☆ TOS terms of service ☆

• updated on the 26th May 2023 please read to make sure you're up to date! •

• please make sure to read this!! You automatically agree to these terms when you received a design made by me or when you commission me! •

• On toyhou.se I have been listed as designer when I am the maker of the character! You must always follow my tos regardless if im listed as the creator or designer due to this reason •

1. BLACKLISTED USERS

- Please ALWAYS look at this list before accepting an offer from someone to make sure someone on my blacklist doesn't get a design I’ve made!

2. Commissions 

- Payment must be sent first before I start drawing! 

- once payment has been sent you will be added to my Trello! 

- all art I make for others will have the little gold stamp watermark 

- I do not allow refunds however for designs you are welcome to resell the design for the price you got them for when you get the final design image file!

- please always make sure you read a commission ad fully to avoid any misunderstandings!

Commissions progress:

- sketch phase: I can make changes to poses and small edits  (If on base however I cannot edit the pose!) (Any corrections if I missed details of the character!) 

- line art: no longer allow for edits on pose and lines 

- colour: allow for colour-related edits only 

- once the drawing is finished no edits can be made!

Custom designs progress:

- sketch phase: I can make changes to poses and edits to design (If on base however I cannot edit the pose!)

- line art: no longer allow for edits on pose and design lines 

- colour: allow for colour-related edits only 

- once the design is finished no edits can be made!

3. Re-selling and trading 

- please let me know when you are Re-selling a design I made! ( For any other like trading or gifting you don’t need to inform me!) 

- you cannot sell a adopt for more than what you paid for (if found the character value will be put on the rules part of the ownership and the person who overprices the design will be blacklisted) Only in special circumstances that have been discussed prior with me can I approve a character be sold for more but this has to be agreed with me first before you put the character up for sell  

4. Closed species

- designs that are a closed species made by me I would prefer still keeping the cs form than being discontinued. You are more than welcome to give the design difference species aus (one-off species or other cs!) And priviting the cs form! However, exceptions can definitely be made! It just needs to be discussed with me prior! 

5. Credit 

- Please always make sure to credit me!

- Never pretend to be the designer/artist. being an art thief will get you blacklisted 

6. Personal use and commercial use 

- All art made by me will only be for personal use unless with very clear permission saying otherwise 

- Strictly no NFT I do not give permission for any art or design I make to be used as NFT

no one regardless of personal use or commercial use has my permission to ever use my art or designs I make for NFT minting

- Strictly no AI I do not give permission for any art or design I make to be fed into an AI

- For designs, I make they are for personal use only unless with very clear permission saying otherwise 

- If a character has been given the permission for commercial use it will be very clearly stated in The List of approved permission given for commercial use

( if iv been credited as a designer on Toyhouse when I made the character it will always be only for personal use due to being unable to alter the tos)

- With discussions/agreements with me designs I've made in the past can be upgraded to have commercial rights but there will always be an extra up cost

- if the character has been granted commercial use it is only for the design, not the art I made! (However, agreements can be made! )

- if anyone is found trying to use a personal use character commercially Action will be taken

- the design I make is to have fun with and enjoy not to just make a profit!

7. Other 

- never use designs I make for Illegal content, hate speech or anything similar  

- I don't ever allow the lightening of the skin in any poc designs I make 

- when getting my art/design by me you get the license to use it. I keep the Intellectual property to the art/design meaning that I can use it as examples for further commissions!

- I retain the rights to all art I make 

- art trades I will start my half after the person I'm doing an art trade with has started unless its someone iv done an art trade with before (to prevent scamming)

8. BLACKLIST 

• some users blacklisted are in a private blacklist. All users I have blocked are blacklisted • 

The following are ways that you get blacklisted if you do them:

- not following my tos

- not giving credit 

- removing my watermark (including cropping it out) 

- draw on my art/edit my art without getting permission to do so first

- be an art thief

- scamming me

- behave rudely to me

- giving a design to someone blacklisted (mistakes tho happen so you will get a warning first if this happens if it was a mistake)

- heavily reference, copy my art or designs

- time wasting 

- backing out of already agreed things  ( Note!: This doesn’t include things like art offers on characters if you're unable to complete the offered art as long as you inform me it's totally fine I always fully understand!) 

Etc 

What it means to be blacklisted by me

- you no longer can get any of my services (commissions, designs, art trades etc)

- if you own a design by me you have to re-home the design to someone unrelated to you

- you cannot get my art or designs from a 3rd party 

- you will get blocked 

- you no longer can interact with me or my art/designs
