Design Terms of Use
As this is a creature from a closed species, I ask that you speak to me before removing them from the species or transferring them to a new one. Thank you.
General Rules
None of my designs should be removed from ToyHouse for any circumstances. If you would like to have the same design on multiple ToyHouse accounts for personal storage OR for co-owning purposes please make sure that both have me as the designer.
Regarding co-owning, I have no rules against it. But, I will not moderate, mediate, or settle co-owning disputes. Once a design has left my hands all disputes are to be handled by the owners and co-owners unless it is an issue regarding breaking of T.o.S or theft.
I reserve the right-to change and adjust my T.o.S at any time and without notice. Please be sure to re-read it before reselling characters, especially [Black-List Policy] & [Black-list].
Personal Rights VS Commercial Rights
All adopts which are purchased or traded from me are personal rights only. This means that you may use them for any variant of personal use you so desire: art, writing, stickers for personal use, free comics, art you make of them can be commission examples/advertisement, etc. However, you are not allowed to make a profit using these designs, even if you redesign them yourself.
Commercial rights may be purchased from me at additional cost (usually +250% price, though it may be changed on a case by case basis). These rights would include anything involved in profit, including but not limited to selling stickers featuring the design, comics which are pay to read, or mascots for your brand.
Closed Species Adopts
Due to them being members of a closed species, I do not sell commercial rights to these unless the creator/owner of the closed species allows this. In that case you would have to pay whatever fees they desire for the closed species character to be commercial use AND my personal fee. Otherwise they are for personal use only.
Additionally, it is strongly requested that upon leaving a species you try to rehome (non-custom) adopts within the species instead of voiding them. In some cases, should you not be able to rehome them within the species, I may be willing to exchange them for a custom character with full reference sheet if you are amenable to it. All else failing, you have purchased the design and may void them if you find yourself too attached and/or the above measures fail.
Pokemon Adopts
Pokemon, Pokefusion, and Fakemon adopts, due to the fact that the Pokemon franchise would not sell commercial rights to them, are permanently for personal use only.
Redesign & CS-Alts Policy
Redesigning, especially in small ways, to customize and bring yourself closer to a design is highly encouraged. Please keep redesigns recognizable (usually the 50-65% maximum change is a good rule of thumb) and do not white-wash any PoC designs purchased. Sexuality and gender may be changed at will unless the design was made specifically as a Pride-Adopt: in that case please keep it intact.
As for Closed Species alts of purchased designs there are only three rules.
1) They cannot be kept/owned separately from the original design and as such may not be sold separately from one another. If you sell the Species Alt the original must be included and vice-versa.
2) The appearance of the closed-species design can change significantly as long as it is still obviously inspired by the original design.
3) Even if you have already purchased commercial rights to the original design, the closed species design is for personal use only unless the steps described in [Closed Species Adopts] with the Species creator/owner have also been completed.
Resale Policy
You may resell any design for the same amount you bought them for plus any monetary commissions which you have purchased of them. If you are gifted a design by someone who purchased it via monetary exchange for you, you may resell it at full price at any time.
Regarding designs traded for art/writing/customs, you may resell them for the price of your art at the time once you add at least 2 pieces of additional art/writing. All personal art/writing may add 50-80% monetary worth for what you price the type of art at the time it is created (redesigns may add 100% of your custom rate). Gift art should never add value to a character. Should you be found to be adding monetary value via gift-art you will be in violation of T.o.S.
Black-List Policy
I reserve the right to black-list anyone at any time. That being said, I do try to keep my blacklist as short as possible. These people may keep any designs they currently own which have been designed by me; however, they are barred from acquiring any of my designs in the future. This acquisition of designs does include friends holding them on their own account for black-listed individuals to use. If anyone is found to be acquiring my designs for these individuals or holding them for them, they will be added to the black-list for breaking T.o.S.
I do not provide my reasons for black-listing people within public access; however, each individual has been black-listed for a reason. Should you have need of the information, you may request it; however, I reserve my right to refuse disclosure, especially if disclosure is personally uncomfortable for me.
