Design Terms of Use

By owning this design, you, the client, henceforth referred to as Party A agrees to the following terms set up by the artist, henceforth referred to as Party B:
Party A is not allowed to claim the design as their creation. The artist, Party B, retains their rights as the original creator and must be credited whenever necessary even after the design has been tweaked in any way.
Party A is allowed to redesign the purchased character however they see fit. However, this redesign must be done on a separate canvas and the original art cannot be drawn over or tweaked for this purpose.
Party A is not allowed to inflate the price of character design; meaning they are not allowed to resell the design higher than what they bought it for. However, Party A is allowed to resell the design if/when there are extra art pieces available, either drawn by Party A or obtained from commissioning other artists through monetary means. Party A is not allowed to add the value of free art into a design’s monetary value.
Party A is not allowed to profit off the character design in any way, including commercialization, unless Party A has obtained explicit permission from Party B to do so. This includes NFTs.
If Party A has obtained Party B’s design through other means than monetary values (e.g., by exchanging art for the design, or physical goods), then Party A may not resell the design for monetary value. Party A may not sell a design that they obtained through character trades. However, Party A is allowed to resell the design if/when there are extra art pieces available, either drawn by Party A or obtained from commissioning other artists through monetary means. Party A is not allowed to add the value of free art into a design’s monetary value.

Once a design is paid for, Party A may not issue a chargeback. This is a consensual purchase of digital goods and personal rights to a piece of art. In case a chargeback does occur, the rights to the character return to Party B.
Party B does not do refunds once a payment has been made.
In case any one of these terms is violated, Party B reserves the right to take legal action and blacklist Party A from any future purchases and trades of Party B’s character designs.
