REDESIGN FAQ

no, you do not need to ask for permission to edit a character.

• if you redesign in any way, please continue to keep me listed as their creator. toyhou.se has a designer credit option for redesign purposes.
  
  
• you can make them completely different from how i originally intended them to look, i don't care. there is literally only one limit to this rule and it's to not whitewash a design.

REDESIGN--BUT SPECIES--FAQ

the following rule does NOT allow you to make use a character design you have bought from me to create an original species based off of it. this allows you to transfer the character into an existing species, like "darling dainties" for an example.

you are able to convert any of my characters into a species and out of a species. i also allow you to keep the original design while simultaneously having a version that is a part of a species--technically creating two "separate" characters.

• if you do this, the additional species design is not its own solo character. make them a character tab. please also check with the species owner if you are able to do this. i don't normally involve myself in species, so i do not know if it is common practice.

you are free to use this T.O.S. as proof of permission to do the above. i do not need you to DM me. just tell the species owners to read about this on the character's ownership tab.

please understand that many species have commercial restrictions and content restrictions which you must follow. the character is now a part of that species, and my word on those matters becomes void to the species rules.

STORAGE AND TRANSFER FAQ

you should NEVER sell my characters offsite. they should stay here, where it's easy to track ownership and keep my designs on display as a sort of portfolio. if i ever see one of my characters on coin amino, i will be so disappointed in you. do not do this to me. thanks!

do not delete my characters off of toyhou.se. ever. you are welcome to hide them, and you are not required to let me know--but if you are comfortable doing so, i would appreciate it.
i will never ask for an access key if you hide a character, but i do like to see how my designs are doing sometimes, so if you're comfortable lending me one i'd love to see!

characters can be resold, traded for other characters, or traded for art. if one of my designs is listed as untransferrable, feel free to PM me and i will edit that!

MARKETING, USAGE, AND COMMERCIAL RIGHTS

IF BOUGHT VIA USD my designs may be used freely for indie or small-scale commercial purposes, but my artwork of the character cannot. anything you draw of the design or commission from another artist with permitted commercial usage is fair game though.

• AS OF AUGUST 2022 A CHARACTER WITH COMMERCIAL RIGHTS WILL HAVE IT LISTED IN THEIR PERSONAL TOS!
  
  if you haven't paid through usd and you'd like commercial rights it's a $15 fee. it's one-time and you can add it to their value if you want idc!

• on an indie scale, this includes using the design(s) in your small business for mascots, merch, logos, vtubing, self-published webcomics, literature, and animation, whatever. i will not ask for a cut in these situations.
  • if you are outsourcing plushies, you are not required to give me a cut but you ARE required to send me one... :3
    
    
• anything involving what i consider a major commercial use, such as a book publication where the design is visually used (if a written work, as long as my design is not on the cover and doesn't show up visually inside the book either, i do not care.) further examples include being featured consistently in a comic or other visual work, on a cover, as a mainstream brand icon and distributed on a mass scale to retailers or online streaming services. this is when you must reach out to me to discuss cuts and proper credit.
  • this includes partnering with makeship for plushies.
    
    but this will most likely never happen so otherwise do what you want to! i will be very excited if it gets to that point though.
    
    
• if you got them thru trade/whatever from someone who originally paid usd/a fee you still have commercial rights. i'm not gonna fee someone twice i'm not scum.
  
  
• crediting me in indie commercial situations (explained at start of this segment) is not required, but if you're feeling nice i'm never against it! please DM me for information on that.
  
  
• lack of credit is not a pass to claim you have created the character. you either write somewhere that i made them, or you write nothing. if someone asks, just be real about me making them. it's not going to affect you negatively anyways.
  
  
• giving away a character with commercial rights also transfers those rights to the new owner. be aware of this if you are selling anything physical of the design. this is not a co-own between you and the new owner, unless you agree on it.
  
  
• i am not responsible for working out rights transfers between characters that were not obtained directly from me. they do not belong to me anymore. do not reach out to me about this.

using my characters for nsfw/sensitive purposes is fine and i don't care. just be respectful and moral about what you do. i'm not going to police what doesn't belong to me anymore.

• designs by me that have been sold are not associated with me anymore besides creation credit. whatever directions the new owner chooses to go with that character do not represent my own personal beliefs or morals. designs sold do not reflect me, represent me, and most importantly, do not belong to me anymore. i cannot control their or their owners' actions. please understand that.
  
  
• if you break my tos i WILL NOT withdraw a character from you, legally this is impossible and also immoral, no matter the reason. i, however, will not permit you to obtain designs from me directly. if you're going to break my tos then at least be smart enough that i don't see it! they're lenient as it is!
