Design Terms of Use
Not for sale or trade, Character may not be used by anyone other than me. You may draw this character as gift to me but you may not draw this character for personal profit or profit from this character in any way without first obtaining my express permission.
Image and Character Rights and Distribution
All rights to the finished works, designs, or any artwork created by me are retained by the artist (me). You may not sell, redistribute, or reproduce these images in any way without prior permission.
I, as the artist and copyright holder for an image, are permitted to:
- Post the artwork online anywhere I wish for promotional purposes of my work/services.
- Use work I have done for you in personal portfolios, without permission.
You, as the owner of the character design, are permitted to:
- Post ONLY the low resolution version (1000px on it's longest side) of the character design sheet to publicly viewable web pages, giving credit to me as the artist wherever possible, with a link to my website: club-galaxy.weebly.com
- Use the high resolution version of the reference for the purpose of reference in purchasing further commissions from artists.
- Use all or parts of the image as an avatar/icon/banner online, giving credit wherever possible via a link to my website: club-galaxy.weebly.com
- Sell the character ONLY for the price you paid for it unless extra artwork is included.
You, as the owner of the character design (and anybody else) are not permitted to:
- Use the work I drew commercially in any way without prior permission. This includes selling prints, merchandise, books, CDs, ect, featuring the art.
A licensing fee may be required before you can use the art commercially. This can be obtained at the time of commissioning, or anytime thereafter. (This does not affect artwork of the character not created by me) - Use the character in content promoting hate towards protected groups based on gender, sexual orientation, religion, skin colour, nationality, ect.
- Identify the character design with, or promote real hate or terrorist organizations and their ideologies.
Breach of Contract
Any breaching of the terms herein will result in the termination of your ownership of the character design and forfeits any right to a refund.
Chargeback of funds via Paypal constitutes a breach of contract.
