Terms of Service

By commissioning me, you are stating that you have read and agreed to the terms below:

1. GENERAL DISCLAIMERS

I reserve the right to refuse or discontinue a commission at any time.Disrespectful behavior (including rushing) will not be tolerated, and your commission will be cancelled if it occurs.The terms outlined here may vary slightly depending on the type of commission.My turn-around-time can vary greatly but I try to keep it under 3 months!I work top to bottom on my queue. I usually ONLY work on up to 3 at a single time.If you are not comfortable with my queue size DO NOT commission me.I have chronic fatgue syndrome and adhd. I fall asleep unwilling often and occasionally this will hinder with my art schedule and replying to messages right away. If you are not comfortable with this DO NOT commission me. I literally cannot help this, and I am working on solutions closely with my doctor.

2. PAYMENT & FEES

Payment is due in full upfront unless a split payment is agreed upon. I will allow split payments for commissions over $100.Payment in USD done through PayPal invoice, Cash App or Venmo.A rush fee of $30 will be charged for tight deadlines.A fee will be charged for clients with difficult or intricate designs. This fee will vary dependent on the commission.A design fee of $30 will be charged for characters with no reference images where I am to rely on a description, moodboard, etc, to draw from.Additional fees will be charged for excessive or major revisions (see “Revisions” below).The exact prices for the fees described above will be dependent upon the complexity of the commission.

3. CLIENT OBLIGATIONS

Write in a clear and concise manner when filling out the commission form.If able, provide clear reference image(s) of the character.Mood boards are welcome!Maintain professional conduct throughout the commission process.Respond in a timely fashion, I will be doing my best to do the same!Assume responsibility for any important information and clear descriptions/references you fail to provide me that results in my inability to complete your commission to your full satisfaction.Carefully read through the ToS and Commission Information.

4. PROCESS & WORK SCHEDULE

As a mother of two, I cannot possibly be available 24/7. I work 5-6 days a week usually 9am-2:30pm est and 9pm-11pm est. Hours do vary but these are the average. Days off also vary depending on appointments/plans.You will recieve a resized version of the original work as I work on quite large canvases! The original can be requested.I will send over a concept sketch for approval before continuing the commission.I will show WIPs via preferred communication platform throughout the commission process.Sketch and subsequent in-progress shots will initially be sent as low-res, likely screenshots, watermarked images.If you want the commission completed by a specific time a deadline must be agreed upon prior to the start of the commission.I will always do my best to complete your commission within a timely manner, but please understand that I am a Mother and sometimes real life may cause a delay in completing your commission. I will notify you as soon as possible of any issues that come up to keep you informed.

5. REVISIONS

Multiple revisions are allowed during the sketch phase and are covered in the commission price. I will not proceed with line work or color until you are satisfied.A limited number of minor revisions are allowed in coloring/painting stage and are covered in the commission price.Excessive minor revisions to the point that forward progress on the work has halted will incur additional fees.Changing the characters palette or design during the coloring stage will incur a fee.Revisions due to my own negligence are free.Additional major revisions will incur additional fees.It is up to my discretion as to what constitutes minor and major revisions.There will be a fee if you request revisions after the piece is completed/ approved.

6. COPYRIGHT & USAGE POLICY

I, the artist, retain the rights over any commissioned works.I reserve the right to post the commissioned work on my social media. if you request the work remain private, I will only share with youI reserve the right to stream, record, and upload videos of the creation of the artwork.Any characters portrayed in the commissioned work remain copyrighted to their rightful owners.The final product is strictly for your personal use only, unless you purchase commercial rights.You must credit me when sharing or using the commissioned work. Tags/mentions are appreciated but not required. A simple 'Artwork by MarzGhoul' will be fine.For commercial use, you must purchase the rights from me at 50-75% of the commission price.Credit is still required when using the work in any form commercially.You may use or edit the commissioned work in the following ways:Print the work for personal use.Crop and/or resize the image for use as an avatar, header, video thumbnail, etc.Use the artwork as reference for a study.Post the artwork on social media, with credit to me clearly visible.You may NOT use or edit the commissioned work in the following ways:Claim the artwork as yours.Remove my watermark/signature.Paint over or otherwise alter the artwork in ways not covered under the allowed uses above.Color in my sketches or line art. unless it is commissioned line art/baseUse the commissioned piece in any technology related to NFTs, cryptocurrency, or AI.Reproduce the work commercially without purchasing the rights from me.

7. CANCELLATION AND REFUNDS

Once the final product is approved, a refund is not permitted.You may cancel the commission any time, after which I will issue a refund equivalent to the amount of work not done.I reserve the right to cancel and refund the money for your commission at any time.You may not file a chargeback against me after you have given approval of the artwork.If I am messaged repeatedly about a commissions progress when you are clearly not at the top of my queue, left feeling rushed or encounter bad mannerisms, I will refund you and blacklist you from future commissions, including buying bases and adopts.

8. WHAT YOU RECEIVE

You will receive the following after the commission is finished and approved. Images are always sent as 300 dpi pngs through your preferred email, g-drive or stash:Final sketchFlat color version (only available for shaded works)Final artworkPSD files are only provided for
ref sheets (if requested) and bases.
