Please note that when referring to "the creator", the terms of service are referring to the creator of the adopts and the owner of this account, also known as FirePyr.

The creator may be contacted via Amino (FirePyr), toyhouse (FirePyr), instagram (firepyrworks), twitter (firepyrworks), tumblr (firepyr), Deviantart (FirePyr), or email ([email protected]).

When referring to "the client" the terms of service are referring to the potential and/or current buyer/owner of a FirePyr-created design/adopt.

1.0 The creator, the owner of this account (FirePyr), reserves the right to refuse any offers/bids/etc for any reason and to change the Terms of Service anytime without given reason. Current owners of FirePyr designs are advised to keep updated on the current Terms of Service on their own time.

2.0 The terms of service regarding adopts are applicable for ALL adopts, even if not stated in the adopt post, UNLESS otherwise specified in the specific adopt post itself. For example, if the terms of service state no reselling and the client wishes to buy Adopt A, the client may not resell Adopt A unless Adopt A's post has explicitly stated that reselling is allowed.

3.0 Regarding payment, there will be no refunds once the adopt has been sent.

4.0 If payment is completed, but the adopt has not been sent: For Amino Coin or Deviantart (via gift and not commission widget) payments, a full refund may be given unless otherwise specified in the adopt post itself. If payment is in cash (via PayPal or via commission widget for DeviantArt), refund may be less that what was sent, because PayPal and DeviantArt commission widget takes a percentage. For example, if payment is $5.00, the creator may only receive $4.50. The creator will send back $4.50 but by the time it reaches the client, it may be just $4.00. If refunding via DeviantArt commission widget, the creator can also refund via gift, in which case the DeviantArt point amount of $4.50 (for this example) will be given. Please note the creator is not familiar with PayPal refunds, so the example given may not be wholly accurate.

5.0 Once sold, the client can: Resell at any price as long as this terms of service journal must also be linked in the reselling post somewhere. Optional but appreciated if the creator is notified on who the new owner is. The client may also make changes to design/color scheme and change gender/age/relationships/sexual orientation/personality/etc of the character's bio.

6.0 If NOT buying from the source (aka me, FirePyr) directly, the creator is not responsible if the client has been scammed and will not be responsible for giving the client a refund of whatever the client has paid. The client is responsible for abiding by the creator's terms of service for any adopt the creator made that the client owns. In cases where other artists' or creators' terms of service also apply, the client holds themselves responsible for abiding by those terms of service as well.

7.0 The client DOES NOT own any of the creator's adopts unless the client has paid for them in some form, or (as in the case of gifts/raffle prizes/etc.) I have explicitly stated the adopt is now the client's ownership.

8.0 Any adopt design of the creator's should always be credited back to the creator with a link to the creator's amino (FirePyr)/toyhouse (FirePyr)/instagram (firepyrworks)/twitter (firepyrworks)/tumblr (firepyr)/deviantart (FirePyr) page.

9.0 The creator reserves the right to display any of the creator's artwork of a sold adopt in the creator's gallery/website/social media/etc. when showing potential clients the creator's previous work.

10.0 In regards to gifts/free adopts/raffle prizes/and similar, adopts are not to be resold or traded unless extra art is present for the character. This extra art should be a full piece and not just a quick doodle or sketch. Regifting is always allowed, with or without extra art, but it is preferred the creator is notified of who the new owner is, if not on Toyhou.se.

11.0 In regards to those who are NOT the owner of an adopt, stealing of the adopt is not allowed and will be subjected to blacklisting.Using the adopt and/or its pictures in actions including but not limtied to: roleplaying, as a story character, as a profile picture, etc. without permission is strictly prohibited. Heavily referencing an adopt of the creator's is forbidden.

12.0 The client must read, understand, and agree to all the above terms before entering into an agreement with the artist. By sending payment or accepting the adopt, the client is stating the client has read, understood, and agreed to the above terms.
