DESIGN & ADOABTABLE TERMS OF SERVICE
► I retain rights to the artwork and intellectual property. Because a designs is not a tangible item/service, what is being purchased is the license to use the design itself Kouyne holds rights to the creative integrity of the product
► Regardless of how much is spent on the design, only partial rights are being bought and Kouyne retains the full commercial rights unless given away in contract.
► Your rights after payment for the adoptable include the right to draw the character, posting the character on other sites with credit to Kouyne, commissioning art of the character, printing the character, and including the character in any personal use projects
► As Kouyne retains the rights to the artwork and intellectual property you can not create a TOS and expect others to abide by it if it contradicts this TOS that you're hereby abiding by. Because a license is purchased by yourself to use the design, you have no legal rights to add stipulations for future license holders.
► TOS may be subject to change and changes can be discussed with Kouyne if it was something significant & not agreed upon with the TOS at the time of purchase. You are expected to review and follow updated TOS otherwise.
► Violation of this TOS may result in Blacklisting and revocation of the adoptable under the reasons of, but not limited to, chargebacks, selling/trading/gifting to blacklisted users, upselling to make a profit, being engaged in illegal activities or discriminatory hate.
► You have the right to resell, trade or gift those partial rights in any way that does not contradict the TOS.
► After re-sale of a design, the new owner must abide by these Terms of Service and it is your responsibility as the party selling the rights to make sure they agree to it. This can be done by telling them "by sending payment you are agreeing to the TOS linked below".
► Reselling may only include the original purchased amount, as well as any commissioned pieces if you have permission from the artist. Personal art pieces cannot count towards the value.
► If you trade or gift a design, The new person must be informed they cannot resell the design under any circumstance unless they obtain permission from Kouyne.
► Users that are Blacklisted cannot purchase or obtain designs directly from Kouyne or current adoptable owners by any means
