Welcome to my T.O.S.! Here states everything you need to know about when buying or receiving art from me. Please note, by doing service with me that you agree to comply to these Terms Of Service. GENERAL: - Artwork modification: please don't modify my Artwork without my written consent. Redlining during the commission process or likewise for edits is fine! I usually allow modifications once asked or even offer them for free as long as it's not a complete change. - Do not repost my work on any Social Platform without properly crediting me (EX: Link to original, Name, Etc). Includes uploading onto sites that allow an extensive profile image description of images such as Facebook, you don't have to credit for a pfp on say TH or Twitter. - Do not attempt to falsify or impersonate IMPLUCIUM (Myself) or my Artwork through any means, including but not limited to: Tracing, Falsifying Accounts, Stealing, Etc. This is just an in general rule but it's also illegal. - You are NOT free to use my Artwork for commercial use such as selling T-Shirts, Phone Cases, Etc without my written consent (EX: Contracts, royalties), I am directly referring to mass production or resale of my art. If you have artwork from me then you have the right to make said Artwork for your own entertainment into physical items, without alterations of course (Non-Profit). I would love to see it! - Owning my Artwork does not in any way entitle you to claiming it as your own or misuse. - I cannot revoke Artwork or a Design that you have purchased or obtained by me through proper means, breaking T.O.S. will not allow me to do so. Instead see "Blacklist & Warnings". I do not revoke art/designs unless under suspicion that it is stolen. REFUNDS: - Refunds are rare but will be given if: I cannot complete your commission, I am going on Medical leave, There is a mistake. In some cases other circumstances will apply, funds are never spent until a commission is completed in the case I must refund. - I will not refund you over personal conflict, I believe that business and personal conflict should be kept apart. Personal conflict does not in any way exclude me from my priorities and will not interfere with my work. - Special cases: If there are any issues regarding this then please contact me and we may discuss if your case is appropriate for refund. Under a special case I will issue a refund. DESIGNS: - Designs by me are subject to any of the rules under General, License, Etc. - You may resell designs for no more than the original price, however if said design has added commissioned artwork then you may add up from there. You're allowed to mark down a price as well. Inflating design prices is very questionable unless factors above are the cause, please make my designs easy to access for others by keeping the original prices intact. - You do not need to contact me to redesign a character, when posting the original artwork by me please credit me. You are allowed to modify designer credits as long as my own art is credited, unless I am the sole and only designer (there are no other redesigns and original concept is my own). - ASK ME if you want to turn a design by me into a species/closed species because I often "remake" series of designs later on, a lot of the things I draw are similar. Since I remake concepts or recreate them, i'd best avoid it. RAFFLES, GIVEAWAYS, FREE STUFF, & OTHER: - In general it is bad taste to sell something you got for free unless you have purchased content for said designs. This includes COMMISSIONED or purchased works. This rule is in place to prevent people from flipping my designs. - If there is a situation (such as an emergency) maybe a resale or voucher for my art can be discussed. DM me if that's the case. Adding your own artwork and counting it towards monetary design value may be negotiable but I prefer you to reach out if you do this and be completely transparent that the character was initially free and said works are your own. BLACKLIST & WARNINGS: Failure to comply to any of these terms way result in a Blacklist or Warning based on the severity of the problem caused and frequency, WARNED users will be placed under a 6-Month BAN from participating in any Events, Commissions, Etc. BLACKLISTED users will be PERMANENTLY BANNED from using my services. BLACKLISTED: WARNINGS: CONTINUED...: - Unless I have a proper reason to Blacklist or Warn you, I cannot do so. Some examples that would allow me to include: Harassment, Stalking, Ban Evading, Failure to comply to Terms, Hate Speech, LGBTQ+ Phobia, Illegal Acts, and special cases. THESE TERMS MAY BE SUBJECT TO CHANGE OR MODIFICATION IN THE FUTURE. THANK YOU! : D
