V. Gagnon Personal Commissions

The artist reserves the right to deny or cancel any commission. Cancelled commissions will be refunded in alignment with terms detailed below.

The commissioner will provide all relevant materials and requirements when submitting the request form.

The commissioner and the artist will settle on an accurate explanation and interpretation of the expected finished product before starting the commission.

The payment currency is in USD.

100% of payment is required up front for commissions totaling under $200.

Commissions over $200 will be paid 50% up front, and 50% before final completed commission files are sent.

Payment will be payed only in the form of a PayPal invoice. Do not send payment unless the artist has agreed to accept your commission and sent an invoice.

Once payment is received and commission request is formally accepted, the estimated turn-around time (ETAT) will activate.

The standard ETAT is 60 days unless otherwise specified.

Commission requests for a quicker turnaround will incur a proportional rush-fee.

Throughout the commission process, the commissioner will receive a work-in-progress (WIP) at the following stages: sketch, line-art/inking, flat colors, and finalizing.

On completion of the commission, the artwork will be sent via email as a high-resolution png & TIFF file attachment. A jpeg file or other file type will also be sent upon request.

The commissioner is entitled to 3 major revisions during the whole commission process.

Changing the subject of the commission will not be permitted after the scope of the commission has been negotiated and payment received.

There will be no revisions once the commission is considered complete.

Extra revision(s) will incur fees proportional to additional workload.

Small revisions/changing colors/etc may not count toward the 3 major revisions.

Under no circumstances may the artist's signature be removed from any work.

Art may not be modified or edited by anyone but the original artist.

The artist retains the right to own the copyright of the completed artwork unless the commissioner requests a commercial use of artwork (additional fee will be applied).

The artist promote services and with the finished artwork anywhere.

The commissioner is permitted to use the commissioned artwork for personal use only unless agreed otherwise. (Example: Upload it on all your social media profiles, forums, etc.)

The commissioner is permitted to print the artwork and claim the character(s) as their own, but not the artwork itself.

The commissioner is permitted to use the artwork to promote themselves in a non-commercial way (Example: Use the commission as a profile picture)

The commissioner is not granted rights to turn the artwork into NFTs.

No refund will be issued at any given circumstance unless the artist failed to deliver the product according to the pre-agreed turn-around-time during the initial negotiations.

In case of refunds, the artist will only refund the amount they got after cutting off the PayPal fees.

The artist has the right to cancel any art commission and refund the appropriate(proportional to work completed) amount to the commissioner.

The artist is entitled to cancel or deny the art commission if the artwork contains any depictions of racism/sexism/hate or is meant to mock/ridicule an individual for no apparent reason.

Reselling is permitted. Resell price must not exceed the price the adopt was originally sold for unless new artwork has been made by you or commissioned. Art obtained via trades, gifts, or free requests are not considered when calculating final price.

Trading is allowed.

Gifting is allowed.

Designs received for free (via raffle, trade, or gift) can only be traded, gifted, or raffled for free.

Designs received for free may regain value if you commission additional artwork. In this case the price would be (the cost of the design - $0) + (the cost of the additional commissioned artwork).

Changes to the adoptable design are permitted but please do not edit my original art to reflect this.

The original design/art must remain public/available no matter how dramatically it differs from the current design.

Changing the design from feral to anthro to human, etc. is permitted.

Do not create a species (open or closed) based on my design.

Do not create duplicate or heavily derivative designs based on my designs.

You may not claim you created the design.

You may not claim the original design artwork to be your creation.

Non-commercial use of the design is permitted. (Examples: using the design as a profile pic or sona, uploading the design to your social media profile or website, printing a copy of the design for personal use.)

Commercial use of the design is not permitted without permission and/or payment. (Examples: making and selling merchandise, using the design as a vtuber/pngtuber, using the design in a for profit game or comic, etc.)

Returns and refunds for completed designs or purchased adoptables are not permitted.

And finally, do not use one of my designs or adoptables to create or promote hate speech and/or offensive content.
