Reselling designs for free?

Thanks for your opinion guys! I'll tell them to my friend! I don't intend this thread to be up long, so I'll be locking it now ^^

Do you think it's moral to do the above? I've seen someone resell my friend's designs less than two months after purchase for free without telling her, this goes against her ToS and she is upset, so I want to know your opinion, out of curiosity. 

Her ToS is no reselling and to actually use the character by the way,


Worded wrongly, sorry for any misunderstandings, my friend didn't put the designs for free, she sold the designs for DA points. The new owner, upon less than 2 months after purchase was the ones who put it up for free despite my friend's ToS not allowing her designs to be transferred around that way.

Once a character changes hands, the creator/previous owner has no say in what the new owner does with it. The community may consider it rude to resell a freebie without any new content, but the current owner has every right to do so, it's their property now.

i think im a bit lost. if its a resell, was any money involved? or it was a free batch/gift to someone?

the tos thing is sad to know, for sure. and i think in the Toyhouse official rules theres something about this? let me just copypaste:

"3.2 Character Disputes Do not sell things that you do not own or have permission to sell. We defer to the Terms of Service of the original designer - if they do not permit re-sale or re-trade of their designs (or have other terms related to the trade of their designs) we will do our best to enforce this."

i dont know if this applies to this situation, but i hope it helps.

It's actually a potentially bannable offence according the site rules to violate another user's ToS like that.  You still have to provide receipts to the mods and they can't do much about stuff offsite or involving actual money, but if she's that upset she's well within her rights to seek help.

but, as others have said, you can't really control other people in any way that matters.  it's usually easier to just block them and move on.

Honestly if your friend cares that much about what happens to characters after she sells them she probably shouldn't be selling characters

Oh, I see! Well my original point on character ownership still stands regardless, adopt TOS are usually just pinkie promises between children and not an enforceable legal agreement anyway. Unless your friend has it in writing that the owner was aware of and agreed to their terms upon purchase (and they and the buyer are both 18+), there's nothing she can do other than refuse to sell to this person again in the future..
