Design Terms of Use

Gax-Kat Global Rules

OVERALL DESIGN RULES AND USE:
1. Feel free to redesign any designs I made that you own!
2. You are allowed to edit my original artwork that came with the character! HOWEVER! I will not provide .PSD files to anyone besides the original owner. If you purchased a design from me second hand please contact the original owner for the .PSD layer files.
3. My designs are for personal use only! please check the "Commercial use" section regarding monetary use of my designs.
4. You can make "children" for my designs, HOWEVER! Just like in real life, you must have them resemble another character as well.
5. This being said, No "Clones" or "Identical Twin" designs! Fraternal twins are allowed!
6. Only transfer ownership of my designs to people who use TOYHOUSE! I like to keep track of my work! I can provide an invite code if needed!
7. You cannot make merchandise of my designs unless you purchase commercial rights!

TRADING/SELLING/GIFTING RULES
1. You may gift, trade, and sell me designs overall.
2. Please sell my designs for their estimated value! You may include your own art, commissions, and art payments (Example of an art payment: someone offering you a $35 bust art of my design in return for an oc you're trading)
3. Do not include gift art and art trades into character value.
4. Trading my design for an oc of higher value does not make my design equate to the traded character's value! Traded my $20 design for a $100 design? My design is still $20!

COMMERCIAL USE:
1. If you're interested in commercial use, please tell me upon the original inquiry! This makes the process easier for both of us!
2. Commercial use ownership CANNOT BE TRANSFERRED TO ANOTHER USER. If you purchase commercial use from me, and transfer ownership of said character to someone else, that person will individually need to re-purchase commercial use.
3. That being said, the only way your commercial use purchase can expire, is that if you no longer own the character you purchased commercial use for. If you obtain the character you purchased commercial use for again, you too must re-purchase commercial use. (Lets be real... why would you re-home a commercial use character anyways???)  
4. Transferring ownership to yourself (sending the character to a new account or an account) is COMPLETELY FINE BUT PLEASE LET ME KNOW DIRECTLY!!!
5. Commercial use allows you to use my designs for monetary value! Use it in a comic, make and sell charms, use the character in a video game! Design tattoos of them and tattoo them onto your unsuspecting friends for top dollar!
6. With that out of the way. I charge a flat, $100 fee per character for commercial use!

REGARDING CO-OWNERSHIP BETWEEN INDIVIDUALS
1. I allow free co-ownership of my designs and you are free to make duplicate profiles! HOWEVER! You must ask me for permission for co-ownership. With written out reasoning, rules and who the character would go to in case of a dispute.
EXAMPLE:
"I would like to co-own x character with my friend! Reason, I like my pal! Some ground rules we decided on, we can both draw, use, and commission art for said character, but only I am allowed to write lore for the character. Incase of a falling out, character ownership would be given to me, as I am the original owner and my friend agreed on this >insert proof of conversation regarding rules and final ownership."
I will then let you know if I approve offical co-ownership or not. I require all this information + proof of agreement to prevent possible drama between owners down the line.
 
2. You cannot partially sell my designs! This means you cannot sell for co-ownership!
3. Think of co-ownership as a gift! You can only gift co-onwership to someone!
4. Co-owned design CANNOT BE USED FOR COMMERCIAL USE! Co-ownership is already messy as is!
5. This being said, you cannot grant co-ownership to someone if you own commercial use of said character.
