TOS for adoptables

This document is organized into rights specific to the designer, VentisetteStars/Beth Walker, and rights specific to the Owner.

By purchasing my designs, you are agreeing to these terms unless other agreements are made in writing elsewhere between me and the purchaser.

Copyright and Usage Policy

Designer:

• I retain all intellectual property copyrights to the official art and design.

• I reserve the right to include design for self-promotional purposes such as in my portfolio or online galleries.

• I reserve the right to include the design and any process images in printed materials such as, but not limited to, printed sketchbook compilations or art books.

• I do not have the right to use the design for personal or commercial projects where the design would be used outside of showcasing my art, unless I purchase/trade the design back from the owner. For example, I can't make a webcomic or a novel series with the design used in it.

Owner:

• You cannot claim to have created the design nor the art showcasing it.

• Design can be posted anywhere as long as VentisetteStars is credited. This includes the use of the art for group roleplay apps, social media icon/avatars, banners, headers, footers.

• The design and art can only be used for personal non-profit* purposes. This includes, but isn't limited to, role-playing, writing, and/or world-building projects. *Non-profit refers to creative work or project that doesn't generate any profit or involved with generating income. It is not a merchandise, nor is it funded by investors, nor is it funded by any subscription services such as Patreon. Absolutely no money is involved in the creation or distribution

• You cannot use the design nor the official design art in any commercial work*. *commercial work referring to anything that generates income in any way or form. Such as but not limited to: webcomics with ads or that are monetizable, print, merchandise, Patreon, subscription-based platforms.

• If you would like to use the design for profit, you can purchase the rights to the copyright from VentisetteStars. This is can be negotiated through email at [email protected]. If purchased, a contract as proof will be included with the invoice as well as through email.

• You may get commissions of the design, however additional art does not increase the design's value if you ever decide to resell it.

• You cannot make major changes to the base* design without contacting VentisetteStars about what you would like to change. Most times, it won't be a problem. *Base design doesn't include outfit changes. Though feel free to share anyway as I love to see where designs go.

• You may resell the design but not over the amount you had paid for.

• You may trade the design, but from that trade forward that design is no longer resell-able, only trade-able.

• Please notify me if sold/traded the design and make sure that the new owner is sent the TOS before they purchase.
