By ordering a commission from me, user Keileon ("the Artist"), you ("the Client") affirm to have read and agree to be legally bound by the following Terms of Service listed below. Failure to abide by the Terms of Service may result in a rejected or cancelled commission with or without a refund, depending on the situation. Please note that these Terms of Service may be subject to change without prior notice, but a changelog will be provided once this occurs.

These Terms of Service are in effect as of June 1, 2023. They were last changed October 11, 2023.

Section 1.1 - Will Draw

The Artist is willing to draw any of the following:

  1. Human(oid)*, Kemonomimi, Anthro, Feral
    (*I will attempt humans/characters with human faces, but please understand that this is not my specialty.)
  2. Original characters, fan characters, closed species, open species
  3. Sonas
  4. Fanart
  5. Light to moderate gore
  6. Vore, mawshots
  7. Reference sheets
  8. Artistic nudity, doll anatomy
  9. Logos, tattoos, iconography
  10. Creature design, Fakemon, etc

If something is not listed, feel free to ask.

Section 1.2 - Will Not Draw

The Artist will not draw any of the following:

  1. Explicit sexual content
  2. Most fetishes
  3. Politics
  4. Activism
  5. Pride
  6. Dainties and knockoffs

Section 2 - General

  1. The Artist has a right to refuse the commission for whatever reason, with or without explanation.
  2. The Artist has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  3. The Client has a right to cancel the commission for whatever reason, with or without explanation.
    (Please see Section 6 - Refunds for more information on cancellations.)
  4. The Client is permitted to request the Artist's e-mail address for the purpose of the commission.
  5. The Client is permitted to request the Artist's Discord handle for the purpose of the commission. After the commission is done, the Artist has a right to remove the Client as a friend for whatever reason, with or without explanation.
  6. The Artist has a right to upload the commission on any/all social media (including but not limited to Discord, Twitter, Toyhouse, Ko-fi) unless specified by the Client beforehand to keep the commission private.
  7. Payment is to be made after the Client has approved the sketch. The sketch will be resized and watermarked. The commission will be on an "on hold" status until payment has been received.
  8. The Artist will not work with deadlines or rush orders of less than two weeks.
  9. The Artist does not work on a "first come first serve" basis. Smaller commissions/commissions that do not take much time may be worked on in between larger commissions/commissions requiring more time.
  10. The Client may contact the Artist at any time to ask for a progress check on the commission, but no more than once every a week. The Client is encouraged to contact the Artist via social media (Discord, Twitter, Toyhouse, Flight Rising) if the Client is unable to reach the Artist via e-mail.

Section 3 - Image Rights

  1. The Client may make minor edits to the completed commission (ex. Cropping, adding text/borders, Changing Brightness/Contrast/Hue/Saturation...).
  2. The Client may use/ reupload the commission for personal/non-commercial use, but only if proper credit to the Artist (Keileon) and a linkback to any of the Artist's social media (Twitter, Toyhouse, Flight Rising, Art Fight) is provided.
    1. If the commission includes characters that do not belong the Client, additional credit to the owner(s)/ creator(s) of said characters must be provided when using/ reuploading for personal/ non-commercial use.
  3. The Client may not use the commission for any commercial use unless discussed with the Artist beforehand.
    1. Commissions for commercial use will be charged more than personal/non-commercial commissions. Prices are negoatiable.
    2. If the commission includes characters that do not belong the Client, the Client can not use the commission for commercial use unless explicitly written permission from the owner(s)/creator(s) of said characters is provided to the Artist in the form of direct communication.
    3. This only applies to the art that the Artist has directly drawn for the Client. Sold characters and designs may be used for commercial use as long as it is not the Artist's work.
  4. The Client may not claim the commission as his or her own work, whether (s)he did or did not make any edits to the commission.
  5. If the Client was given a layered .SAI2 or .PSD file, (s)he may not profit off of edits to that file (including but not limited to recolors, lineart edits, or isolated components of the image).
  6. The Artist does not claim ownership to any of the characters/subjects portrayed in the commission. Characters belong to their respective creator(s).
  7. The Artist does not care what the Client does with sold designs and characters. The Client is not required to notify the Artist of ownership changes, and is permitted to make or commission any art (s)he wants of that design or character.

Section 4 - Delivery/ Turnaround

  1. All commissions will be done digitally.
    1. There will be no hard copies.
    2. The Client is paying for a service/digital good and will not require any shipping of any kind.
  2. All commissions will be done in a hard cel shaded style or as specified in the commission type ordered.
  3. All commissions will be .PNG with dimensions ranging from 1000px - 3000px+ at 96 PPI, unless specified otherwise. Exceptions may be made, depending on the commission.
  4. The Client may request that he or she receives the layered .SAI2 or .PSD project file. Any extra charge for this is negotiable.
  5. The Client may ask for a specific canvas size for the commission.
    1. Commissions with a canvas size larger than 4000px will have an additional charge.
    2. Commissions with a canvas size smaller than 1000px may have prices negotiable. (Note: Smaller canvas sizes may result in losses to detail and/or quality).
  6. The Client may ask for the commission to be 300DPI if the Client plans to personally print the commission; however, there will be an additional charge.
  7. All commissions will be sent via a pre-negotiated delivery methos (e-mail, Discord, etc.) with the completed commission .PNG file attached.
  8. Unless specified not to upload the commission to the public, all commissions will be posted on the Artist's social media, resized and/or watermarked.
    1. Commissions will be posted on the Artist's social media after the Client has received and approved the original and unmarked commission file.
    2. The Client may choose to remain anonymous when the Artist publicly uploads the commission.
  9. Depending on the commission type and queue, the estimated turnaround is about one (1) week to three (3) months at the latest.
    1. If the Artist has to take longer than three (3) months to complete the commission for whatever reason, the Client will be contacted and informed of the status of his or her commission.

Section 5 - Payment

  1. The Artist prefers payment upfront. However, payment is only required after the Client has approved the sketch.
  2. Payment in USD via Paypal is universally accepted for all commissions.
  3. PayPal payment is to be done using invoices. The Artist will require the Client's PayPal e-mail.
  4. The Client does not need to pay extra for any of the PayPal fees.
  5. The Artist may take art or characters as partial or full payment, on a case-by-case basis.
  6. The Artist may take virtual currency on a case-by-case basis; however, the only petsite currency accepted is Flight Rising Gems.
  7. The Artist does not take cryptocurrency or NFTs.
  8. Payment must be sent within 72 hours after confirmation of the sketch.

Section 6 - Refunds

  1. If the Client cancels his or her commission for whatever reason, the Client will receive a partial refund, depending on how much of the commission has been finished:
    1. 80% refunded if in the sketching stage
    2. 65% refunded if in the inking stage
    3. 50% refunded if in the flatcoloring stage
    4. 25% refunded if in the shading stage
    5. There will be no refund if the Client cancels his or her commission when the order is past the shading stage.
    6. The Client will not receive any files of the commission.
  2. If the Artist cancels the commission for whatever reason, the Client will receive a full refund, in addition to a .PNG file of whatever progress of the commission has been completed.
  3. Refunds will be given within 72 hours after correspondence.
  4. The Client will not be refunded if (s)he is unsatisfied with the commission.
    1. If the Client is unsatisfied with the commission, the Artist is willing to discuss and make minor edits (ex. adjusting colours, length of claws, etc). Any desired major revisions (ex. reposing, entire colour scheme change, etc.) will be rejected.
    2. The only major revisions permitted are details that the Artist may have missed and was specified by the Client in the order form/correspondence while the commission was still in the sketching/lineart stage (ex. missing tattoos or scars, clothing details, anatomical errors, etc).
