TOS

This is a simplified T.O.S for art and designs made by Keats/KraheArts/Jacziel and their collaborators/co-creators. By owning a design or commissioning art by this artist, you automatically agree to these terms.

GENERAL RULES:

• I, as the artist, reserve intellectual and artistic rights over the artwork and character design(s). Please always link back to my TH or Devianart if you post images or characters created by me, on other sites.
• Co-ownerships are allowed, but please do not expect me to get involved with any disputes that happen between the two parties.
• DO NOT use any designs made by Keats/KraheArts/Jacziel for commercial use without explicit permission from Keats/KraheArts/Jacziel and their co-creators/collaborators.
• Please notify me of ownership transfers so that I may keep track of my designs. This applies to TH and off-site.
• Gift art does not add monetary value to a Keats/KraheArts/Jacziel design.
• Digital currency such as BitCoin, Amino Coins, dA points ect. Do not count as currency for valid commission value on Keats/KraheArtz/Jacziel design(s). You can still buy a commission with digital currency, but only currency used by the average individual in each country is acceptable.
• Any designs that have been deleted or I was blocked from editing still adhere to these terms. You will be promptly reported if I find you going against my TOS. This could result in blacklisting or the return of designs.

TRADE/SELLING/GIFTING RULES:

• Did you buy a Keats/KraheArts/Jacziel design?: You cannot resell the base design any higher than what you originally paid for it unless you have paid for commissioned art.
• Did you Trade for a Keats/KraheArts/Jacziel design?: You cannot sell the design unless there is paid commission art. The design value will be the commissioned art total.
• Were you gifted a Keats/KraheArts/Jacziel design?: You cannot sell the design unless there is paid commissioned art. The design value will be the commissioned art total.
• (This only applies to any design(s) made after 2023) If you receive a Keats/KraheArts/Jacziel design as a gift with no commissioned art attached, you will need to draw the design in your style once before giving it away. It does not matter if you are the 2nd or 10th owner, you are still required to draw the design before regifting.
• Make sure the next buyer/trader is aware of the TOS and worth of the design(s) before any transactions are made.

DESIGN EDITS:

• You are allowed to change their clothes, gender, ethnicity, colours.
• You may make minor edits to the original artwork.
• You may receive all kinds of art and commissions, gifts ect. For personal display with proper credit to me for the design(s).
• Do not make clones/twins of the design without permission.

DISCLAIMER:

• Terms and conditions are subject to change as I see fit.
• Designs that originally had personal terms, those terms are no longer valid, even if I am no longer able to edit them due to theft, deletion or blocking by the individual owner.

Please make sure you are crediting the source and always contact the original creator(s) of when a design is gifted, resold or traded. I have been recently checking my designs once a month to keep track as well.
