Design Terms of Use
These terms of service apply only to Jolly Monster / Troldenil!
By purchasing or otherwise acquiring a Jolly Monster you automatically agree to the following conditions. If you have any questions, send me a dA note or email to [email protected]!
This TOS is liable to change at any time at my own discretion.

>> PAYMENT <<
- All payments are to be made in USD, sent through Paypal.
- If you've bought one of my designs through an auction you are expected to be able to pay immediately, and I will give you the full sized individual drawing of the design you've bought afterwards. If you've bought a custom design from me, I will only start working on it after I have received payment.
- I don't charge small edits to the design, but for major edits I may request a small fee.
- If you're completely unsatisfied with a design I will refund you, but I reserve the right to sell the design I made at a later time.
- I only hold for 24h! - After 24h have passed the design will go up for adoption again.
>> CREDIT <<
- Please credit me for the original designer, species creator and the original art when used and posted.
>> RESELLING & TRADING <<
- You are allowed to resell a design you have bought from me, but only at the same price that you originally bought it for.
- The value of any commissioned art you may have acquired of your Jolly Monster CANNOT be added to the value you are reselling your Jolly Monster for.
- MYOs CANNOT be resold! You can only trade or gift a myo-design. - You CANNOT sell a Jolly Monster that you obtained through trade or gift.
- You are allowed to trade/gift your design to someone, but you have to inform me first via dA note. In purpose of keeping track and the masterlist updated!
- If you found an interestant for a trade be sure to link them these tos, as they are the only ones applying for Jolly Monster .
>> CO-OWNING <<
- Co-owning is not allowed.
>> EDITING <<
- You are completely allowed to name and create a personality and backstory for a design you have bought from me, as long as the backstory fits in to the world created for the species.
>> SPECIES SPECIFIC EDITING <<
- it is strictly forbidden to change the horn type & tail type
- you are not allowed to change colorsor pattern of nose/claws/horns/eyes/pawpads
- you are not allowed to change the pelt color to white or black
This terms of service apply only for creations by OuroborosBytes or F3NRIRART (twitter)!
Character profile- You are prohibited to delete the original character profile created by OuroborosBytes.
- By purchasing an adoptable/design from OuroborosBytes, you receive the original artwork with and without watermark as well as the partial rights to the design
- I retain all artistic copyrights over my original work, which includes that, me the original creator, is not limited to the right to distribute, reproduce, or use the image as a sample for sales-promotion/self-promotion only. I will never re-use the same image or design for selling or trading unless the adoptable itself returns to my ownership.
- You may NOT claim the original artwork, creature creation or creature creation lore as your own.
- One-off designs: You are free to use the designs for personal and commercial projects as long as proper credit of the original designer is given.
- Species designs: You are free to use the designs for personal use and non-commercial projects. You may not use the design for commercial purposes without first consulting me for royalties.
- Sale
A character design by OuroborosBytes, received in a sale can be sold, traded and gifted.
You are allowed to resell the design for the same price or less.
You are allowed to resell the design for more than the base price if at least one (1) commissioned work is added.
If the base price is not listed, ask OuroborosBytes
- Trade
A character design by OuroborosBytes, received in a trade can be traded and gifted.
Is the character received through trade, the value resets to the original sale price and previous commissioned works cannot be added to the price again. Only future commissions are accepted to raise the price.
You are allowed to resell the design by OuroborosBytes only if at least two (2) commissioned pieces are added.
Example: Base price + value of commissioned work.
If the base price is not listed, ask OuroborosBytes
- Gift or Freebie
A character design by OuroborosBytes received as a gift can only be regifted.
Received as gift you are prohibited to resell the design for the original sale price.
You can resell the design if at least four (4) commissioned works are added. Only for the value of the commissioned works.
Prohibited actions result in a ban/block from future designs!
- Adding a sentimental value to raise the original value of the design
- Using Original Artwork: You are free to re-post the image or use it for layouts/graphics ONLY. Credit must ALWAYS be given to me for the original image.
- Please refrain from using the original artwork in your commercial projects. Use your own artwork.
- One-off Designs: may be freely altered and modified to suit your needs. You may change the species, outfit, traits, and any other features
- Species designs may also be altered, but the original character design must remain as it's default design. You may not alter species traits on the design to make it special, or change major elements of the design without first consulting
- Currently, species designs are outlined as the following species: Aerovull, Barasva, Kogbadjur, Troldenil (Jolly Monster), Rokvargr, Witchkin (includes Äljen).
- Art created by you while the ownership of a character design created by OuroborosBytes cannot raise their value.
Important: Violating my terms of service result into a block/ban from future designs. May they be sold, traded or gifted.
