STARALLIES DESIGN TOS (updated January 25th 2024)

gonna try to keep it brief and simple! feel free to DM me for clarification if needed, i'm p lax on these so don't be intimidated by them! These terms will be updated as I wish, though significant changes will have a bulletin announcement.

General Rules:

▶ All adopt sales and trades are final! Though feel free to contact me if you no longer want a design of mine, as I may want to offer for it back!
     ↪ This does not apply for emergencies on your part! Feel free to contact me within a reasonable timeframe if something's happened and you need me to refund you and transfer the adopt back.

▶ Once yours, you are free to use a design of mine for whatever you wish! Personal use, properly-flagged NSFW art by those 18+, independent commercial use (such as merchandise, stories, projects, games/webtoons, etc.), go crazy! Just be sure to credit me, and I'd love to see what you made with them!
     ↪ Please discuss with me beforehand if you wish to use my art of them for any projects! This may require a fee.

▶ I will NEVER revoke a design unless in the case of a chargeback! In any case of a chargeback or revoking of payment, you will be rescinding full ownership rights of the design back to myself, and you will be placed onto my blacklist. This hasn't had to happen yet, though, so...!

▶ I reserve the right to use any art of sold designs for portfolios and commission/custom examples unless discussed prior.

▶ Once out of my ownership, I am not responsible for what is done using my designs. It is up to the new owner to make sure what they do with them is within their local laws and Toyhouse rules! I reserve the right to retract on-site crediting for both design and art at my discretion. I also reserve the right to blacklist those I feel are using my designs/art/brand to promote hatred/bigotry, child abuse and/or zoophilia, wishing death/harm upon others, etc.

▶ MY ART IS NEVER TO BE USED FOR NFTS OR TRAINING IMAGE GENERATION AI. I will never grant permission for this even if you ask.

Reselling/trading/gifting:

▶ If you bought an adopt with money, you may resell it for the buying price without additional art! Commissions and personal/gift art can add to worth unless otherwise specified by the artist, within reason. I won't badger and nag about this lol

▶ If you traded for an adopt, you're allowed to resell at the worth of the traded character (or my custom prices if you're unsure!)

▶ Please draw gifted/free characters at least once before applying worth! Then the above rules apply to it instead.
     ↪ The three above rules are also exempt for emergencies, again just let me know if something comes up!

▶ DO NOT trade any designs of mine to anyone on my blacklist, or you will also be blacklisted! Any characters owned before blacklisting can be used freely.

▶ While you can ask for tradebacks on adopts I made, I will not get involved in disputes regarding this at all--they're entirely your situation to handle. Tradebacks also do not replace or erase any of my given terms.

▶ If you created non-refundable payments (such as art) and then cancelled the trade, I will still keep the images. If I'm the one that cancelled, I'll offer to draw in equal exchange to the art given!

Splits/redesigns/derivatives:

▶ You're free to redesign an adopt as much as you wish! You may also add yourself as a co-designer for larger edits at your discretion, but please do not remove me as the main designer. Just please ask me before editing my art, and please do not delete my art either!
     ↪ If you do add yourself as a co-designer after I sold an adopt, particularly if you resell the character after, your terms do not replace or erase my own. All my terms still apply!

▶ Splitting my designs for lore reasons or to make family characters is allowed as long as you keep both designs together. While I can't stop you, I heavily discourage selling splits of my designs separately unless they're different enough to not be recognized as a split of the other.

▶ You're free to create derivatives/family designs of my adopts you own or have permission for, as long as all derivative designs go with the original adopt when sold!

▶ Co-owns are allowed, but I will only accept credit for one profile. Making more than one is discouraged to avoid scamming, confusion, or disputes. Please make sure all co-owns are clearly labeled somewhere on their profile to avoid assuming a secondary profile as stolen!

▶ Please do NOT copy or heavily reference my designs or characters! I used to be more lax on this but it only ended up with more grief in the end. If I have a suspicion you've copied my design or character, I will come and ask you about it and attempt to work things out. I reserve the right to request ownership any copied designs/art of stolen ocs for situations of admitted theft/copying or situations proven without plausible doubt.
     ↪ You're free to get inspired by my designs, characters, or art of course! I can't own concepts, traits or color schemes. Just make sure it's unique and your own idea and not just taking my character and changing their colors and markings/accessories!
     ↪ If you purchased a design from someone else that was then determined as stolen/heavily copied, I may offer to create a similar character for you as a replacement for the one you bought!

Blacklist:

Nobody on this list is allowed to obtain new designs from me, and I'd prefer any associated with them to avoid contact with me outside of business purposes. If you believe to be on here in error, you're free to DM me to try and sort things out, though I try to avoid blacklisting anyone over hearsay or purely personal beef.
