Lysander's Ownership

By owning a design I made or, user MalJaws ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in being added to my blacklist or the creation and posting of a public service announcement if I feel I need to. Please note that these Terms of Service may be subject to change without prior notice.

Section 1.1 - Usage Rights

1. You may NOT delete their page off toyhouse, but you may private them! It would be appreciated for you to give me access to see them, but you do not need to
2. Credit me when you use the design. You don’t need to do it each time you show em, but it must be in a clear space to see and if anybody asks credit me. Clear spaces are like:
   1. Underneath art of the design, outside toyhou.se
   2. In bio, description, or a pinned post if you're using them as a banner, profile picure, or the like
   3. And similar spaces which do not require digging
3. Redesigns are allowed! Please do not overhaul, and my credit must be kept, and you may add yourself as a co-designer of the redesign if you wish and it is distant enough from the orignal

Section 1.2 - Commercial Rights

1. Commercial rights may be purchased for half of the characters base value, or if the character was traded to you, 10 USD. The value of this is added to the design
   
2. With commerical rights you may make merchandise with the characters likeness for up until you no longer own the design, then the right is passed onto the new owner.

Section 2 - Trading/Selling

1. There is no cooldown for being retraded / resold / regifted, but its appreciated for them not bought as trade fodder, but I'm not in your brain and you may do what you wish
   
2. You may NOT resell for more than you got them for. Added commission value is fine! Just keep track of it, and only do that amount or lower. Any exchange of money, including vouchers, gift cards, species currency(IF it has a real money equivelent amount), etc, counts as a resale as money is involved. All monitary value is null if traded for another character, art, etc, without any money involved.
   1. Adding to the point above, you may not redesign and resell for more than its current cost. Yes, you redesigned but it’s still my design at base. If you commissioned a redesign, that is added value, in the same way a piece of commissioned art is.
   2. Your own art is not added monitary value

Section 3 - TOS Changes

1. I can change my TOS at any time and changes will apply from that point onwards. If you broke a rule before it was instated, you're fine

Section 4 - Blacklisted Users

1. If anybody on my blacklist tries to block/blacklist evade, changes usernames, or gets a new account, please contact me so I can update my list!
   
2. As of November 24th 2024, trading any of my designs to blacklisted users will get you blacklisted as well without warning, as the popup should give you plenty warning. If you traded a design to a blacklisted user before then or before they were blacklisted, don't worry, you're fine. You didn't know.
   
3. While none are specififcally in the list, avoid trading my designs to queerphobes, racists, xenophobes, ableists, sexists, etc. I know they can be hard to spot since many try to hide it.
