By ordering a commission from me, user Icecyclone ("the Artist"), you ("the Client", "(s)he/ they") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected/ cancelled commission with or without a refund, and/ or a blacklist/ public service announcement. Please note that these Terms of Service may be subject to change without prior notice.
通過向我，Icecyclone， 委託，即代表你(客戶)已閱讀並同意以下條款。不遵守服務條款可能會導致在無/有退款的情況下拒絕/取消委託，並且/或列入黑名單。請注意，這些服務條款可能會隨時更改，恕不另行通知。
These Terms of Service are in effect as of January 29, 2023.

Section 2 第2節 - General 總則
- The Artist has a right to refuse the commission for whatever reason, with or without explanation. 我有在不告知原因的情況下拒絕接受委託的權力。
- The Artist has a right to cancel the commission for whatever reason, with or without explanation. 我有在不告知原因的情況下取消訂單的權力。

- I will try my best to complete your commission within one to two months, I'm a busy college student who about to graduate, please don't expect me to finish your commission in a short time. 會盡力在一到兩個月內完成您的委託，我是個即將畢業的忙碌大學生，請不要指望我能在明確日期前完成您的委託。
- The Artist does not work on a "first come first serve" basis. Smaller commissions/ commissions that do not take much time may be worked on in between larger commissions/ commissions requiring more time. 不需要太多時間的較小型委託可能會在需要更多時間的較大型委託之間進行。
- I will be in touch with you through discord DM and send you my progress, please keep an eye out for messages. 我會通過discord私訊向您聯繫，以及傳送途中，請留意一下訊息。

Section 3 第3節 - Image Rights 權限
- The Client may use/ reupload the commission for personal/ non-commercial use, but only if proper credit to the Artist (@User) and a linkback to any of the Artist's social media (Youtube, Twitter, Buzzly.Art, Toyhou.se, Instagram etc...) is provided. 客戶可以將委託完成品為個人或非商用用途使用/上傳，前提是要註明出處並附上Icecyclone 的任何社交連結 (Youtube, Twitter, Buzzly.Art, Toyhou.se, Instagram 等等...) 。
- The Client may not use the commission for any commercial use. 客戶不得將委託成品用於任何商業用途。
- The Client may not claim the commission as his/ her/ their own work, whether (s)he/ they did or did not make any edits to the commission. 客戶不得聲稱委託完成品是他們自己的作品，無論他們是否對成品進行的更改/編輯。
- The Artist does not claim ownership to any of the characters/ subjects portrayed in the commission. Characters belong to their respective creator(s). 藝術家不擁有委託中的角色，角色屬於他們各自的擁有者。

Section 4 第4節 - Delivery/ Turnaround 成品交付
- Physical or digital art will be delivered based on commission type. 將根據委託項目交付實體或是數位圖像。
- Digital art will be sent via e-mail. 數位委託成品將通過電子郵件交付。

Section 5 第5節 - Payment/Refunds 付款/退款
- PayPal only。 僅接受paypal，若你是台灣人可以用匯款的方式付款。
- Payment must be sent within 1 week after confirmation. 請在確認後一周內付款。
- If the Client cancels his/ her/ their commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been finished: 如果客戶因任何原因取消委託，客戶將收到部分退款，具體取決而委託的完成度:
- 65% refunded if in the lineart stage. 如果處於線搞階段，退還65%費用。
- 50% refunded if in the base colours stage. 如果處於底色階段，退還50%費用。
- 30% - 20% refunded if in the shading stage/ final touches. 如果處於最後陰影/美化階段，退還30%~20%費用。
- The Client will not receive any files of the commission. 客戶將不會收到任何檔案
- Not applicable to physical and animation commissions. 不適用於實體及動畫委託。
- If the Artist cancels the commission for whatever reason, the Client will receive a full refund. 如果藝術家因任何原因取消委託，客戶將收到全額退款。
- Refunds will be given within 1 week after correspondence. 退款將在確認後一周內交付。
- The Client will not be refunded if (s)he/ they are unsatisfied with the commission. 如果客戶對完成品不滿意，客戶將無法收到退款。
- If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colours), up to a maximum of two (2) times after correspondence. Any desired major revisions (ex. reposing, colour scheme change, etc.) will be rejected. 如果客戶對完成品不滿意，藝術家願意討論並進行小的修改（例如調整顏色），最多可在交付後修改兩次。任何重大修改（例如改姿勢、配色更改等）都將被拒絕。

Section 6 第6節 - Commission Process 委託流程
The following is a sample of the Artist's commission process: 以下是委託流程示例:
- Inform the commission you want and character reference through Discord. (冰颶 Icecyclone#0553) 通過Discord(冰颶 Icecyclone#0553)或Messenger私訊告知委託項目以及角色參考圖。
- the Client provide character references and specific ideas or concepts. 客戶提供人物設定圖以及具體的想法或概念。
- TDiscussion content and valuation. 討論內容及估價。
- Sketch 1 Confirmed. (Two revisions accepted) 草稿1確認。（接受兩次修改）
- Payment 付款
- Sketch 2 confirmation will be made if necessary. (minimum revisions accepted) 若有必要會進行草稿2確認。（接受小部分修改）
- Delivery of finished commissions. 交付成品。

Section 7 第7節 - Design T.O.U 設計使用條款
- You can set the background story, gender, add accessories, scars and other changes that do not change the genes. If you want to change the genes (fur color, etc.), please ask me first! 可自行設定背景性別加上飾品傷疤等不改變基因的更改，若要改變基因(毛色等等)請先詢問過我!
- You can give them special abilities! Other forms are possible but only for AU. 你可以讓他們擁有特殊能力！可以有其他型態但是僅限AU。
- You can use them as your oc or sona. 你可以將他們作為你的oc或是繪型。
- The Owner may regift the design but need to let the desiner know first. 所有者可以在告知設計者後轉贈設計。
- The Owner may not resell the design for a higher price than bought unless additional value (i.e. trades, commissions, personal art) has been added to the character's gallery. Free/ Gifted art (i.e. art received in which the Owner did not give anything in exchange) does not count as additional value. 所有者不得以高於購買價格的價格轉售設計，除非附加價值（即交換繪、委託、個人藝術）已添加到角色的畫廊中。 免費/贈送的藝術品（即所有者未提供任何交換的藝術品）不算作額外價值。
- The Owner may not claim the original design and the original artwork as their own. 所有者不得聲稱設計以及設計圖/附加蹭圖是他們的。
- Keep the credit. 請務必保留設計者(冰颶/Icecyclone)的名字。
- I will upload them on my toyhouse, if you have an account I will transfer the character to you, if you don't but want to have one I can get you an invitation code, if you don't want a TH account I will put this character in sold folder of my account and will never use it, just for the record.我會將它們放在我的toyhouse上，如果你有帳號我會將角色轉移給你，如果你沒有但是想辦我可以幫你拿邀請碼，如果你不想要TH帳號我會將此角色放置在我帳號裡的已售出資料夾，並絕對不會使用它，僅作為紀錄。
- I will give a discount depending on the situation if you commission me with the character design by me. 未來如果用從我這裡購買的設定來委託會視情況打折。
