TOS:

- Credit me the first time you use the character and/or post them to a different website! After that, crediting is optional, just please don't say you designed the character all by yourself. If you're uploading the OC to Toyhou.se , please credit me as Kawaiimarshmallowkit (on site creator).

- Redesigns are allowed as long as the character is still at least somewhat recognizable as the design I created. This is more of a guideline/suggestion rather than a solid rule, so it won't get you blacklisted if you do redesign them beyond recognition.

- Holds are for two weeks! If I don't hear from you within two weeks, I will notify you that I'm taking the character off hold. I can extend the hold for another week at max if you ask. If I take the character off hold after the extension is up, but you later get enough currency and the character is still available, you can still buy the character after I've taken it off hold. I don't want people taking advantage of the hold system by convincing me to put designs on hold for ridiculously lengthy periods of time, which is why I have it set up like this.

- I will not start working on customs or YCHs until I've been paid. Please don't order customs or YCHs from me if you know you can't pay.

- You cannot re-sell free adoptables (exceptions can be made), but you can re-gift or re-trade them. You can only re-sell free adopts if they were originally up for sale and later made free, OR you have added extra worth to them (your own art, writing, commissions, etc). I don't care if you donate my designs to character shelters since their currency (if they have one) is typically fictional anyway.

- If you decide later on that you no longer want a design you got from me, you are free to give them back to me if you really want to, but you don't have to. Keep in mind that this does not mean I will give you a refund or offer on the character to get them back, so only send my designs back to me if you just want to get rid of them and aren't looking for anything in return.

- I am not comfortable with giving my designs to kink/fetish and NSFW accounts, since I really don't like the idea of designs I made potentially becoming someone's kink OCs. I'm not saying you can't use designs you bought from me for this kind of content, I know I can't stop you, but trying to buy a design from me while using a primarily fetish/NSFW account will make me assume you intend to use that design primarily for NSFW/fetish content, and ideally I don't want designs I've made to become heavily associated with kinks/fetishes and pornographic content. This means that if you are on a primarily kink/NSFW filled account and are trying to buy from me, I will turn you down. I won't blacklist you if you do use a design you bought from me for NSFW/kinks, however, if that design is being portrayed as a minor/loli/shota or a feral animal in the NSFW/kink art, you will be blacklisted. You will also be blacklisted if you involve the design in incest artwork or noncon themed artwork in general.

- DO NOT USE MY ART OR DESIGNS TO MAKE OR PROMOTE AI IMAGES!! IF YOU ARE PRIMARILY AN AI "ARTIST", I WILL NOT SELL TO YOU!

- I no longer revoke OCs unless under specific circumstances. If you end up on my blacklist and/or get blocked by me, your OCs will not be revoked regardless of what you did. If you've been blocked or blacklisted by me and someone else gives you a design I made afterwards, I won't revoke the character, but depending on the situation, I may put the person who gave you the design on my blacklist if I somehow find out about the transaction. If you use an alt account to get designs from me despite being blocked or blacklisted, your alt will be blacklisted, but you can keep the character(s) if I've already given them to you by the time I find out you were block evading, assuming you didn't also scam me.

- There is ONE exception where I will revoke OCs, and that's in the event of a scam/chargeback. For example, if we trade designs and I find out you've given me a stolen design, I will take back the character I gave you.

- You might be able to get off the blacklist, but you'll have to discuss it with me first. If you did something really bad (ex. stole mine or other peoples designs), then you'll likely not be able to get off the blacklist unless you can prove you've changed. If you're one of the people who did something really really bad to get on the blacklist (ex. acted gross towards minors), you will likely never get off the blacklist.
