By paying for a commission, you agree to be bound by the following Terms of Service ("Terms") between you ("the Customer") and Lumaerix ("the Artist"). Please read this Agreement carefully before proceeding.

The Artist reserves the right to decline, refund and cancel any commission orders at any time, without any explanation.

The Artist may decline an order if it is something they are unable to deliver well. This includes, but is not limited to: elderly people, mecha, ferals, furries, and extreme violence & gore.

The Artist does not accept commissions with hardcore NSFW content and prejudicial themes.

The Customer will only receive the full resolution digital file/s of the commission. No physical copies will be provided or shipped.

The Artist retains rights to credits and the publishing of the artwork in their personal portfolio & social media.

Reposting commissioned artwork is allowed as long as proper credit is given (such as linking any of the artist's social media).

Publishing and privatization of commissions can be considered and discussed, especially for marketing of commercial work.

Do not reproduce, distribute, or commercially use the artwork unless this has been discussed and paid for beforehand.

If commercial use has been paid for, the artwork may be featured on merchandise sold by the customer, and also on monetized platforms, such as TwitchTV and YouTube.

The Artist's works are NOT authorized for use in any blockchain-related technology, including NFTs and cryptocurrency.

The Artist also does NOT authorize their work for use in machine learning models, e.g. for creation of computer-generated works.

The Artist will provide a sketch for approval after receiving payment. The Artist will then keep the Customer updated with screenshots with progress of the artwork until completion.

Completion time varies based on complexity and the Artist's situation. For tight deadlines, the Artist may require additional fees. Details of any rush orders must be discussed and agreed on by both parties beforehand.

After completion of the artwork, the Customer is entitled to request small changes, such as color adjustments or adding tiny details, free of charge. The Artist will accommodate such requests within reasonable limits.

Major adjustments to the artwork, including but not limited to a change in character or composition, may incur additional fees. The Customer will be notified of the additional costs before the revisions are made.

If the Artist has not finished the sketch of the commissioned artwork, major changes can be requested free of charge. These changes must be discussed and agreed upon by both parties.

The commission will only be started after complete payment has been made to the artist, with the method of payment(s) agreed upon by both parties beforehand.

Refunds are not offered for commissioned artwork unless agreed upon by both parties under exceptional circumstances. Do not issue chargebacks.

In the event of a full refund, you will forfeit your ownership and rights to the commissioned artwork/s at any stage of progress.

If a completed form for a commission was sent and hasn't been paid for over a week, the commission will be cancelled unless there's mutual agreement regarding the delay.

Any additional charges (rush fees, further edits, added assets, etc.) will be upheld and respected by all parties involved.
