Terms of Service


All participants and owners of Eternal Realms species are covered under the following Terms of Service. By participating or becoming the owner of a Eternal Realms species, you agree to these terms.


Payments & Processing

  1. Only accounts older than 3 months and currently active are allowed to purchase designs unless proof of an older and active account is given.
  2. Full payment is required with 24 hours of claim. You'll be allowed a 24 hour extension if needed.
  3. Cash payments are processed via Paypal invoice. An email or paypal account isn't needed to pay.
  4. Point payments are left up to the discretion of the seller.
  5. There are no refunds on design purchases, however, you can resell for equal value.
  6. Sellers reserve the right to refuse service to anyone.

Terms of Ownership

Rights of Ownership

  1. Ownership is transferred upon receipt of full payment and the design becomes irrevocable unless it was received by underhanded means.
  2. All designs are for non-commercial purposes only; however this can be negotiated with Cheeriko and the original designer.
  3. Co-ownership of any Eternal Realms design is prohibited.
  4. The original designer, uqv, and cheeriko should be credited for the design.

Ownership Transfers

  1. To transfer, you must fill out the transfer form on this forum post and submit it in the comments. It'll be logged ASAP.
  2. Upon trade, resale or gifting the design to another individual, the current owner agrees to transfer all ownership rights to the recipient.

Species Voiding

  1. Designs can be voided completely from the species at the original designer's discretion. Once voided, they can not be reinstated.
  2. The voided design will still remain on the masterlist for future reference.
  3. Designs do not have to be changed up once voided; however, if you're caught attempting to sell it as part of the species, you will be blacklisted.
  4. If the design was created by you: You have full rights to the design and can do whatever you'd like with it.
  5. If the design was created by someone else: The design will follow the original designer's TOS.

Reselling, Trading & Gifting

  1. It is your job to check the masterlist before receiving a design. Never start a transaction until you've seen the masterlist entry.
  2. Please remember to comment with the form at the bottom of this forum post to log transfers on the masterlist!
  3. Designs & slots can be resold up to the amount they were paid for.
  4. Designs & slots obtained for free (through events, gifting, or trading) or with group currency can only be traded or gifted.
  5. Additional art is not considered part of the design and will not add to the value; however, you are allowed to sell/resell any art seperate from the design. As long as you have permission from the original artist and the buyer agrees to buy the piece(s) - we will not be moderating these transactions.

MYOs

Obtaining an MYO

  1. MYO's can be obtained through the following means:
    • MYO sales - both with real currency and in-game currency
    • Event participations - including DTEs, quests, and other similar events
  2. After you've obtained your MYO, the slot will be kept up with on the masterlist.

MYO Designs and Approval

  1. Please follow the guide to make sure you create a design that 100% reflects the species. Stylistic differences (like sometimes have 4 fingers instead 5) are absolutely okay for any art outside of an official reference - but the official reference (your MYO art) needs to be accurate.
  2. Designs may:
    • Be similar in concept or themes to other designs as long as the final design be visually distinct from any existing designs.
    • Be based on other designs that you own as long as the original designer is aware and gives permission for this. Trades of any MYO designs derived from other designs must be traded with its original design.
  3. Design may not:
    • Be recognizably similar to any existing commercial franchise.
    • Contain ideological sensitive material. (No designs with Soviet Union flags or Native American headdresses.)
    • Be publicly displayed anywhere but the species' discord prior to approval.
  4. After you've designed your MYO, you can fill out the form on the bottom of this forum post (include the image, designer and artist) and submit it below.

Edits & Redesigns

General

  1. All edits must be based on the original design and be recognizably the same design.
  2. Owners may choose to revert designs to any already approved redesign if desired.
  3. For approval, please fill out the form on the bottom of this forum post and submit it in the comments!
  4. Major redesigns require a small fee of $3 or 300 points.

Edits

  1. Minor edits that do not require an item and do not need to be submitted for reapproval include:
    • Minor hue shifts
    • Slight changes to hair style or adding color highlights
    • Slight marking changes
    • Alternate outfits
    • Weight
    • Adding blemishes such as minor scars
    • Masterlist image change

Redesigns

  1. Anything more than a minor edit will be considered redesigning and will require a small fee (via an item or $3 micropayment) to update on the masterlist. Examples include:
    • Drastic, permanent changes to hair style or color
    • Permanent changes to the body, like major changes to markings or addition of major scarring, etc.
    • Changes to species traits such as altering the tail type, ear type, etc.
  2. The masterlist image will be updated, but the old version will be kept in case a future user would like to revert.

Penalties

  1. For minor offenses, moderators may issue warnings.
  2. Penalties for minor offenses may include temporary bans from participation in any or all group activities including but not restricted to:
    • Access to the group Discord
    • Prompts
    • Adopt or MYO slot purchases
  3. Major offenses that severely breach the Terms of Service will result in an immediate ban and blacklist.
  4. Blacklisted users can not interact with the community beyond trading designs, but they must still abide by the Terms of Service.
  5. If a design belonging to a blacklisted user is traded to a non-blacklisted user, the new user may use this design to participate in group activities.

These terms may be subject to change and any edits to the Terms will be announced either in the DeviantArt group or on Discord.
