Adoptable T.O.S

________MODIFYING WORKS (section 01)

-- DO NOT Alter/Change the design's original artwork. You may make a separate copy of the original artwork to edit on as you please. You must still specify that it's my work you've made changes to, ie. give me credit for the original artwork on your edit.

-- I will not make color changes or edits to a premade adopt unless offered at the time of posting

-- When purchasing an adopt you may inquire about minor changes/edits for a small fee

-- Requests for major changes will have to be done through Custom Commission (If you want me to be the one to edit it, that is.) You can always commission another artist to make you a new piece of the adopt with your requested modifications.

________PAYMENT METHOD(S) (section 02)

-- ALL purchases will be done through Paypal Invoices unless another method is offered. (CashApp is being considered)

-- Adoptables sold in DeviantArt points CAN ONLY BE SOLD in points or its RL-currency equivalent. You may consult me about pricing questions.

-- I WILL NOT HAGGLE PRICES! If you noticed a price dropped its by my own choice. Please do not try to haggle down prices.

-- Any charge-back issued without prior warning or discussion with me to reach a more desirable resolution will be taken with great offense and result in an immediate blacklist.

________ADOPTABLE RE-OPENING & HOLDING POLICY (section 03)

-- An adoptable Opens again if payment is not received within the hold limit.

-- After your hold expires, the adopt will re-open publicly or go to the next buyer who expresses interest.

-- I may hold adopts for longer if specified.

-- If you wish to hold an adopt for an extended length of time, you must first approach me with the details of your holding requirements before publicly claiming the adopt. In most circumstances I will not hold an adopt for longer than 2 weeks. (this may have some leeway if it's a highly expensive design) I will not hold a design for 2 weeks if it is less than $120 and any down payment made on an adoptable design will be considered non-refundable should you ghost me or have to back out of the hold/sale.

-- You (the buyer) understand that if rules are ignored or the hold limit expires, you are not required to pay for the design and will not be given priority.

-- You understand that if you choose to avoid me during multiple attempts--by you-- to purchase one of my designs, you will be banned from all adopt sales in the future and considered for the blacklist if you do this with commissions as well.

________RESELLING ADOPTABLES (section 04)

-- DO NOT Resell for more than you purchased them for!

-- Additional art that you have spent your own money on may be included on top of the design's original value.

-- Any commissioned piece of art that features a character that your design is in a relationship with cannot be added to the design's overall value as this will not be relevant to the new owner's personal interests and intents for the design and thus it is not fair to expect them to pay for it.

-- You (The Buyer) understands that you should notify me (the artist) of a design transfer.

--- This will ensure the safety of the design and/or be proof of ownership should they run into any problems later.

--- Note: Adopts are digital goods and should only be sold as such.

________TRADING ADOPTABLES (section 05)

-- Trading a design to someone? As stated above, let me know who the new owner is!

-- Adopts purchased then traded will only be tradeable/giftable/voucher-able.

-- Original value should only be used for determining what it should be traded for.

-- Do not inflate value based on what you trade for it (ex: trading a $100 design for a $30 one). Please provide/refer to the original purchase + any purchased commission price for its value.

-- DO NOT try to sell an adopt you obtained through trade or gift without my permission. (You'll need to keep proof of my permission)

-- Adopts obtained through giveaways cannot be traded. Only gifted!

-- Pieces put into the design drawn by YOU (or gifted) do not raise the value!

-- If you've commissioned additional works of the design, keep track of the prices you paid for each piece for ease of determining the design's overall value later on.

________VOUCHERS (section 05.2)

-- My designs can be traded for real items/merchandise or gift cards, etc. You do so at your own risk, however. I cannot be held accountable for any scamming that might possibly occur. It goes without saying but don't share your address with anyone if you are not comfortable with doing so.

-- In such instances of a design being traded for real items/merchandise or gift cards, the value of the item the design is traded for becomes the new value of the design.

-- You CANNOT resell an adopt you got in a voucher exchange unless I give you permission to do so. (You'll need to keep proof of my permission)

-- If you got a design via voucher, you can re-voucher it for another design that's worth the same price OR LESS.

-- Vouchers cannot be exchanged for money

-- Do not inflate the prices of vouchers based on what you traded for it. Vouchers should be the same as the original sale price UNLESS you've purchased additional art for it.

-- Art or character vouchers are allowed. (i.e. offering art or characters in exchange for a new design that someone buys directly from me)

-- Traded designs may be vouchered for the base design value (+ any commissioned work owner has added to the design since obtaining)

-- If it does not have any resale value, do not resell!

-- If you're unsure, please ask me! Permission of vouchers may be revoked if abused, please use them responsibly!

________FREE & RAFFLED ADOPTABLES (section 06)

-- Raffle adopts w/no additional pieces of commissioned artwork should not be sold for currency or traded.

-- It was free, so unless there's money put into it, it should stay free.

-- If this is the case, contact me to let me know!

-- Pieces put into the design drawn by YOU (or gifted) do not raise the value!

________GRANTING OF RIGHTS (section 07)

-- I retain rights to authorship credit of my designs.

-- I agree that Design Work/Adoptables are produced with the intent that it/they be unique and will not seek to resell or publish Design Work/Adoptables that have been sold unless I have stated that said Design work or Adoptable is part of a series or species that I intend to make derivatives of to keep or sell at my discretion.

-- I reserve the right to use all past, present, and future designs when promoting myself and my work, ie. featuring designs in a portfolio or in a page of commission examples. I will not, however, use your design to make merchandise.

-- PLEASE credit me as the original author of the design when you draw them, repost to a site such as ToyHouse or anywhere that you are featuring the design for the first time. [RedDiamondVespa @ dA, FA, TH, Instagram, Twitter, etc. In some possible instances RedDVespa, or ScyllaLovelace when appropriate.]

-- Overall, my designs are for non-commercial use (see section "COMMERCIAL RIGHTS") as long as design credit is properly given.

-- The original artwork of the design IS NOT TO BE USED FOR COMMERCIAL PURPOSES.

________COMMERCIAL RIGHTS (section 08)

-- You (The Buyer) understands that you are not allowed to use my art of the design for profit in any way (under most circumstances, see below to see what you can do for commercial use)

-- You may resell the complete design for the price that you purchased it for/invested into the design.

-- You are allowed to include my designs in games/comics/videos and other mass media consumed materials for profit or non-profit productions (with proper credit). However, you may not use my original artwork of the design as part of any of these publications.

-- You may make charms/shirts/prints/business cards/post cards featuring the character you have purchased so long as they are made in limited quantity, and the art is YOUR OWN art, or art purchased from another user with explicit permission from them to use said art.

________BLOCKCHAIN POLICY (section 09)

I, RedDiamondVespa/RedDVespa/ScyllaLovelace, absolutely do not create or participate in any Blockchain-related technology. If any of my designs are found to have been implemented into a Blockchain-related system, I will respond with appropriate legal action and demand monetary compensation. (This includes NFTs)

-- Failure to follow this rule will also result in a permanent ban+blacklist from purchasing, trading, or owning any of my designs/work in the future. The design/work in question will also be reclaimed and repurposed for my own personal use or otherwise resold as I see fit without refund to the violator of this rule. -- By purchasing or obtaining my designs through other means: You agree that you will not create or participate in any Blockchain-related technology using my work or my designs.

-- This includes commissioning another artist's work of my designs and using it in any Blockchain technology.
