Section I - GeneralThe artist has the right to refuse a commission without reason.The artist reserves the right to cancel a commission and issue a refund due to poor communication, rude or inappropriate behavior, or inability to communicate in clear/effective English, or unforeseen inability to complete the commission.No AI / NFT art is allowed in any references I recieve and for commissions, trades and requests. Using AI / NFT art out of my character designs is not permitted.
Using my art for AI / NFT is not permitted.
The client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the client has agreed to the above and below terms.Section II - Payment and PricesAll payments are in USD.Payments are through Paypal Invoices. Checks are accepted if it seems fit for certain circumstances. The artist will not accept payment in any other form.Prices are subject to change according to the size, complexity, and/or detail of the piece at the discretion of the artist.Full or a percentage of a payment plan payment takes place after the artist accepts the commission.Payments must be made in full or a percentage of a payment plan within 48 hours of the invoice. If paying with a check, payment must be paid in full or percentage in 10 business days. Once payment has cleared, the client's commission will be added to the artist's work queue.Payment plans will be accepted depending on the project. Depending on how big the project is, my turnaround time can change to more than 2 months to complete! The client can offer a turnaround time and we can discuss further from there.All communication logs, forms, and payment information will be kept for at least 180 days after the invoice is paid.Due dates or rush orders will incur up to a 50% fee depending on the time window given for completion and project size.A group commission must be paid for by 1 (one) person in order to avoid complications and miscommunications.Final prices on commissions are non-negotiable.Section III - Process/Deadline/CommunicationCommunications about commissions between the client and artist will take place solely through Discord, Social Media direct messages, email, or mobile texting.Please use the form I provide you for ordering. If you notice a mistake let me know ASAP.Time of completion can reach up to 1-2 months. If a client requests a larger commission piece, the time of completion may vary upon the client's commission which will be discussed and accepted with the client. Wait time depends on how full my queue is and what placement you are in my queue. I send updates directly to the client upon sketch completion, line work completion, flat color completion, and the final rendered artwork. You may ask for more frequent updates! My queue will always have current progress posted to it.The artist may not be available to answer emails on holidays, scheduled days off work, or emergencies. If you do not receive a reply within 48 hours, I encourage you to resend your message.Clear and concise visual references and/or descriptions of a commission idea must be provided by the client. After which a preliminary quote will be provided by the artist.I will not change the character if I have already begun the commission.Any written text or communication must be in English.Quotes may be provided at the client’s request. They do not represent the final price. They are only an estimate at the time of sending and can be changed at any point in the future at the artist’s discretion.Clients may request a few changes during the sketching phase. Clients may also request a few minor changes during the lineart phase. Changes applied after this check-in may require an extra fee based on the nature or complexity of the change as the commission will take longer to complete.I only allow a max of 3 major changes throughout the commission. More than 3 major changes will result in an extended due date and extra fees.Final commission pieces will be sent through Discord, Social Media direct messages, or email in order to receive the full-quality image.Allow up to 1-2 months for commission turnaround starting the day payment is cleared.Section IV - RightsThe commissioned piece may NOT be used for commercial purposes and cannot be redistributed or reproduced unless discussed otherwise. The client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, etc.The artist retains all rights to the piece of artwork itself.Removing any artist's watermarks is a violation of these terms.The artist retains the right to crop, edit, or alter the image for promotional use.The artist does not claim any rights to any intellectual property or the character(s).The client may not alter or edit the piece of artwork itself unless agreed upon by the artist.If permission has been obtained from the artist, the piece may be reposted to their platforms of choice so long as full credit is given to the artist.The client may not claim the commissioned piece as theirs in any way, shape, or form.The commissioned artwork may not be resold.The artist is not responsible for providing the client with a physical object, print, merchandise, etc. of the artwork unless agreed upon in which a fee may be applied.The client may print the commissioned artwork for personal use if provided with written consent by the artist. It may not be redistributed or sold in any way.The artist may recycle sketches and preparatory works that were rejected by the commissioner for other commissions or personal works.The artist reserves the right to reject critique and redline pertaining to artistic skill or style preference (i.e. anatomy, coloring style, etc.) or if said critique reduces the artistic quality of the piece.The artist is not responsible for lost or damaged items sent by mail.Section V - Refund PolicyThe artist reserves the right to cancel a commission and issue a refund due to poor communication, rude or inappropriate behavior, inability to communicate in clear/effective English, or unforeseen inability to complete the commission.I require 7-10 days to issue a refund after it has been requested.The refund policy is as follows; if the client wishes to cancel their commission before work begins, the client will receive 100% of the original commission payment.In the event of client cancellation during the sketching stage, a 70% refund of the original payment will be issued.In the event of client cancellation during the line work stage, a 50% refund of the original payment will be issued.In the event of client cancellation during the flat coloring stage, a 30% refund of the original payment will be issued.If the artist cancels the commission, 100% of the original commission payment will be refunded to the client.No refund will be issued if the client cancels after the flat color stage or after the commission is complete.In the event that a client is unreachable by ordinary contact means for 3 months or more, the artist reserves the right to cancel the commission and retain a 5% fee. If the client is unreachable for 6 months or more, a refund will not be issued. The client is welcome to receive credit valid toward another commission at the artist's current rate (having rescinded their spot in line due to lack of communication). If the client is unreachable for 1 year or more, then the payment is void.PAYPAL CHARGE-BACK INFORMATION + POLICY: I offer manual refunds so at no point should a charge-back be issued. Upon issuing a charge-back the client should be able to prove some sort of negligence, neglect, & loss of communication on my part regarding a manual refund. I keep dated logs of all communication between every client and me. If using a charge-back to void my refund policy the following actions will be taken:The client's rights to the product in question will be forfeited. The product may be resold or utilized in other ways as compensation.The client will be subject to a public blacklist to warn fellow freelancers of their charge-back.Section VII - Adoptables / Designs
All terms of service above continue to apply to designs created by the Artist.
Adoptables may be resold, traded, or vouchered.Adoptables may not be sold for more than they are worth. Adding on the price of commissions that you have paid is totally fine.Adding your own art/drawings you've done of them to their worth is permitted.All adopts are non-commercial. The client may use the character for personal use and the artist must be credited as the creator of the design.
-If you are seeking commercial usage of a design created by me, please send me a message on the social platform we messaged on. Depending on the request, the design will be 2x-4x the original price of the design.
Due to the fact that many of the Artist's designs are adult/NSFW/fetish themed when the adoptable is purchased they must be kept an adult and/or 18 and above. However, temporary depictions of them being a child (flashbacks, AUs, one-off drawings, etc. ) would be permitted, of course.No refunds are provided for adopts. All sales are final.No holds.Payment plans can be discussed, you may send me a direct message if you have any questions.Edits to the original artist's adoptable art are not permitted.Edits not made on the artist’s original art are permitted, feel free to make whatever edits you'd like to the design.Upon sale, the full-resolution image will be provided to the client.If creating a twin/minimally edited or any type of alternative version of an adoptable (whether that be human/feral form, them as a closed species, or anything else), they must be owned by the same person. When rehoming, they must be sold or traded together. Splits of these alt versions are not permitted.Section VI - OtherBy providing the client with a line of communication with the artist, the client agrees to act in a professional manner.The client may not redistribute the artist’s contact in any way unless agreed upon by the artist in advance.Should any terms of service be breached, or the artist incurs damages caused by the client, the artist reserves the right to either issue a takedown DMCA notice or pursue damages through the Copyright Law of the United States (https://www.copyright.gov/title17/)
