ART TOS ~Payment via Cashapp or Paypal{USD}

~Art can take me from a week to a couple of months depending on multiple different factors, I will always try to give updates if I know things will be delayed.

~Payment is to be sent before I begin drawing, no negotiations unless I know you.

~Do not constantly pester me about your commission. If it's been 2 weeks without any updates/wips THEN you can inquire. But please try not to ask every other day. I do appreciate reminders every now and then though!

~I reserve the right to refuse service for ANYONE or decide to stop working and refund you.

~I reserve the right to put any of my art in a portfolio or post to a public social media platform.

DESIGN TOS ~I RESERVE THE RIGHT TO REVOKE MY DESIGNS FROM ANYONE WITH OR WITHOUT COMPENSATION DEPENDING ON THE SITUATION. ANY USER WHO EARNS THEIR WAY ONTO MY BLACKLIST AFTER SEPT. 20, 2022 WILL GET DESIGNS REVOKED. Do NOT buy my designs if you do not want to risk this, thank you, this will not be removed.

~If I ask to be notified before a design of my goes for sale, PING ME. This will be on each of design terms in the ownership section of each character on toyhouse.

~Blacklisted users absolutely, can NOT acquire any of my designs and you will be BLOCKED AND BLACKLISTED if you are caught giving my designs to blacklisted users.

~You may not redesign my designs into a closed species without my direct approval, you will be blacklisted if you do this without permission.

~You can redesign a character as long as at least 75% of the design stays the same.

~You may use any design in any of your personal lore or rolepay them/use them however you wish AS LONG AS IT IS NOT FOR RACIST/HOMOPHOBIC/TRANSPHOBIC/POLITICAL/PEDOPHILIC SITUATIONS.

~If you want to make a physical item of your character you absolutely can as long as it's not mass produced commercially.

~You can make your characters a mascot/sona/etc! idc!!

~You do not have to ask me to resale a design as long as I haven't asked to be pinged!

~Do NOT add my designs to this species https://toyhou.se/KessholumiMasterlist . If they are currently part of the species as an adopt/custom they may stay. If I give you a design after September 20th, 2022 and you add it to the species the character will be REVOKED and you will be immediately blacklisted. Do not buy one of my designs if you do not want to risk this.

If I find you selling my designs to users on my blacklist I will not be afraid to revoke any and all designs in your possession with or without compensation.

This applies to blacklisted users as well; if you are on my blacklist and are passing designs TO ANOTHER blacklisted user, I will be revoking my designs from your possession.

It is within my right to do this because by purchasing my designs you agreed to my tos which included -I have the roght to revoke my designs. And -Do not ever sell my designs to blacklisted users

I will not tolerate this behavior any longer and if you are caught doing it, be prepared to lose my designs as I will take action via admins for breakage of terms of sale. Thank you.

~Blacklisted users may not purchase art or ocs directly from me

~Blacklisted users may not purchase any of my designs after the date they were put on the blacklist.

~My blacklist is part of my terms of service and by purchasing my art and designs you agree to the blacklist, anyone caught breaking blacklist rules will be blacklisted themselves.

~I will not draw a blacklisted user's oc even if a user who's not on my blacklist requests it; you will be blacklisted if you try to do this. EX: ship art, Secret Gifts/etc.

~Blacklisted users do have the potential to be removed, however, it is on MY terms and if I see a significant change in the person's character.

~any design OF MINE sold, traded, or gifted to a blacklisted user could result in permanent blacklisting and the revocation of my designs. Too many times have I seen my designs passed around between blacklisted users or passed to someone blacklisted and as it is a direct disregard of my terms, stated publicly and on most designs on toyhouse, the design has a right to be revoked.
