In the case of cancellation at my discretion, the client will be refunded accordingly, following the guidelines listed above. If I cannot provide a refund immediately that will be communicated with a clear timeline of when said refund will be issued.

⚖️ CHARGEBACKS ⚖️

❗ Chargebacks will result in a permanent ban from future commissions. ❗✧ This is considered a method of abuse and exploitation, most commonly used as such, and will not be tolerated.
✧ In the case of custom orders or character designs I reserve the right to resell completed designs, should the client issue a chargeback..
