Terms of Service

Please read this carefully before commissioning me.

By commissioning me you agree to all of the following:

General T.O.S.

If you have a deadline, be clear about this upfront before payment. My pace can vary from hours to months depending on my health conditions. My health conditions vary on a daily basis, so it is rare I will be able to predict how long something will take.

Most commissions will be digital, unless stated otherwise- So please select the "no shipping" option when sending payment

If your order is digital, save the finished file to your own device. It is not my responsibility to keep track of where your file has gone after you have responded to the final product. (or 1 week after I have sent you the final product)

If your commission is not a custom, please send a clear reference of your OC. Please do NOT send large folders of art unless every angle/detail is necessary for me to finish the commission(s).

Payment

I may get a head start on your commission before payment, but I will not send WIPs or the finished piece before payment has been sent.

I take payment through PayPal only.

Chargebacks, when a piece has been finished and sent, will result in me blocking you and me creating a callout post against you.

Chargebacks without warning, before a commission has been finished, will result in me blocking you. So please send a message if you need a refund.

My Rights as the Creator

I retain the rights to my works including but not limited to making merch of any kind, etc.

I retain the copyright to my works, meaning even if you commission me, you cannot copyright my work for yourself.

I am allowed to refuse to work with you in any way, for any reason, without specifying why.

I do not have to adhere to a deadline if I didn’t agree to one before I accepted payment.

No refunds unless we have agreed to a deadline and I have told you I will not be able to finish it in time.

I usually work in order of who has commissioned me first. However, if I can’t work on your piece for any reason, I retain the right to change the order in which I finish commissions, to keep up a better pace of getting commissions done quicker.

Your Rights as the Customer

You, as the customer, retain all rights to your original characters.

You, as the customer, may only use the work I create for you for any personal/non-profitable/non-commercial purposes, (unless I have given you explicit written permission to do so) including using my work on another website, blog, gallery, etc., with credit given to me (chronic-rose at Toyhou.se).

Whether or not you're a customer..

..you may NOT use my work in blockchain-related technology or use my work to profit off of it or for commercial use without my explicit written permission.

..you may NOT edit my work without my explicit written permission.

..you may NOT claim any of my work as your own work.

(including, but not limited to, personal and commissioned works, for all of these)
