TERMS OF SERVICE

If my terms are broken, you will be blocked and blacklisted.

General Rules:
1. I require my art to be credited, if I have an account on the site you’re posting on, tag me. Otherwise, credit my toyhou.se which is NeptuneScribble. You may repost my art or use it as a profile image as long as it is of your commission or character.

2. Do NOT steal, trace, recolour, copy or get too heavily inspired by my artwork or designs. Even if you own the character or commissioned it. I allow tracing if it’s NEVER posted publicly and I am credited.

3. You can edit my art if you either commissioned it or own the character within my artwork, however, it is not to be edited to include discrimination or hateful content.

4. I retain rights to my artwork, I may post it or use it as an example unless explicitly requested for it to be kept private. If you want to purchase the commercial rights to my artwork, contact me.

5. I will NEVER allow my artwork to be used as NFTs or used in/for AI software.

Commission Rules:
1. I prefer to contact you using Discord when I'm doing commissions or owed art. However, I am also willing to use ToyHou.se, email, Ko-fi, Instagram or Twitter to contact you.

2. I only do major edits (pose, outfit change, etc.) when the piece is in the sketching phase, anytime after that it is too late. Colours, however, can be changed whenever.

3. You can only request alterations within 7 days after you accept the final piece.

4. You can expect your artwork to be completed within a week. If the artwork isn't completed within one month, you may request a refund. You can only request a refund earlier than a month if there's an emergency.

Design Rules:
1. You cannot adopt a character from me without a ToyHou.se account. If trading them offsite, their profile must not be deleted from the site. The new owner must be aware of this and my TOS.

2. Do NOT resell adopts for more than their worth, they are worth what you got for them plus any additional art added after payment. This also applies to trades. If you got them for free, you can not sell or trade them without additional art. Giving them away or raffling them is always okay.
2.5 Commissioned art, art obtained via trade and personal art ALL count as additional art, as these all add worth (unless the artist says otherwise), free art does not. (Again, unless the artist says otherwise.)

3. Do NOT use my designs for the creation of hateful or discriminatory content. NSFW with my designs is allowed as long as it is not visible to minors and is of adult anthro or humanoid characters. I do not support or endorse underage or feral NSFW content.

4. You can always redesign my designs, I don't have any hard rules on redesigns, you own the character and may do what you like. However, I do request you do not detransition trans characters or race-swap POC (or POC-coded) characters. I also ask that they aren't changed beyond recognition.

5. I'm happy to take back designs of mine if you want to give them up, I may occasionally ask about the status of freebies I've given away and enquire if I may take them back.

Commercial Rights:
For artwork, you must purchase commercial rights separately. You may request commercial rights upon requesting a commission or anytime after completion. For designs, you may use the design commercially but not my artwork of said design! Commercial rights for the artwork must be purchased separately.

Payment:
I ONLY take Paypal payments or payments through Ko-Fi currently, I can also send out Paypal invoices. I take full payment upfront, however, payment plans can be arranged if required. I take USD.

By purchasing a commission or character design you are hereby agreeing to the terms expressed above.
