General ToS

• Payment in USD is expected upfront.
• If payment is not received within 12 hours, the adopt will be put back up for sale.
• Rights and a full resolution file will be transferred after full payment is confirmed, the buyer may then change the name and make edits to the character as they see fit. However, please credit me for the original design!
• My artwork cannot be traced or copied under any circumstances.
• Current owner cannot claim to have created the character.
  If offsite, current owner must credit me for the original and any use of my artwork.
• The adopt cannot be duplicated in any way.

Commercial Use

• The adopt CANNOT be used for commercial work (excluding advertisement of your own work, like a mascot/primary character). If this is intended, the current owner MUST discuss this option with me or will lose all rights to the character.
• Should the adopt be authorized for commercial use, they will no longer be resellable, tradable, or giftable.

Reselling/gifting/trading

• The adopt itself may not be sold for more than its purchasing price, i.e. you can sell the adopt for its purchasing price + commissioned art work.
• The adopt cannot be priced again after being received as a trade or for free, unless it is being sold with artwork the current owner has commissioned.

  
  

Tracking

• If accessible, please keep the toyhou.se updated.
  In the case that the owner cannot use toyhou.se, please do your best to inform me if you are selling, gifting, or trading the adopt to a new owner. 
• Please try to inform me if you are moving accounts, changing your username, etc.

Misc.

• The buyer will be vetted and can be turned down should I feel the buyer is not reliable. This may include suspicious accounts, off putting or rude behavior, relations to cryptocurrency, etc.
• The adopt CANNOT be used, traded, or sold in any way in relation, direct or indirect, to NFTs and/or cryptocurrency. Should this happen, all rights revert to me and the design will be resold. The current owner and any other participants will be blacklisted.
• The adopt cannot be refunded except, potentially, in the case of an emergency, up to 24 hours after purchase. In the case of an emergency, I will make my own judgement.

Should any of the ToS be broken, all rights revert back to me immediately and I will investigate the case. Depending on the severity, I will be willing to discuss options if requested.

I WILL NOT:

• Post the adopt to social media without your permission and without tagging the owner(unless you want to remain anonymous). I DO retain the right to post the adopt for portfolio reasons, the owner will be listed.
• Resell the purchased adopt without reason. If you see that I am reselling your adopt, contact me immediately and I will discuss the issue.
