$5's Ownership

By accepting an adopt from me, user DaniAdopts/Danisketchs ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected sale/trade with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.

These Terms of Service are in effect as of March 08, 2021.

Section 1- Claiming

If you wish to buy an adopt:

1. First come first serve
   
2. I will not be holding an adopt for new buyers, frequent customers may ask about holds but a down payment of %25 is required and will be non-refundable.
3. Serious buyers only! if I do not hear from you after seven days of inquiring about the adopt, that will count as a strike. [See Strike section for more information]
4. You can claim the adopt via any methods of contact, if it's my adopt or home Toyhouse account,Discord, Instagram or Deviant Art. That being said please do not request my discord information. It is reserved for close friends and clients

Section 2- Payment- Paypal/Points/Trade ect

1. payment for acquiring adopts are prioritized in this order: Paypal, *Gift Cards, dA Points, Art, existing Adopts, Customs

1.1*Gift Cards will only be accepted if the adopt[s] are $20+ in total, gift cards must be of equal value to the adopt you are buying. Gift Cards that will be accepted are Amazon and Nintendo Shop

1.2 Please see my front page where the information in reguards to accepting adopts,art and customs as payment

Adopts by paypal will require your paypal information so I may send the invoice. Failure to pay the invoice within 24 hours of being sent, will result in a strike and the adopt being placed back up for sale. I the seller will always let you know when the invoice has been sent If you are paying via dA points, I will send you a link to my dA account. Please include your TH account name when sending the points so I can be sure you have paid For gift cards I will give you the information via inbox

Section 3 - Trading/Gifting/Re-Selling

1. In reguards to Trading,Gifting or Re-selling please refrain from handing my adopts to anyone on my blacklist! Failure to comply with this will result in you being placed on the blacklist!
2. Gifting an adopt is perfectly acceptable as long as they agree to my TOS [Terms of Service]
3. Trading is also acceptable, as long as the person agrees to my Terms Of Service
4. Re-selling is acceptable as long as the adopt has remained in the buyers ownership for six months. I as the seller keep a record of when things are sold. The adopt cannot be sold for any more than what you paid for unless it comes with addtional art work, not including Dollmakers/Dress-up Games. All new owners must agree to the TOS

Section 4 - Modifying

1. The Seller will not be responsible for any modifcations requested! What is uploaded is the last time I will touch the piece unless stated otherwise.
2. The Buyer may make as many alterations to the original concept as they please.
3. The buyer may make alterations to the original artwork as long as it's requested before hand and is approved by me!

Section 5 - Strike System

1. A strike system is put in place for those who break my TOS. Three strikes and you are placed on the blacklist
2. When a rule has been broken I will contact you the first time as a warning
3. If you break a rule again, another strike will be given and you will be prevented from buying adopts for a certian amount of time
4. A Third warning will result in a ban from buying or obtaining my adopts

Section 6 - Bans/Black List

1. My Blacklist will be made public with the reason beside the username[s] So there is no exucse for not knowing if a person was placed on the list or not
2. If you are banned you will be unable to obtain any adopts made in part of fully by me
3. This ban will not be lifted, three times is enough warning to allow you to follow the rules
