Terms of Service
Designs
You may:
Use the design for personal things (fursuits, cosplay, non-commercial prints, profile pictures, etc)
Post to social media (with credit) provided the design or art piece was for you or currently belongs to you
Credit can be linked to either my Toyhou.se (ChronosAstra) or Instagram (chronos_the_violinist)
Resell for more than you bought for even if received as a trade or gift (within reason. Don't sell a $20 design for $200 without extra art)
Redesign to your heart's content as long as I'm still credited
Move characters/art off of toyhouse
But first please do add the character or art piece to this character via the "characters" section of the image's edit page (select "search all by ID" and input 19644034)!
This is just so I don't forget whether I've traded a character or not
Make minor edits like scars and jewelry
Create sibling, parent, or child characters, provided I am still credited if they look similar
You may not:
Use an art piece or design for commercial purposes without purchasing commercial rights
Use my art or designs for NFTs, AI art, hate speech, fetish, or other harmful media
Remove my signature, claim the art as yours, trace it, make a base out of it, or make large edits to the image
Make a design I made for you into a closed or open species without prior discussion
Repost without credit
Co-own with someone else
Trade to people on my blacklist (I try to keep it short)
Actions such as tracing, theft, removing my signature, feeding a design to an AI, or using it for commercial purposes without purchasing commercial rights, will result in the design being confiscated and appropriate action (legal if necessary) being taken
Additional info:
I reserve the right refuse a commission for any reason and I am not required to explain why
I retain image rights to post the art to my social media or use as portfolio filler or examples
I can provide minor edits (color changes, scars, small jewelry) for free even after a design is completed
If a design was obtained on Toyhou.se I would like to know if you plan to move it offsite so I don't wonder where it went
Redesigns of characters someone else designed are more of a case-by-case basis for who receives credit, so that will need discussion if commissioned
Information and rules on commercial rights are available in the respective page for it
If I gifted you a design myself you have full rights to it, commercial and otherwise
If I design just an armor reference (for instance mandalorian) and not what's beneath, you only need to credit me for the armor design. If you design the character underneath, then you keep credit for that!
Inverse also applies, and if you want to move armor to a different character that's totally cool
Design trades/art trades
For design or art trades, I expect progress updates, as I will try give them regularly myself
If I don't receive any updates for two weeks straight, you forfeit the character design you had me working on, and I will keep it to do as I see fit (effective after 7/2/2022)
The updates I sent you prior will also no longer be yours
Art trades I will consider cancelled after two weeks of no updates, and the sketch or art piece will be scrapped
I will only cancel a trade after I have tried multiple times to reach you and receive no answer. You will be informed that it has been canceled.
Art
My blacklist does not apply to art of a character I did not design, I cannot force you to not trade something to certain people if I didn't design it
The art I make cannot be used as merch or to gain monetary profit from the art itself (not the character) unless discussed otherwise
Just don't use my art to promote hateful or harmful content
Payment
Payment is half up front and the remainder on completion, and covers 3 medium changes after completion (hairstyle, eye shape, outfit details, etc).
Large changes (multiple limb pose changes, large design alterations, etc) will cost extra no matter how many medium changes you've used.
Small changes such as color shifts or tiny details like scars are free.
Feel free to come back later and request small edits! Medium ones will require an additional payment, but I'm still willing to make changes to designs even a long time after I've made them.
Vouchers (another person paying for you) must be paid in full up front
This is to prevent a scenario where the one providing the voucher backs out, resulting in me not getting paid and you not getting your art piece
The first half of payment is non-refundable unless I cancel the commission myself, and I will not start an art piece until I receive it
I have the right to refuse a commission or stop at any point.
If the remainder of the cost is not sent within 1 week of asking, you forfeit all rights to the design and are blacklisted, and I am allowed to keep it to do as I please with it.
Chargebacks filed without discussion will result in a blacklist and a beware post being made
What you get
The full-resolution file of the artwork (can be sent via email, discord, or just toyhou.se)
All commissions, trade or otherwise, come with regular progress updates so I can make sure the custom or art piece is completely to your liking
Progress updates will be watermarked with "unfinished art/trade" and screenshotted at lower resolution until payment is completed, at which point you will be given the full res unwatermarked piece
Free small updates such as scars, jewelry, and color shifts even after completion
Things I won't draw
Extremely heavy gore
Mostly because I don't feel my style is suited to hardcore gore and I don't have the internal anatomy skills to make it convincing
NSFW
Fetishes
Extremely sexualized characters or outfits
This does not mean I refuse to draw characters that are "sexy". If they have a reason to dress a little scantily, if that's just their personality/preference, or if they just have a larger figure, that's fine, that's not sexualization
In short, no "hyper". For me that includes incredibly oversized breasts, manga-style overdefined muscles, and so on.
Anything that promotes hate content
Cultural appropriation
Things such as feather headdresses inspired by Native American attire, "tribal" tattoos, dreamcatchers, and so on fall under this category. If you are of a certain culture and want to see it represented, awesome! But if you are not of that culture, please do your research before coming to me for a commission, that way you can ensure you are appreciating rather than appropriating.
Things I will not tolerate/will blacklist over
Hate speech or bigotry
Anti-lgbtqia+ and general homophobia
Racism
Sexism
Pedophilic content
Bestiality/zoophilia
Ableism
Fatphobia
Asking for art for free/asking me to draw for exposure
Stealing other people's art/having a history of mistreating or stealing from artists
Trying to haggle my prices at all. They aren't up for debate
Going silent on a commission for over 2 weeks when asked for approval on progress, or frequently cancelling commissions with little explanation
Using my art for NFTs, AI art, or anything related
Art theft or scamming
Repeatedly trading designs of mine to someone on my blacklist
