Had a hard time trying to finalize this, but I think I found my perfect T.O.S after much study and help from multiple people!

Thank you so much for your patience, not much has changed, I just wanted to make sure that if you own a design from me, I want it to be not restricting but at the same fair for future and previous owners.

By owning and buying my design, you have full rights over said design! Unless commercial use is granted, since my designs are automatically for Personal Uses that has no restrictions, hence the "full rights" over it without me dictating what you must or must not do, my apologies for not clarifying!

Unless you have used scamming and or manipulative tactics to harm and fool an owner to get a design, which is not legal.

Most of the following rules are mainly morally-based to keep everything fair for everyone who has owned a design and the artist, as well as to prevent drama and fights to occur as much as possible.

Breaking a rule does not mean I will block you ASAP!!! I like to keep my blacklist short and I can forgive misunderstandings and accidents unless actions has been repeated multiple times.

If you ever made big edits or changes to a design, please let me know! I'd love to see the new changes. ^w^

~~QUICK READ~~

For those who wishes to understand my T.O.S asap, but it is recommended and necessary to read the entire T.O.S fully when you have the time before owning a design. ^w^

Q: Can I do anything to a design?

A: Yes, you can! Unless it is for commercial purposes, you can do anything you like with the design AS LONG as you do not use it to harm others.

Q: Can you revoke a design I got from you?

A: Never, this is absolutely illegal. Instead, I will be the one revoking my Creator Credits if someone ever uses a design they got from me to harm others, such as for homophobia, pedophilia, racism, etc.

Q: Why is Commercial Use different?

A: Basically you can mass produce an object with the Design on it with the intent of reselling the object (mainly merch) or anything that allows you to make lots of money off of it, but isn't the same as reselling as you would still be keeping the character but selling images of them.

Q: Can I trade it to everyone?

A: You are able to, but giving a Design to someone from my blacklist will result in a blacklist itself. Please do not trade the design to anti-LGBT, racist, zoophilias/pedophilias, etc.

Q: Can I sell a traded design I got?

A: You can, but I recommend doing it after putting a lot of value in currency or fair personal artwork, this is to be just and fair if the previous owner you traded with paid for the design. Please ask the previous owner if you can sell them first.

Q: Can I sell/trade the design through other sites?

A: You can! ^w^ But anything than Amino or somewhere not much people can reach, as the design can get lost there and I won't be able to find it.

Q: Can I draw NSFW of a design I got from you?

A: You can if you are 18+ as well as the DESIGN, as I do not know what age someone may put after getting a design from me. If someone makes my design underage for the sake of drawing them in NSFW, roleplay in NSFW, or use them in any NSFW after making them underage, I will be revoking my Creator Credits.

❥You may resell, trade, and gift the design to only those outside of my blacklist. If you ever give my designs to a blacklisted person, you will be blacklisted as well.

❥You may only resell it at the price that you have bought it or lower.

❥You may edit the design as long as it is recognizable and you have kept the file for future owner(s)!

❥You may change the color, species, gender, edit, make adjustments to the design, as long as you credit the artist and keep the original design file.

❥You can transform them as a CS with a MYO.

❥Please do not sell my designs and adopts through AMINO or for virtual currency. They may possibly get lost.

❥If you got my design through a trade, you can only trade it or gift it. If you got my design through buying it, you can resell, trade, and gift it. You can only resell a traded design if you put/added more currency or artworks.

❥If you commisioned me for a custom design and you pointed out that I have missed an important detail, this change will be absolutely free! However, bigs changes or changes that are left not clearly informed or have forgotten to tell me will have charges. (This does not apply on sketch stages! Changes on sketch stages are free but beyond that will have fees)

Thankfully though for the last part, I love to talk into lots of details for a custom design, so you can speak out your ideas as much as you like. 💖

💖PAYMENT💖

❥Payment will only be through PayPal Invoices unless stated otherwise.

❥I accept short payment plans for one to three months or so depending on private negotiating and that you are sure you will be able to fully buy it.

❥I will give you 24 hours to pay the invoice. If you have failed to pay within 24 hours, your offer will be forfeited.

❥I do not allow REFUNDS under any circumstances. Once you have bought the adopt, it is yours. You may however, resell it.

❥I accept delays of payment if your reasons are valid, however continously delaying payment and unvalid reasons will result of your offer being forfeited and a block depending on severity.

2 weeks or more of waiting with no promised payment results in a block, please let me know if you have any problems beforehand as 2 or more weeks can result in a disruption and chaos of not being able to pay bills on my end. Informing me and keeping your word helps me greatly and it is very appreciated! 👍 

BLACKLIST

I DO NOT ALLOW any form of harassment to them!!! Some of them are tagged scammer to spread awareness, please be careful around them.

Please do not ask what they have done as I do have reasons for it. :,)

If you are found to be supporting and doing actions of the following: Pedophilia, Zoophilia/Beastality, Racism, Sexism, Against any LGBTQ+ and sexualities, etc, you immediately go to my Blacklist.

Being disrespectful and rude to me will also land you on my blacklist. Although, it is possible for me to remove you if you changed and apologized for the errors of your ways, I support the idea of changing yourself for the better.

🖤SPECIAL RULE🖤

To protect those who owns my designs from scammers and thieves.

❥This special rule indicates that if my designs are gotten through a method of scamming, the design must be given back to the rightful owner(s) as the design was traded or sold through scamming methods.

If said scammer does not cooperate and does not desire to give back the design they scammed for, the character page will be stripped of all creator credits and become unofficial and label it as STOLEN.

Scamming and doing unfair and unclear trades also goes up against ToyHouse' Trading and Selling T.O.S.

Accomplices of Scammers who helped them scam are also breaking ToyHouse' T.O.S.

It is still highly recommended to get Toyhouse Admins' help in order for things to work out well, especially if the situation becomes messy.

Once the rightful owner(s) have received the design they were scammed out of, the rightful owner(s) must give BACK the trades they have gotten from the other party, but if the following happens:

A.) The trades that the rightful owner(s) received are characters that have been duplicated in order to resell/trade it to another person at the same current time.

-I cannot extend much of my help here, I can only recommend that you chargeback, ask for refund, or some sort of payment from the scammer who has both scammed you and the other party for duplicating characters to double profit.

B.) "The other party" have already re-sold/re-traded the design and cannot "give it back."

-This is unfair as "the other party" received it through scamming, and should refund, repay, give back the trades they have received to the person they have sold or traded it to, as they lied to said person as well by giving them a SCAMMED design.

The scammer have broken ToyHouse T.O.S and should comply and fix their problems respectfully.

C.) The rightful owner(s) has already given away the trades they received from the other party, but only found out about getting scammed afterwards.

-I cannot extend much of my help here, please inform the person you traded with that you have been scammed out of, and request their help for a re-trade in order to receive back the trades you have received from the scammer previously.

Then you may discuss with the scammer for a trade back for the design as they used unfair and illegal methods to get said design, if they do not cooperate, please inform me.

⚠️EXTRA INFO⚠️

This special rule ONLY applies to my designs that are received by using scamming methods and thievery.

Falsely reporting scams and thievery can lead to blacklisting, please do not falsely claim and keep solid hard proofs at hand.

Please come to me privately through dms or notes if you found out you have been scammed or stolen a design of and I would be very much happy to help!

If you have been stolen from, I can make a statement of your sole ownership rights or rightful co-ownerships rights of the design you have been stolen from.
