ART/COMMISSIONS T.O.S.

Any instances of "I," "me/my/mine," or "Peculiur" refers to the artist.
"You/your," and/or "the buyer" refers to the commissioner.

Basic Rundown:
-I own copyrights to my artwork, not your character.
-Payment is up-front only.
-Do not resell the artwork you receive.
-Do not claim you made the artwork.
-Do not alter, edit, recolor, trace, or otherwise or steal the artwork.
-Artwork may NOT be used for NFTs. Do not contact me for NFTs.
-No NSFW content (besides gore).

BEFORE COMMISSIONING:
Please be sure to thoroughly read the terms of service provided below.
By purchasing a commission, design, ect. from me, you are agreeing to the terms of service below. Breaking of TOS may result in a block, refund, and/or cancellation of your commission.

TERMS OF SERVICE:
When purchasing a commission from me, you are to acknowledge that the artwork is still my copyright/intellectual property. I have the rights to use the commission for promoting myself and my artwork, e. g., posting on other websites or social media, using as commission examples.
Any character(s) used in the artwork remain as your intellectual property.
I only have rights to the artwork that I created.
Commissioning me is not the same as commissioning "work for hire" and artwork may only be used privately. Commercial use of commissioned artwork may be discussed if desired.

WHEN COMMISSIONING:
For the best results, please provide as many details as possible about what you would like for your commission and provide a colored picture reference of your character(s).

I hold the right to decline or cancel commissions.
Foul behavior or unwillingness to work with me may result in a decline of your commission request.
Commissions must be paid up front. However, for commissions above $200 USD, payment plans can be arranged. (Please contact me for payment plans.)
Work-In-Progress images can be provided if requested. Frequency of WIPs will vary based on commission type.
Completion time is widely variable due to commission type and time of purchase. Your patience is requested and appreciated. I will do my absolute best to keep you up to date should commissions take over 1-2 weeks to finish.
Changes can be requested if you are dissatisfied with certain aspects of your commission. However, after the product has been finalized to your liking, edits will no longer be available.

COPYRIGHT:

I hold every right to the commission(s) and finished artwork, not the commissioner or their character(s). In other words; I only own the artwork that I made.
Using the copyrighted artwork in any way to make money, such as reselling, taking credit for the creation of the artwork, removing any signatures, using the artwork as an "NFT" or Non-Fungible Token, removing watermarks or altering the artwork without my consent is considered copyright infringement.
Artwork commissioned by me may NOT be uploaded to ANY blockchains, cryptocurrency-related, or non-fungible token related websites.
Commissioned art may not be turned into a non-fungible token under any circumstance.
Do not remove the watermark (if your commission includes one).
Art may not be traced, recolored, or claimed as your own under any circumstance, regardless of whether it was a commissioned piece or not.

REFUNDING
I hold the right to cancel and refund commissions under any circumstance.If payment has not been sent for the commission, you, the commissioner, have the right to cancel whenever.
If payment has been sent, and no progress on the commission has been made, the commissioner will be refunded completely.I will not provide refunds after the artwork is completed and finalized. (In the event that the commissioner is dissatisfied with the final work, I am willing to make changes to the piece as requested).Additional payment may be required for heavily extensive edits or complete re-works. Do not file a "chargeback" via Paypal after the artwork has been completed or if you, the commissioner, would like a refund. Please contact me if you have problems or need a refund.

REPOSTING
Commissioned artwork may be reposted as long as permission has been received. If you are unsure, please ask. When reposting (with permission), please provide proper crediting and sources back to any of my social media.
If the commissioned piece includes a character owned by the commissioner, they may repost the image to the character's "Toyhou.se" page without needing to ask. Proper crediting still required.

DISCLAIMER
If you have not thoroughly read the Terms of Service, I am not to be held responsible for your own misconception.Failure to follow the Terms of Service will have your commission cancelled, and you will be potentially blacklisted from commissioning me again.

USAGE & COPYRIGHT
Designs created by me may be used in personal, non-commercial works freely.For use in commercial works, such as games, books, comics, or otherwise, please contact me to discuss permission and terms of use.
Designs may be altered, adjusted, and redesigned freely by the owner as they see fit, and do not require permission to change the design.Much like my artwork, my designs are NOT allowed to be used or sold on any sort of NFT, Blockchain, or Cryptocurrency website for any reason.Refunds are not provided for "adoptable" or "custom" designs. However, they CAN be resold unlike artwork commissions.Designs purchased as "adoptable" or "custom" designs still follow my standard art/commission Terms of Service, however, the design is owned by the buyer and considered an "original character" upon purchase, and the artwork will only be used as examples of completed designs by me.
This adheres to the statement: Any character(s) used in the artwork remain as your intellectual property. I only have rights to the artwork that I created.

RESALE
Designs may be resold as the owner sees fit.
Owners of designs created by me do not need to contact me before resale.

(Footnote: For all my concerned artists and character owners, I am very lax about my character design permissions. Big legal words are needed just in case someone tries to steal my stuff or use it commercially without permission, or try to scam me. If there is anything not mentioned that you are curious about, feel free to ask.)
