Design Terms of Use
My designs can only be sold for IRL currency (CAD, AUD, USD, Pounds/Euros, etc) if they were originally sold for IRL currency by ME. Any designs that have already been sold for IRL currency with someone who was not me does not apply to this term and has any worth assigned by the current owner.
Other than that, while i do not control where you use or put my designs, my preference is that at least the base image/design itself is not hidden, removed, or put off of TH. This is up to any current owner to decide, but i may request for it to be available for me to see.
- My designs should NEVER be used for NSFW or explicate reasons. This includes digital and traditional art, NSFW 3D models, roleplay, etc. You CAN ask to use them for these purposes, but you should not do so without my permission.
- Redesigns are allowed as long as the design is recognizable and you do not take credit for the design as your own. I do not control how you interpret the design.
- My designs CANNOT be resold for real currency if either a. they do not have any commissioned pieces, or if they were not originally sold for real currency. The only circumstance in which i officially allow proper resale is if that character was bought for IRL currency; in which my TOS is null and the original buyer owns the entirety of the character.
- I have a right to request to take back a design if i find they are being misused or being treated in a way that is against my TOS; this is RARE CIRCUMSTANCE that i do NOT do frequently, but it IS A POSSIBILITY AND BY OWNING A DESIGN BY ME YOU DID NOT PAY MONEY FOR I WILL REQUEST THE RIGHTS BACK IF CHANGES ARE NOT MADE. Reasons why i may request the rights back for a character may be; a. they were used in an explicit way repeatedly, b. the original design is not properly credited or can no longer be found on toyho.use, c. there are complications with the owner (either being they are blacklisted, problematic, etc..) or for ANY other reason.
- My designs MUST stay accredited to me on toyhouse. They are not allowed to be taken off-site for any purpose/reason. This only applies to designs made in 2023 and onward. If taken off-site, and they were not bought with real currency, i will reinstate them on the site and either resell them or keep them as my own character. - Lastly, just to be clear; if you buy my designs BY ME SPECIFICALLY FOR REAL CURRENCY any part of my TOS is null and does not apply to that design.
