TERMS OF SERVICE

Update:11/2023| GENERAL |By purchasing anything from me, you agree with my terms of service.♦ Buyers by default have the rights to re-post, print or minor edit their commissioned work and adoptables for personal use only. You cannot trace or draw over my artwork without explicit permission.♦ Any commissioned or existing artwork, including character designs are not allowed to be used for AI art purposes or crypto related purposes such as NFTs. This is non-negotiable.♦ If you desire to purchase art or a design for commercial uses, the customer must contact me first to discuss details of it. A licensing fee will be charged in this case.♦ I have the right to deny any commission without providing reason.♦ I have the right to blacklist certain clients without providing a public reason.♦ I have the right to post my artwork anywhere I choose to promote myself as an artist. If you do not want your art to be displayed online for such purposes, please talk to me beforehand.| COMMISSION PROCESS |♦ Look at my prices before commissioning me so you have an estimate of the prices and type of art you are getting. When you request for a commission I will give you the quote of how much will be charged, and complexity fees will be added in the initial process depending on what your order is.♦ If you are unsure if your order is going to fit within your budget, please let me know your actual budget so we can figure out what works best for you.♦ You can only commission me to draw things you own or have explicit permission to use, with exclusion of fan art of popular media, or indie media that does not prohibit profit over their IP. You hold all responsibility about what is being portrayed. If you happen to not have permission to commission a certain character/design, you will be the one who will have to deal with legal issues if that is to happen.♦ Please check the art limits section to see what i will draw, and won't draw art wise.♦ Please provide a clear digital reference of the character(s). No traditional reference sheets without digitalized color palettes.(Color palettes being provided digitally are fine) No blurry or low resolution/quality JPGs where the character isnt recognizable. Colors must be clear and concise. If your reference is shaded or has altered coloration, I will likely end up using those colors for your commission, and will not correct them if base colors were not provided in the reference sheet.♦ My artwork will have an amount of artistic liberty. I will not replicate specific art styles of other small artists, and popular media styles are only for special types of commissions. I will try my best to satisfy what you've requested in the commission type, being faithful to the examples you've asked, but I do have a certain freedom of expression.♦ My style usually follows a slightly more semi-realistic style in which I use anatomical features that match the species given, unless it's a mythical creature. If you want me to ignore certain features and purposefully stylize it differently, warn me beforehand.♦ I may end up posting other art content before your commission, whether it be someone else's commission, personal art, or adoptable designs. This does NOT mean I have forgotten your commission or am ignoring it. I work on multiple things at once, and some pictures take longer for a multitude of reasons. If you think I am taking too long with your commission, you are free to contact me to ask for progress (Although be mindful, one week without updates is not a long wait.)♦ The average wait time of a commissions completion is of 1 to 3 months. Some commissions may take a bit more depending of the request, but if you need your artwork to be done at a specific period of time, discuss with me beforehand. any deadline that isn't set beforehand will be charged extra to fulfill it within the time period.| EDITS |♦ Edits can be requested as I send previews for approval. I will always send a sketch for approval before continuing with your commission. You can ask for edits up to 5 times per step for free as long as they are not edits already done or regarding a previous approved step. I will not work on alterations of a picture composition when I am in the lining and coloring stage, for an example.♦ After the 5 edits, any other change in that step will cost $5 per edit. If more than 10 edits are done overall, each extra edit will cost 15$ regardless of which step is it. I will inform you of how many edits you can ask for each step, and remind you of my Terms of service as I do so. Once the final result is approved, you cannot ask for any more edits.| PAYMENT |♦ I do accept Paypal USD dollars through invoices only. An email must be provided so I can request it. This terms of service will always be linked on the invoice and you must agree to it.
♦ The payment must be sent upfront before starting anything. For safety reasons, I will not accept commissions without this.
♦ Unfortunately, I cannot give full refunds right away upon request because of my living situation. If you are dissatisfied with a commission, please inform me while I am working on it. I'll note you in the sketching process to check if it looks alright, and any tweaks can be made then.
♦ Payment plans are an option for orders of $200 dollars or more.|REFUND POLICY |♦ If you want to stop the commission and ask for a refund, contact me first before trying to file any chargebacks. I will offer a manual refund instead. If you issue a chargeback, you should be able to prove that I was neglecting you and not communicating regarding a manual refund.
♦ I will refund you the full money if i havent started on your commission, if the commission has already been started and in the sketching stage, you can get a 50% refund.♦ If you order a chargeback in any other process without a warning, you will be blacklisted and exposed as a beware to warn other freelancers and the art will be repurposed in any way i see fit.| ART LIMITS |♦ Things I have experience in drawing:
-Anthropomorphic characters with emphasis on animal species that are not very common place in the fandom.
- Fictional species.
-Animals, monsters and fantasy creatures.
-Humanoid, human and fantasy characters
-Cute art.♦Things I am currently working to improve, and will likely be experimental if the option is offered:
-Backgrounds
-Limited palette pieces
-Perspective pieces/foreshortening
-More realistic artwork.♦ Things i will absolutely not draw:These are some things I am particularly not comfortable with drawing, and I'd appreciate it if commission requests with these themes are not even sent to me.-R-18 content for minors, of minors or remotely related to characters that look underage.
-Nonconsensual content, nsfw content involving feral and real animals, Underage content.
-Unsanitary content containing bodily fluids.
-Ideologically sensitive, prejudiced, bigoted content. I am LGBT friendly, and a minority so if you're seeking for that kind of content you are at the wrong place.♦If you're interested in commissioning anything nsfw that you think I might be comfortable with, please note me privately to ask over email or @lighterium on furaffinity and we will discuss it over properly.| ADOPTABLE AND DESIGN INFO |♦ I do accept Paypal USD dollars through invoices only. An email must be provided so I can request it. This terms of service will always be linked on the invoice and you must agree to it.♦ The payment must be sent 48 hours within a claim, unless a custom, which will be paid upfront instead like commissions.♦ When Working on a custom design, extras may be charged depending on the complexity with patterns, accessories and more detailed features if they stray from the agreed concept by your choice.♦ The edit section works the same way as with commissions.♦ I can also do extra pictures and references of the design upon request, but more money will be charged to do so. Depending on certain ideas, a discount can be applied as a special deal.♦ Once you Purchase the design you are allowed to trade it as you desire. However you cannot resell it for higher than what you paid for unless there is commissioned art of the design or the value of your own art. Trades that have no monetary amount or usd equivalents (i.e. art trades amounting to a commission price do) will not count to the design's worth.♦ Do not claim that you've designed them, and if the design has a redesign, credit me for the original concept. I have a Toyhou.se with the same username as my other social medias, so you can credit me there as well.♦ You can create different versions, species, forms, alter gender, etc of the character, but all versions must be resold or traded as one. Do not keep one version of the character and trade the other if they share too many design similarities.♦ Do not make the design into a closed/semi-open/open species without asking me first. That will fall under commercial use. Having them as a certain species in your personal story or work is fine.♦ Do not clone designs for profit. Do not breed your design with the intent to justify creating similar designs for sale.♦ For closed species adopts, please notify me/the species masterlist if available if you trade them. Most have masterlists to keep track of their ownership!♦ I am not in charge of co-ownerships, and will not be involved if conflict over designs occur. I will not make decisions for my designs after my designs have been sold or assign ownership if things go sour. Please be aware of this when co-owning designs.♦ You cannot tell who can own a design of mine once you let go/sell them.

Design conversions

♢ One fullbody of a character designed by your custom specifications.
♢ I can work with any kind of designs, human, anthro, fantasy, fandom. Don't be afraid to ask about a type you're interested in.
♢ I can also create alternate form for an existing character as long as yo own it, or are commissioning it for a consenting friend.
♢ I am also able to do designs using the symmetry tool
♢ If you are stuck on the description of your design idea, use the custom form on this google doc.♢NOTE: I do not lower my custom prices if you want a headshot design, a bust design, etc. My custom prices reflect the time i spend researching and studying character design.

Reference sheets

♢ Reference sheets usually contain one fullbody/edited fullbody with an outfit/back view with one extra chibi and a bust. These are priced $175
♢ More complex reference sheets will cost more, please message me for a quota.
♢ Backgrounds remain fairly simple, with patterns, halftones,etc. I can also use free scene pictures upon request.
♢ I offer the option of one fullbody to be drawn in a reference-like pose and an extra fee for clothes/edits. that would be $130 USD
♢ I am also able to do symmetry references.
