Design Terms of Use

1. ORIGINAL DESIGN 1.1. Partial or full refunds, once payment has been sent, are not permitted, unless with the exclusive discussion and prior agreement from the original Artist. Designs may be resold, re-traded or re-gifted at the Buyer's discretion, without prior contact needed to the original Artist. Added value from separate commission pieces involving a resale is at the discretion of the commissioned Artist(s) involved, in accordance to their own Terms of Service.

1.2. The design may be tweaked and adjusted to the Buyer's liking, but the original art of the design may not be altered without written consent from the Artist.

1.3. High resolution copies of the artwork will always be provided upon a completed payment of the design, though after the initial sending of the full resolution artwork, the original Artist is not responsible for any loss or destruction, failure to provide files in circumstances of trade, etc, that may occur of the full resolution artwork after the initial sending to the original Buyer. Copies of the art can be requested again upon such an incident, but it is not the original Artist's responsibility to hold onto full resolution copies after the initial copy has been sent.

1.4. Upon purchase, the Buyer is granted a perpetual, non-exclusive, non-commercial license to:

Use the character’s design in non-commercial projects, which is often perceived as using the character for roleplaying and the creation of art for non-commercial purposes. 1.5. Upon purchase, the Buyer is not granted a license to:

Use the original artwork for profit, including use as merchandise (outlined in "2. Original Artwork"); Use the character’s design in commercial projects, including larger bodies of work like a comic, video game, or film, or in smaller bodies of work like t-shirts, stickers, and prints featuring the character; Create derivative designs (otherwise known as “adoptables”) from the character’s design to sell for profit. The Buyer may purchase additional licensing for use in commercial projects. The terms and pricing are outlined below (“3. Commercial Licensing”). 1.6. The Artist retains the non-commercial copyright to the original design and artwork, and can use the original design and artwork for portfolios, advertisement, and any other promotional use. They will not use the original design or artwork for profit.

1.7. The Buyer will identify the Artist as the creator of the design. Any work or merchandise featuring the design must include a copyright notice for the Artist which will include the word "Copyright" or the symbol for copyright "©" and the Artist's name. A link to one of the Artist's online galleries should also be included for online posting, but is not required for physical merchandise.

2. ORIGINAL ARTWORK 2.1. The Artist will not sell the original artwork. The Artist may use the work for portfolios, advertisement, and any other promotional use.

2.2. The Buyer is granted a perpetual, non-exclusive, non-commercial license to:

Publicly distribute, display, or repost low-resolution versions of the artwork, accompanied with a credit line to the Artist. The client may not use the high-resolution artwork for these purposes; Resize or crop the artwork to create icons, wallpapers, or header graphics. The artwork may not be modified itself; Produce prints of the high-resolution artwork for private use; Include the original artwork upon transfer or sale of the character(s) or intellectual property. The Artist will retain all rights granted under this Agreement. 2.2. The Buyer is not granted a license to:

Sell physical prints or pieces of merchandise of the artwork; Use the artwork to promote commercial material, such as in product advertising; Use the artwork in commercial projects, including larger bodies of work like a comic, video game, or film or in smaller bodies of work like t-shirts, stickers, and prints featuring the character; Sell one’s own material, with the artwork attached to the material, such as on the cover of a music album. The Buyer may not purchase additional licensing for use in commercial projects. 2.3. The Buyer may not claim the artwork as their own work, or as the work of anyone other than the Artist.

3. COMMERCIAL LICENSING 3.1. The Buyer may purchase additional licensing for use in commercial projects. This licensing may include:

Use the character’s design as a professional mascot; Use the character’s design in commercial projects, including larger bodies of work like a comic, video game, or film; Use the character’s design in smaller bodies of work like t-shirts, stickers, and prints featuring the character; 3.2. The pricing of a commercial license follows:

Large commercial projects, such as comics, video games, and film: $800.00 USD one-time-payment Small commercial projects, such as t-shirts, stickers, and prints featuring the character: $500.00 USD one-time-payment The use of the design as a professional mascot falls under "small commercial projects" and is automatically included with the purchase of the license. There is no license that grants the rights to create derivative designs (otherwise known as "adoptables") from the character's design. 3.3. These licenses transfer to every new owner.

3.4. Payment plans are available for commercial licenses. For all licenses, $200.00 USD is due up front. After which, at least $50.00 USD is due each month until the license is paid off in full. Buyers who are still in the process of paying off licenses are unable to purchase additional work from the Artist. The license does not come into effect until after it is paid off in full.

3.5. The Buyer will identify the Artist as the original creator of the design for any and all commercial projects, regardless of the License purchased.
