Poison Ivy (Ivy) NFT's Ownership

By owning a design created by me, user @Zana / Atelas("the Designer"), you ("the Owner") affirm to have read and agree to be legally bound by the following Terms of Use listed below.
Failure to abide by the Terms of Use may result in a public blacklist announcement.

Please note that Terms of Use may be subject to change without prior notice.
These Terms of Use are in effect and up to date as of October 12, 2023.

These Terms of Use only apply upon the Owner's new ownership of a design.
Any changes made to the Terms of Use after an Owner has claimed ownership to a design will not apply to said design.

1. Block me without any reason, without tell me the "why" = auto blacklist
2. The owner CAN'T delete the character 
3. The Owner may make minor edits to the design/ adopt (like hair, gender, name, backstories, scars, tattoos, some marking, body shapes) without asking/telling me. The owner must not make the design/ adopt unrecognizable (change all colors, or almost all marks) without notifying and asking me.
4. If the owner got the design/ adopt for FREE they cannot sell them (except additional drawings added)
5. The Owner may regift the design.
6. The Owner may retrade the design (the owner can exchange the design/adopt only after 1 week minimum.).
7. The Owner may resell the design for the same price as bought. (the owner can sell the design/adopt only after 1 month minimum.).
   1. The owner cannot resell the design for a higher price than purchased, unless drawings have been added (trades, commissions, personal art)
   2. Free/ Gifted art (i.e. art received in which the Owner did not give anything in exchange) does not count as additional value.
8. The Owner may use the design for personal/ non-commerical use.
9. The Owner may use the design for commercial use only if discussed with the Designer beforehand. (commercial use cost 30 euros)
10. The Owner may not claim the original design as their own.
11. The Owner may not claim the original artwork as their own.
12. The Owner may not make both major edits to the original artwork without asking to me.
13. If uploading the original artwork off-site, credit to the Designer (Atelas(ToyHouse) OR Atelas (Instagram)) must be provided.
14. The Designer only claims ownership of the original design concept/ execution. The Owner is not the "Creator" of said character, even if changes are being done on the design.
15. The Designer acknowledges that once a design is owned by the Owner, the design/ character no longer belongs to the Designer.
    1. The Designer may not "claim back" a design.
16. The Owner cannot make a raffle with the design/ adopt
17. DON'T give/ sell or trade the design/ adopt to someone who is on the blacklist list
18. Do NOT remove me from the favorites of the design/ adopt, I like to have a follow-up of the design that I have done (they are all on a special fav-folder here: https://toyhou.se/Atelas/favorites/105154 (old) OR https://toyhou.se/ZanaAdopt/favorites/143401 (recent)
19. No refund can be made.
20. Do not delete your auction or cancel it
21. You CAN'T sell or put to adopt, an adopt you win for FREE (fcfs) right after you win them (you have to wait minimum 1 week before sell/trade/put them for offer)
22. When you offer drawing, you have 1 full month to do the drawings, after that 1 month, I will send you a warning message, and if you don't respond after 24 hour the offer will automatically canceled, and you will not be able to do an new offer.
23. If the owner buy/adopt an "egg"  from me, they can pay/ask to another person to design it. But, I would like to have a little quote somewhere telling that I give the original idea of the design (or/and put me as "one of the designer")
24. The Owner can use his new oc for: nsfw art, gore art, creepy art, vent art/personal art. As long as the oc is not minor, or the subject not problematic. (I would prefer is the oc avoid fetish, but as long as it's not too creepy or weird I'm fine with that)
25. The Owner can turn his new oc into an already made closed and private species made by the Owner ONLY. If the Owner want to turn the oc into a pop closed/open species (dainty, protogen etc) the Owner HAVE to ask me the permission
26. The Owner can't create a closed/open species based on the design of the oc, it contain ANY minimal element of the design.
27. The Owner may make a "IMVU", "Second life" or any 3d/2d game/app model of the design ONLY if they talked to me before!
