> as the creator, i own all copyrights over my work, be it artwork or design
> any obtained artwork or design is for personal use only unless discussed otherwise
> you may not edit my art without permission
> you may not steal, copy, heavily reference, reuse, sell, redistribute, profit or make merchandise out of my artworks or designs
> you may not use any of my artworks or designs in association with NFTs (non-fungible tokens), AI generators and alike
> reposting is only allowed upon prior discussion and with proper credit to my social media
commission terms of service
by commissioning me you state that you've read and agreed to my terms of service
and that you are purchasing a digital product
general
> i can decline your order if it makes me in any way uncomfortable and/or i feel like i may not be able to carry out some of the aspects of a commission
> i may use the commissioned piece for self-promotion or portfolio purposes unless discussed otherwise
> if you want your commission to be private and not posted online/used as portfolio, please notify me ahead of time
> you may cancel your commission without any charges as long as it hasn't been started
> you may adjust your order as long as it hasn't been started
payment
> payment is done either fully upfront or after the sketch/lineart is approved, depending on the type of commission ordered
> all payments are done in USD currency unless stated or discussed otherwise
> crypto currency payments of any form are not accepted
> all payments will be held through my ko-fi page unless stated otherwise
delivery
> delivery of a commission may take up to 4-6 months depending on my inspiration, work flow and university
> if the delivery takes any longer, please contact me directly
> if you have a specific deadline for a commission please include it while placing the order
> commissions with a deadline may be applicable for rush fees depending on the deadline and type of commission
> you may ask to see progress shots past the sketch phase, otherwise i am only required to update you with a sketch for approval before finished product
> once the commission is done, the full digital file will be delivered either through e-mail, sta.sh file or through discord dm
> please make sure to save the commission file if shared through sta.sh as i clear it out regularly
corrections
> if i make a noticeable mistake during the sketching process, you should notify me immediately and i will fix it accordingly
> you can request adjustments throughout the sketching phase
> once the sketch is approved, i will not be redoing the commission
> you may ask for up to 2 small corrections in the final piece for free
> any further corrections will come with a fee unless the mistake was on my side
refunds
> you may only request a refund if i haven't yet started working on your commission
> if i'm unable to meet a previously discussed deadline, we can either discuss an extension or i will refund you
> i will not be refunding any orders that have been approved to be worked on past the sketching phase unless i determine i'm unable to finish them myself
adoptable terms of service
by buying my design or obtaining it through other means (resell, trade, gift, raffle) you state that you've read and agreed to my

general
> any obtained design is for personal use only unless discussed otherwise
> commercial use designs will come with an additional fee which is to be discussed individually
> you may not claim the design as created by yourself or anyone else
> you may not steal, copy, heavily reference, reuse, sell, redistribute, profit or make merchandise out of the design
> you must credit me as the creator of the design either through linking my deviantart page or toyhouse account
> if you want to turn my design into a closed species, please contact me about it
payments
> all the payments are done through my ko-fi page in usd currency unless stated or discussed otherwise
> crypto currency payments are not accepted
> the payment should be made only after i confirm that you have claimed the design/won the auction
> you have 24h to pay for the claimed design
> once i accepted your art offer or confirmed your claim, you may not back out of it
> the full payment transaction must be completed before you own the design
> when paying with art, all pieces must be finished before you own the design
trading & reselling
> you may always gift or raffle away the design
> you may not resell the design for higher than their monetary value
> if there's personal art, you may add the value to the resell price at a reasonable rate (e.g. please don't price an uncolored doodle at 100$)
> if there is any commissioned art, you may add the value to the resell price
> if you receive the design through trade, you may only gift, trade or raffle it away unless there has been additional art commissioned
> if you trade a design for something "worth x amount of $" you can still only trade the design unless there's added actual monetary value
> if you receive the design as a gift/raffle prize, you may only gift/raffle it away unless there has been additional art commissioned/drawn
> if you receive the design as a gift/raffle prize, you may only trade it if the art added has been obtained through trade
> if i catch you drawing a single artwork for a design obtained for free just to profit off of it, you will be automatically blacklisted and forbidden to own my designs
design changes & edits
> you can adjust minor details about the design as long as you keep the general premise of it and it still resembles the original
> redesigning to the point of the design being unrecogniseable or barely recogniseable is not allowed
> if you're unsure about the changes you want to make to the design, please contact me directly
> you cannot edit my art directly in any way, if you want to redesign the character you have to draw/commission a new artwork
co-owns
> if you want to co-own a design, please contact me and inform me about it directly
> my designs can be co-owned between no more than 2 people at the time
> please respect the other co-ownership party, if there are any issues with co-ownership and you think i can help, please contact me
> please do not create co-ownership profiles on toyhouse without my permission and prior discussion
miscellaneous
> please do not delete any toyhouse profiles of designs created by me. if you no longer use the site, please hide the profile instead of deleting it
> if for any reason you end up blocking me, please trade away the designs i made asap. i don't want my designs to be owned by people who do not wish to associate with me.
> if you break any of these rules, i will always contact you first to try and resolve the issue
> if you refuse to abide by my t.o.s. after i have contacted you, you will be put on a public blacklist and banned from owning my designs in the future
commercial terms of service
none of my artworks or designs come with commercial use unless stated otherwise commercial use is to be inquired about separately and is subject to additional fees
general
> commercial use is required if you plan to use a commissioned artwork for branding/promotion, videos, covers, vtuber assets, merchandise etc.
> commercial use is required if you plan to use a design created by me for branding/promotion, videos, covers, webcomics, as a mascot/vtuber etc.
> if you'd like the commissioned piece/design/adopt to be used commercialy, you have to message me about it directly
> basic commercial use does not include the permission to create merchandise (physical or digital)
fees
> commercial fees may fluctuate depending on what you plan on using the artwork/design for
> base fee for commercial use is +100% of the original price of purchase
> base and additional fees are subject to change
credit
> commercial use does not exempt you from crediting me as the creator of the artwork/designer of a character
> if you use my design for the purpose of vtubing, i should be credited as the creator of the original design
> credit isn't required with every use of the piece/character but it should be easily accessible at any time
commercial use transfer
> commercial use does not transfer together with any sort of change of ownership of the design/character featured on the artwork
> if you obtain the design/artwork and also want to use it commercially, you have to pay the commercial fee individually
co-owns
> commercially used designs cannot be co-owned as of right now
